DATE: March 3, 2005
SUBJECT: City Council Meeting - March 10, 2005
ITEM: *13.C.1. Consider an ordinance amending Chapter 3, Section
3.1412, Code of Ordinances (1995 Edition) regarding the
regulation of outdoor signs in the City's extraterritorial
jurisdiction. (Second Reading)
Department: Legal and Planning
Staff Person: Steve Sheets, City Attorney and Jim Stendebach, Planning
Director
Justification:
The City's current sign regulations are enforced in the City's entire extraterritorial
jurisdiction (ETJ). This includes all Municipal Utility Districts (MUD's) that are also
located in the City's ETJ. Brushy Creek MUD is one of the MUD's that is located in
the City's ETJ.
Last year the owners of the Mansions on the Green apartments filed a lawsuit
challenging the City's authority to regulate their signs in the City's ETJ.
This ordinance would amend Section 3.1412 so that the sign regulations would not
be enforced in the Brushy Creek MUD, except for that portion that is within 150" of
the public right-of-way of RM 620.
If the ordinance is adopted, the owners of the Mansions on the Green will dismiss
their lawsuit against the City.
