L— 9 -04- % AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 46-132(b)(1), CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO REZONE 21.53 ACRES OF LAND, OUT OF THE WILEY HARRIS SURVEY, ABSTRACT NO. 298, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM DISTRICT PF -1 (PUBLIC FACILITIES - LOW INTENSITY), DISTRICT TH (TOWNHOUSE), AND DISTRICT C-2 (LOCAL COMMERCIAL) TO DISTRICT PF -3 (PUBLIC FACILITIES - HIGH INTENSITY). WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas to amend the Official Zoning Map to rezone 21.53 acres of land, out of the Wiley Harris Survey, Abstract No. 298, in Round Rock, Williamson County, Texas, being more fully described in Exhibit "A" attached hereto, from District PF -1 (Facilities - Low Intensity), District TH (Townhouse), and District C-2 (Local Commercial) to District PF -3 (Public Facilities- High Intensity), and WHEREAS, the City Council has submitted the requested change in the Official Zoning Map to the Planning and Zoning Commission for its recommendation and report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 6th day of March 2013, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the property described in Exhibit "A" be zoned District PF -3 (Public Facilities- High Intensity), and WHEREAS, on the 11th day of April, 2013, after proper notification, the City Council held a public hearing on the requested amendment, and O:\wdox\SCCInts\0112\l304\NR NICIPAL\00271416.DOC/rmc Rev. 12/11 WHEREAS, the City Council determines that the zoning provided for herein promotes the health, safety, morals and protects and preserves the general welfare of the community, and WHEREAS, each and every requirement set forth in Chapter 211, Sub -Chapter A., Texas Local Government Code, and Section 46-92 and Section 46-105, Code of Ordinances (2010 Edition), City of Round Rock, Texas concerning public notices, hearings, consideration, findings, and other procedural matters has been fully complied with, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the City Council has considered and hereby makes the following findings regarding this amendment: 1. It is consistent with the general plan; 2. It is compatible with the present zoning and conforming uses of nearby property and with the character of the neighborhood; 3. The affected property is suitable for uses that are and would be permitted by District PF -3 (Public Facilities- High Intensity); and 4. Water, wastewater, and stormwater facilities are suitable and adequate and are available for the permitted uses in District PF -3 (Public Facilities - High Intensity). That the Official Zoning Map adopted in Section 46-132(b)(1), Code of Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended so that the 2 zoning classification of the property described in Exhibit "A" is hereafter designated as District PF -3 (Public Facilities- High Intensity). A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. (First Reading*) Type: Ordinance Governing Body: City Council Agenda Date: 4/11/2013 Dept Director: Brad Wiseman, Planning & Development Services Director Cost: Indexes: Attachments: Ordinance, Property Description, RRISD Success High School Update Text of Legislative File 13-137 This site was zoned in 2005 for a place of worship (PF -1 - Public Facilities - Low Density), TH (Townhome) and C-2 (Local Commercial) uses. It has remained undeveloped. The Round Rock Independent School District (RRISD) since acquired it for use as a non-traditional public high school. The PF -3 (Public Facilities - High Intensity) zoning district allows places of worship with an unlimited size of accessory uses, in addition to hospitals, medical offices and high schools. The proposed school is to be designated the Success High School, and it will serve students on a non-traditional path towards graduation. A "Success High School Update" provided by the RRISD is attached for further information. Classes will be scheduled and designed for students who may need to work to support their families, have previously dropped out of traditional high school, or desire to accelerate or customize their education. Class scheduling will not be limited to the traditional school hours in order to meet the needs of individual students. The school will be designed to support a relatively small number of students, with an enrollment of less than 400. For these reasons, the Success High School is not expected to add significantly to morning or evening rush hour traffic. In addition, the City is planning improvements to the intersection of Gattis School Road and South Mays Avenue in order to improve traffic circulation in the area. The site is to be served by a driveway to Gattis School Road at Surrey Drive, where there is an existing traffic signal. A driveway to School Days Lane will also be provided. Voight Elementary School is located to the north, along with the Round Rock Soccer Association fields. Residences, including apartments, are located to the east and west of the site. The Kensington Heights neighborhood is located to the south. City staff spoke with Will Williams, the president of the Kensington Heights neighborhood association, with regard to the proposed zoning change and gave him copies of the public notice and the update.
