AN ORDINANCE VACATING, ABANDONING, AND CLOSING A
PORTION OF BROWN STREET LYING BETWEEN ROUND ROCK
AVENUE AND AUSTIN AVENUE, WITHIN THE CITY OF ROUND
ROCK, TEXAS, PURSUANT TO SECTION 311.007,
TRANSPORTATION CODE, V.A.T.S.; RESERVING A PERMANENT
PUBLIC UTILITY EASEMENT; AND PROVIDING A SAVINGS
CLAUSE AND REPEALING CONFLICTING ORDINANCES AND
RESOLUTIONS.
WHEREAS, Section 311.007, Transportation Code, V.A.T.S.,
allows a home -rule municipality to vacate, abandon, or close a
street or an alley; and
WHEREAS, the City of Round Rock desires to vacate, abandon,
and close a portion of Brown Street lying between Round Rock Avenue
and Austin Avenue, within the City of Round Rock, Texas, as
described in Exhibit "A"; and
WHEREAS, the City of Round Rock desires to reserve a
permanent public utility easement in the portion of the street
being vacated, as described in Exhibit "A"; Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
I.
The City Council of Round Rock, Texas, after due investigation
and consideration, has determined that the nature and extent of the
public use and public interest warrant the abandonment of that
portion of Brown Street as described in this Ordinance.

II.
That portion of Brown Street lying between Round Rock Avenue
and Austin Avenue, within the City of Round Rock, Texas, as more
particularly described by metes and bounds in Exhibit "A", said
exhibit being attached hereto and made a part of this ordinance is
hereby vacated, abandoned, and closed insofar as the right, title
or easement of the public is concerned. The City Council has
determined that this portion of Brown Street is no longer required
for public access and the public interest will be served by this
abandonment. There is however, a permanent public utility easement
hereby reserved across the entire abandoned portion of Brown
Street, as described in Exhibit "A".
That the abandonment provided herein shall extend only to the
public right, title of easement in and to the tracts of land
described in Part II of this ordinance, and shall be constructed
only to that interest the governing body of the City of Round Rock
may legally and lawfully abandon. The City Secretary is directed
to file this Ordinance� /�-in the official public
records of Williamson County, Texas.
IV.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.

C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.

By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

Justification: As adopted in Ordinance Z -93-01-28-12F, the City of Round Rock agreed to
vacate a portion of Brown Street lying between the rights-of-way for Round
Rock Avenue and Austin Avenue as consideration for the adjacent property
owner's (First Baptist Church) installation of landscape improvements and
sprinkler systems. According to the Planning Department, the developer has
completed the landscape and sprinkler requirements as specified in Planned
Unit Development (PUD) No. 7.

Outside Resources: N/A
Background Information: Due to the reconstruction of Round Rock Avenue by the Texas
Department of Transportation, the portion of Brown Street
Lying between the rights-of-way for Round Rock Avenue and
Austin Avenue is no longer required for public access;
however a public utility easement will be reserved across the
entire abandoned portion of Brown Street. The PUE is
required by the City of Round Rock, Southwestern Bell
Corporation, Oncor Energy / TXU Gas and Time Warner Cable.
Public Comment: Abandoning a portion of Brown Street Lying between the rights-of-way
for Round Rock Avenue and Austin Avenue was presented during Public
Hearings for PUD No. 7. The hearings were held on January 21, 1993 by
the Planning and Zoning Commission and on January 28, 1993 by the
City Council.

NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
That, THE FIRST BAPTIST CHURCH OF ROUND ROCK, TEXAS, a Texas non-profit
corporation, hereinafter referred to as Grantor, for and in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, and
for which no lien is retained, either expressed or implied, has this day Sold and by these presents does Grant,
Bargain, Sell, Donate and Convey unto the City of Round Rock, Texas, hereinafter referred to as Grantee,
all that certain tract or parcel of land lying and being situated in the County of Williamson, State of Texas,
along with any improvements thereon, being more particularly described as follows:
A 0.001 Acre (65 square foot) tract of land situated in the Wiley Harris Survey, Abstract No.
398, in Williamson County, Texas, being a portion of Lot 5, Block 33, Round Rock, a
subdivision recorded in Cabinet A, Slides 191-192 of the plat records of said county, said
0.001 acre tract being more particularly described by metes and bounds in Exhibit "A"
attached hereto and incorporated herein.
RESERVATION FOR, AND EXCEPTIONS TO CONVENIENCE AND WARRANTY:
Easements and rights-of-way of record; all presently recorded restrictions, reservations, covenants,
conditions, oil, gas or other mineral leases, mineral severances, and other instruments, other than liens and
conveyances, that affect the property; rights of adjoining owners in any walls and fences situated on a
common boundary; and any encroachments or overlapping of improvements.
Grantor makes this donation on an "as is", "where is" and "with all faults" basis, and Grantee
expressly acknowledges that Grantor makes no warranty or representation, express or implied, or arising by
operation of law, including, but not limited to, any warranty of condition, title (other than the special
warranty of title with respect to the real property and any improvements as otherwise provided herein),

habitability, merchantability, or fitness for a particular purpose with respect to the said premises herein
described or any portion thereof.
TO HAVE AND TO HOLD the premises herein described and herein conveyed together with all and
singular the rights and appurtenances thereto in any wise belonging unto the City of Round Rock, Texas and
its assigns forever; and Grantor's does hereby bind itself, its heirs, executors, administrators, successors and
assigns to Warrant and Forever Defend all and singular the said premises herein conveyed unto the City of
Round Rock, Texas and its assigns against every person whomsoever lawfully claiming or to claim the same
or any part thereof by, through, or under Grantor, but not otherwise.
