WHEREAS, the City of Round Rock has previously entered into an
Agreement for Engineering Services ("Agreement") with Gray-Jansing &
Associates, Inc. for design work on the Doublecreek Drive and Forest
Creek Drive Project, and
WHEREAS, Gray-Jansing & Associates, Inc. has submitted
Supplemental Agreement No. 3 to the Agreement for a change in the scope
of services, and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 3 with Gray-Jansing & Associates, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 3 to the Agreement with
Gray-Jansing & Associates, Inc., a copy of same being attached hereto
as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

TO AGREEMENT FOR ENGINEERING SERVICES

PROJECT: Doublecreek Drive and Forest Creek Blvd.
This Supplemental Agreement No. 3 to Agreement for Engineering Services is made by and
between the City of Round Rock, Texas, hereinafter called the "City" and Gray — Jansing &
Associates, Inc., hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed an Agreement for Engineering Services,
hereinafter called the "Agreement", on the 24th day of July, 2003 for the Doublecreek Drive and
Forest Creek Blvd Project in the amount of $94,155.90; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 1 on January 8,
2004, to modify the provisions for the scope of services, to modify the Term of the Agreement,
and to increase the compensation by $15,475.00 for a total of $109,630.90; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 2 on September 9,
2004, to modify the provisions for the scope of services, to increase the compensation by
$15,500.00 for a total of $125,130.90, and to modify the provision for notices to proceed; and
WHEREAS, it has become necessary to amend the Agreement to modify the provisions for the
scope of services, and to increase the compensation by $10,400.00 for a total of $135,530.90,
and to modify the provision for notices to proceed; and
NOW THEREFORE, premises considered, the City and the Engineer agree that said
Agreement is amended as follows:
I.
Article 2, Scope Of Services To Be Performed By Engineer and Exhibit B, Services To Be
Performed By The Engineer shall be amended as set forth in the attached Addendum To Exhibit
B.

Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$10,400.00 the lump sum amount payable under the Agreement for a total of $135,530.90, as
shown by the attached Addendum to Exhibit D.
Article 7, Notice to Proceed shall be amended to read as follows:
The Engineer shall not proceed with any task listed on Exhibit B until the City has issued
a written Notice to Proceed regarding such task. The City shall not be responsible for work
performed or costs incurred by Engineer related to any task for which a Notice to Proceed has
not been issued.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Agreement in duplicate.

ADDENDUM TO EXHIBIT B
Services to be Provided by the Engineer
The changes to the scope of this project are as follows:
The scope of work to be performed under this supplemental agreement shall be in accordance
with the general terms and conditions as outlined in the original agreement dated July 24, 2003.
The additional scope of work to be performed by the Engineer will include the following:
Item 1
Review existing survey data to design a tie-in to the 16 -inch waterline with plan and profile
drawing to connect to new waterline in Rusk Road.
Analyze and design additional drainage improvements including curb inlet and storm sewer pipe
to accommodate additional intersections.
Design two additional street intersections with Forest Creek Drive at Rusk Road and at Paradise
Ridge. Prepare plan and profile sheets to establish vertical grades.
Provide revised designs to CORR Transportation Department for approval.
Assist City Staff in negotiations with Contractor for cost of installation.
Prepare and issue contract change order to construction contract.
Provide staff for field observation in order to document installation of improvements.
Provide additional construction administration services to cover the increased contract scope.

Justification:
This agreement will allow Gray-Jansing & Associates, Inc., to provide design services
incorporating two new street intersections into the Forest Creek Drive improvements, prepare
revised drawings for the installation of additional utility and drainage improvements associated
with the intersections, prepare and issue change order documents incorporating revised design
into the existing construction contract, provide field observation to document installation of
waterline, storm sewer improvements and paving and provide project representative to
provide field observation to document installation of the additional improvements.
Funding:
Cost: $10, 400.00
Source of funds: Round Rock Transportation System Development Corporation
Outside Resources: Gray-Jansing & Associates, Inc.
Background Information:
Completion of the arterial Forest Creek Drive will provide a four lane divided roadway, with
curb and gutter section and is in accordance with the City's Master Transportation Plan.
