WrENSION SERVICE MEMORANDUM OF AGREEMENT
This Memorandum of Agreement (MOA) is entered into by and between City of Round Rock Texas and the
Texas A&M Engineering Extension Service (TEEX) shown below as Contracting Parties.

11. STATEMENT OF SERVICES PERFORMED:

TEEX to conduct One 16 hour training session (HEPS18 Backhoe Operator Refresher), for up
to 6 attendees, at customer location in Round Rock Texas. TEEX to supply one qualified instructor,
related training manuals, necessary audio -video equipment, sign roster, Certificates of Completions
and wallet cards for successful candidates.
Customer will provide appropriate classroom area for training as well as an area to conduct
"hands on" skill development. The "dig" area MUST be certified utility clear by a qualified locate
service. Customer will furnish one operational backhoe, that will pass a pre start inspection, for each
two attendees. Customer is responsible for fuel, lubrication and any required repairs during the
duration of the training. All students will be required to possess and utilize all related PPE while
operating in the field exercises.
Class date to be set after contract is signed and at a date agreeable to the Receiving Party AND
Performing Party.
111. CONTRACT AMOUNT:
The total amount of this contract is: Four Thousand, Nine Hundred Twenty-five Dollars and Zero
Cents. ($4925.00)
IV. PAYMENT FOR SERVICES:
Payment for services performed shall be billed lump sum with payment due within thirty 1301 days of
comyletion.

V. TERM OF CONTRACT:
This Contract is to begin as of the date of the last signature and shall terminate 31 Aug 2016
If this Agreement is not signed by all parties and returned to both parties within 60 days of date of
the first signature below, then this Agreement will be null and void and of no further effect.
VI. ALTERNATIVE DISPUTE RESOLUTION
The dispute resolution process provided in Chapter 2260, Texas Government Code, and the related
rules adopted by the Texas Attorney General pursuant to Chapter 2260, shall be used by Customer
and TEEX to attempt to resolve any claim for breach of contract made by Customer that cannot be
resolved in the ordinary course of business. Customer shall submit written notice of a claim of breach
of contract under this Chapter to the Deputy Director of TEEX, who shall examine Customer's claim
and any counterclaim and negotiate with Customer in an effort to resolve the claim.
Both Parties reserve the right to terminate this agreement for reasonable cause or if it is determined the
objectives of this program cannot be accomplished. Party wishing to terminate this program must notify
the other Party in writing thirty (30) days in advance and arrange for a mutual settlement of expenses
Incurred.

Consider authorizing a Memorandum of Agreement with Texas A&M Engineering
Extension Service for an HEP15 Backhoe Operator Refresher Course.
The Utility Staff has employees who are certified in using backhoes which they use for
their jobs daily. This agreement is for a refresher course for six of the employees.
Texas A&M Engineering Extension Service will come to a classroom provided by the
City to conduct a "hands on" skill development course.
Staff Recommends Approval.
