G-05-03-24-11C3 - 3/24/2005ORDINANCE NO. a_05-103 -1) 0 3 AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS CHANGING THE SPEED ZONE ON A PORTION OF OLD SETTLERS BOULEVARD; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation, and WHEREAS, an engineering and traffic investigation was conducted on Old Settlers Boulevard from 750' east of Sunrise Road to FM 1460 on the 31st day of January, 2005, and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes as Exhibit "A", and WHEREAS, the results of said engineering and traffic investigation indicate that the speed limit on Old Settlers Boulevard from 750' east of Sunrise Road to FM 1460 should be 45 miles per hour, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: ®PFDesktop\::ODMA/WORLDOX/O:/WDOX/ORDINANC/050310139.WPD/SC I. That Chapter 9, Section 9.502(7), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding the following: (7) The maximum prima facie speed limit shall be forty-five (45) miles per hour along the following streets: ON Old Settlers Boulevard east and westbound FROM TO 750' east of Sunrise Road FM 1460 II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 9, Section 9.502 of the Code of Ordinances (1995 Edition) establishing a 45 -mph speed zone on Old Settlers Boulevard from 750' east of Sunrise Road to FM 1460. (Second Reading) Department: Transportation Services Staff Person: Thomas G. Martin, P.E., Director Justification: Establishment of a 45 -mph speed limit will promote a safer environment for traffic using Old Settlers Boulevard. Funding: Cost: $360 Source of funds: General Fund Outside Resources: N/A Background Information: A speed study was conducted on Old Settlers Blvd during February, 2005. Based on the information gathered, the recommendation is to establish a 45 -mph speed limit from 750' east of Sunrise Road to FM 1460. This signage will replace those placed by Williamson County prior to annexation of this section of Old Settlers Boulevard. Public Comment: N/A
