R -13-05-09-G1 WHEREAS, Section 43.065(a) of the Texas Local Government Code requires that, within certain specified statutory timeframes, the City Council of the City of Round Rock must direct the City's Planning Director to prepare a service plan that provides for the extension of full municipal services to the areas which are proposed for annexation, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the City Council hereby directs the City's Planning Director to prepare a service plan that provides for the extension of full municipal services to the following area proposed for annexation, said property being further described in Exhibit "A" attached hereto and incorporated herein for all purposes. (1) Approximately 7.90 acres of the Smyers Lane right-of-way, between Wyoming Springs Drive and O'Connor Drive. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. On January 27, 2011, the City of Round Rock signed an interlocal agreement with Williamson County (Resolution No. R -11-01-27-14B). That agreement stated the County would make certain improvements to Smyers Lane, and the City would annex the right-of-way, thus assuming maintenance responsibilities. Because this is annexation of right-of-way only, it is not expected to impact any existing uses. Pursuant to State Law, the City Council is required to officially direct staff to prepare a service plan for land to be annexed unilaterally. Once directed, staff will prepare and present a service plan to the Council. Because this is annexation of right-of-way only, it is not expected to require the extension of any utilities. The service plan is required even if no utilities will be extended. Upon the Council acceptance of the service plan, a series of notices and public hearings will be held. Two public hearings are scheduled for June 25, 2013, and June 27, 2013. On May 24, 2013, written notice of the annexation will be sent by certified mail to all public and private utility providers that could be affected. Published notice of the June 25, 2013, and June 27, 2013, hearings will appear in the Round Rock Leader and on the city's website on Saturday, June 8, 2013. Staff recommends approval.
