G-05-01-13-9B2 - 1/13/2005ORDINANCE NO. &-05-0-13 -q62-) AN ORDINANCE ADOPTING THE "CITY OF ROUND ROCK CHAMPION TREE REGISTRY, JANUARY 2005 " TO ESTABLISH A LIST OF THE LARGEST TREE OF A SPECIES, KNOWN AS CHAMPION TREES; DESIGNATING THE CHAMPION TREES LISTED IN THE REGISTRY AS MONARCH TREES; PROVIDING FOR A SAVINGS CLAUSE; AND REPEALING ALL CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, the City of Round Rock, Texas, has adopted the revised Tree Protection and Preservation Ordinance; and WHEREAS, the revised Tree Protection and Preservation Ordinance calls for the adoption of a Champion Tree Registry; and WHEREAS, the City Council of the City of Round Rock, Texas, wishes to adopt the "City of Round Rock Champion Tree Registry, January 200511, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. Exhibit A is hereby adopted as the "City of Round Rock Champion Tree Registry, January 2005" of the City of Round Rock, Texas, establishing a list of the largest tree of a species, known as Champion Trees; and designates each of the Champion Trees listed in the "City of Round Rock Champion Tree Registry, January 2005" as Monarch Trees. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. DATE: January 6, 2005 SUBJECT: City Council Meeting - January 13, 2005 ITEM: 9.B.2. Consider an ordinance adopting the Champion Tree Registry. (First Reading) Department: Parks and Recreation Department Staff Person: Sharon Prete, Director Emsud Horozovic, Forestry Manager Justification: The existing ordinance does not have regulations to protect Monarch trees. The Champion tree registry list will be used for the purpose of registering all trees that are champions for the City and will be a benchmark for Monarch trees. Funding• Cost: N/A Source of funds: N/A Outside Resources: N/A Background Information: The Champion trees are the biggest trees of its species in the City. They are used to set benchmarks for Monarch trees which are new to the existing ordinance. This initial list is complied of currently know Champion trees and will be updated in the spring of next year. Public Comment: An Open House was held on November 10th and was attended by 25 people from the development community and the public. Comments from the Open House were gathered and answers sent to all attendees. A Public Forum was held on November 17th with 10 people attending. All of the documents were posted on the City's website. The Planning and Zoning Commission had a presentation on their December 1St meeting. The Council held a public hearing on December 2nd and the 1St reading of the ordinance was held on December 16th. Amendments were made based on the public input.
