G-04-07-08-8D2 - 7/8/2004ORDINANCE NO. �- D4- 0709- AN 7O8' AN ORDINANCE AMENDING CHAPTER 9, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, ADDING A NEW SECTION 9.504, "TEMPORARY CONSTRUCTION SPEED ZONES" AND ADOPTING A TEMPORARY CONSTRUCTION SPEED ZONE FOR A PORTION OF LOUIS HENNA BOULEVARD; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356(b) of the Texas Transportation Code gives the governing body of a municipality the same authority as the Texas Transportation Commission to alter prima facie speed limits when a highway is under repair, construction or maintenance, and WHEREAS, Section 3 of the Procedures for Establishing Speed Zones adopted by the Texas Transportation Commission states that normal speed studies are not required on sections of a highway under construction, and WHEREAS, construction will soon commence on State Highway 45 along Louis Henna Boulevard from County Road 170 to Donnell Road, and WHEREAS, in a letter attached hereto as Exhibit "A, " the Texas Department of Transportation sets out the statutory justification for, and has requested that the City adopt by ordinance a temporary speed limit of 45 miles per hour on Louis @PFDesktop\::ODMA/WORLDOX/O:/WDOX/ORDINANC/040624C3.WPD/S15 Henna Boulevard from County Road 170 to Donnell Road until the construction of State Highway 45 is completed, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9 of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to add Section 9.504, Temporary Construction Speed Zones to read as follows: 9.504 TEMPORARY CONSTRUCTION SPEED ZONES (1) During construction of SH 45, the temporary maximum prima facie speed limit shall be forty-five (45) miles per hour on Louis Henna Boulevard from County Road 170 to Donnell Drive. This temporary speed limit shall expire upon completion of SH 45 from County Road 170 to Donnell Drive, and the maximum prima facie speed limit shall thereafter be fifty-five (55) miles per hour. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which 0 this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. tAJ READ and APPROVED on first reading this the (�7 day of 2004. As of last month, construction has begun on Section 5 of the SH 45/Loop 1 Project. Section 5 begins roughly at CR 170 (A.W. Grimes) and extends to the east with the most noticeable activities from CR 170 to Donnell. It is in the area between CR 170 to Donnell, that construction activities will have the most impact upon the residents and traffic in this portion of Round Rock. In general, construction of the frontage roads will be the first phase of construction activities. During the construction of the frontage roads, traffic will be allowed to operate along the existing pavement and alignment. Once the frontage roads are completed, traffic will be switched to the proposed frontage roads and main lane construction will begin along the general alignment of Louis Henna (SH45). Because of the construction activities in the area, cross street connections and the presence of heavy construction equipment; I would request that the current speed limit, of 55 mph along Louis Henna between CR 170 and Donnell be reduced to 45 mph for the duration of the project. The sign placement and removal would be done at no expense to the City of Round Rock. This reduction in speed, if approved by the city, will allow the Department additional flexibility in traffic control and enhance the safety of the project.
