WHEREAS, the City of Round Rock has, in accordance with Chapter
395, Local Government Code, V.A.T.S., adopted water and wastewater
impact fees to pay a portion of the cost of constructing capital
improvements or facility expansions necessary to serve new development
with water and wastewater service; and
WHEREAS, §10.204 (10) (e) Code of Ordinances (1995 Edition)
provides that the Council by ordinance or resolution may waive or
reduce the impact fees for certain classes of development if there is
a finding that the proposed waiver or reduction would result in
substantial economic benefit to the City; Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
THAT:
(1) Pursuant to §10.204(10)(e) Code of Ordinances (1995 Edition),
the Council hereby determines and finds that waiving the water and
wastewater impact fees for single family residences constructed by
Habitat for Humanity will result in a substantial economic benefit to
the City;
(2) The water and wastewater impact fees adopted in §10.204 Code
of Ordinances (1995 Edition) are hereby waived for Habitat for
Humanity;
(3) The building permit fee, the water meter fee and the water
and sewer line inspection fee shall be waived for Habitat for Humanity;
(4) The aforesaid waiver of fees shall apply to no more than four
residential structures; and
(5) This resolution and waiver of fees shall expire on December
31, 2006, unless extended by action of the City Council prior thereto.

(6) As a condition for the granting of this waiver, Habitat for
Humanity has agreed to make a good faith application for a Self-help
Homeownership Opportunity Program (SHOP) grant, and if such application
is approved, Habitat for Humanity will apply said grant funds to the
fees waived herein.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

Habitat for Humanity.

Justification:
Habitat for Humanity of Greater Round Rock, Inc. was incorporated on January 24, 2003. It
was organized as a nonprofit corporation under the Texas Nonprofit Corporation Act and as
a tax-exempt support organization under Section 501(a)(3) and 509(a)(3) of the Internal
Revenue Code.
Habitat for Humanity of Greater Round Rock services the corporate city limits of the Round
Rock and its ETJ.
Habitat for Humanity of Greater Round Rock is an interdenominational group dedicated to
supporting affordable housing. Habitat is not a giveaway program. Habitat homes are sold
to partner families at no -profit, financed with affordable no -interest loans. Homeowners are
also required to invest hundred of hours of their own labor, sweat equity, into building their
Habitat house and houses of others.
This resolution will waive the following fees:
• Water and wastewater impact fees for single-family residences
• Building permit fee
• Water meter fee
• Water and sewer line inspection fee
These fees will apply to no more than ten (10) residential structures. This resolution and
waiver of fees will expire on December 31, 2007 unless extended by the Council.
