G-13-02-28-H2 - 2/28/2013ORDINANCE NO.IZ- AN ORDINANCE AMENDING CHAPTER 22, THE CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS BY ADDING SECTION 22-8 ESTABLISHING A TRAFFIC SAFETY FUND; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That Chapter 22, Code of Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended by adding Section 22-8, Traffic Safety Fund, which shall read as follows: Sec. 22-8. Traffic Safety Fund. (a) Establishment of Traffic Safety Fund. Pursuant to Chapter 707, Texas Transportation Code, there is hereby established the Traffic Safety Fund. (b) Source of funds. Funds are derived from civil or administrative penalties collected by the City for traffic signal violations under the City's photographic traffic signal enforcement system. Such funds are held, disbursed, and used in accordance with Section 707.008 of the Texas Transportation Code. Section 707.008(a)(2) requires that certain of those funds be deposited in a special account in the City's treasury that may be used only to fund traffic safety programs, including pedestrian safety programs, public safety programs, intersection improvements, and traffic enforcement. (c) Statutory requirements. The City shall do the following: (1) From the funds derived from civil or administrative penalties collected by the City for traffic signal violations under the City's photographic traffic signal enforcement system, the City may deduct and retain amounts authorized by Section 707.008(b), to -wit: (a) amounts necessary to cover the costs of purchasing or leasing equipment that is part of or used in connection with the photographic traffic signal enforcement system in the City; (b) installing the photographic traffic signal enforcement system at sites in the City, including the costs of installing cameras, flashes, computer equipment, loop sensors, detectors, utility lines, data lines, poles and mounts, networking equipment, and associated labor costs; (c) operating the photographic traffic signal enforcement system in the City, including the costs of creating, distributing, and delivering violation notices, review of violations conducted by employees of the City, the processing of fine payments and collections, and the costs associated with administrative adjudications and appeals; and (d) maintaining the general upkeep and functioning of the photographic traffic signal enforcement system. O:\ dox\SCClnts\0112\1304\MUNICIPAL\00268639.DOC/jkg (2) Not later than the sixtieth (60'h) day after the end of the City's fiscal year, the City shall send fifty percent (50%) of the revenue derived from civil or administrative penalties collected by the City for traffic signal violations under the City's photographic traffic signal enforcement system to the Comptroller for deposit to the credit of the regional trauma account established under Section 782.002 of the Health and Safety Code. (3) Thereafter, the City shall deposit the remainder of the revenue in the City's Traffic Safety Fund, and those monies shall only be used to fund traffic safety programs, including pedestrian safety programs, public safety programs, intersection improvements, and traffic enforcement. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
