S-05-06-23-13C5 - 6/23/2005ORDINANCE NO. 8- 05- go 3 - / 3e. 5 AN ORDINANCE AMENDING THE CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, CHAPTER 8, SECTION 8.113 REGARDING NON -RECORDED SUBDIVISIONS; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 8, Section 8.113(1), Code of Ordinances (1995 Edition), City of Round Rock is hereby amended as follows: 8.113 NON -RECORDED SUBDIVISIONS (1) Purpose The City Council finds that strict compliance to the regulations of this Chapter for certain Non -Recorded Subdivisions may result in undue hardship The City Council shall designate such Non -Recorded Subdivisions by resolution duly adopted. So that the purposes of this Chapter may be fulfilled, the City Council may modify the requirements of this Chapter's regulations for those Non -Recorded Subdivisions so designated. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, @PFDesktop\::ODMA/WORLDOX/O:/WDOX/ORDINANC/050623C5.WPD/cdc considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 8, Section 8.113, Code of Ordinances (1995 Edition) regarding subdivision requirements that result in undue hardship for certain non -recorded subdivisions. (First Reading) Department: Staff Person: Justification: Planning and Community Development Jim Stendebach, Planning Director This ordinance will modify text in Chapter 8, Section 8.113, of the Subdivision Ordinance to allow certain tracts of land to be designated for alternative subdivision standards as "non - recorded" subdivisions. Please see the staff analysis for the accompanying resolution for additional information on the need for these exemptions. Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A Background Information: Currently there are a number of existing tracts of land within the city limits and within the City's extraterritorial jurisdiction that have been subdivided into separate parcels by either a metes and bounds description or lots that were never recorded at the Williamson County Courthouse. It is the City's desire to provide both utility improvements and road improvements to these subdivisions. However, in order to provide these services the subdivisions must be platted. The proposed resolution will allow the subdivisions to be platted "as is" without the undue hardship of complying with requirements of the Subdivision Ordinance that would necessitate considerable redevelopment of these already developed subdivisions. The proposed resolution specifically identifies the existing subdivisions in Exhibit "A", attached to the Resolution that will be exempt from the requirements of Chapter 8. The subject tracts of land are built -out subdivisions with right-of-way infrastructure already in place. The subject tracts are not served with municipal utilities and the current rights of way are not in compliance with existing standards. It is the City's desire to provide both utility improvements and road improvements to these subdivisions. Public Comment: None required
