L' - 05- 03- /0- /3 1 AN ORDINANCE AMENDING THE CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, CHAPTER 3, SECTION 3.1412 REGARDING THE REGULATION OF OUTDOOR SIGNS IN THE CITY'S EXTRATERRITORIAL JURISDICTION; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 3, Section 3.1412, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: 3.1412 REGULATION OF OUTDOOR SIGNS IN THE CITY'S EXTRATERRITORIAL JURISDICTION (1) Pursuant to the terms of §216.902 of the Local Government Code, the provisions of this Section 3.1400 regulating Signs shall be enforced in, and extended to the City's area of extraterritorial jurisdiction, except as provided below. (2) The provisions of this Section 3.1400 shall not be enforced in that portion of the City's extraterritorial jurisdiction that is located in the Brushy Creek Municipal Utility District and that is also located more than one hundred fifty feet (150') from the public right-of- way of RM Highway 620. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which @PFDesktop\::ODMA/WORLDOX/O:/WDOX/ORDINANC/050224B4.WPD/sls this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 3, Section 3.1412, Code of Ordinances (1995 Edition) regarding the regulation of outdoor signs in the City's extraterritorial jurisdiction. (Second Reading) Department: Legal and Planning Staff Person: Steve Sheets, City Attorney and Jim Stendebach, Planning Director Justification: The City's current sign regulations are enforced in the City's entire extraterritorial jurisdiction (ETJ). This includes all Municipal Utility Districts (MUD's) that are also located in the City's ETJ. Brushy Creek MUD is one of the MUD's that is located in the City's ETJ. Last year the owners of the Mansions on the Green apartments filed a lawsuit challenging the City's authority to regulate their signs in the City's ETJ. This ordinance would amend Section 3.1412 so that the sign regulations would not be enforced in the Brushy Creek MUD, except for that portion that is within 150" of the public right-of-way of RM 620. If the ordinance is adopted, the owners of the Mansions on the Green will dismiss their lawsuit against the City.
