R -05-02-24-9E6 WHEREAS, Chapter 791 of the Texas Government Code, V.T.C.A., authorizes local governments and agencies of the state to enter into agreements with one another to perform governmental functions and services, and WHEREAS, the City of Round Rock wishes to enter into an Interlocal Agreement for In School Officers with the Round Rock Independent School District to provide for the reimbursement of salary and benefits expenses for In School Officers, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an Interlocal Agreement for In School Officers with the Round Rock Independent School District, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. City of Round Rock, Texas, hereinafter referred to as the "City." Round Rock Police Department, hereinafter referred to as the "Department." SERVICE: Pursuant to Chapter 791, Texas Government Code, the Texas Interlocal Cooperation Act (the "Cooperation Act") the parties are empowered to contract with each other for the performance of governmental functions, including police protection, and as permitted in § 37.081 of the Texas Education Code. In consideration of the mutual covenants and agreements, contained herein, as well as other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, the Parties agree as follows: Section 1. Term. The initial term of this Agreement shall commence upon the date that the parties signatures are affixed hereto and shall expire on July 31, 2005. After the initial term, this Agreement will automatically renew and extend for successive one (1) year terms unless either party elects to exercise their right to terminate under Section 5, Subsection (f) of this Agreement. Section 2. Patrol Services. The City agrees to provide Police Officer(s), known as School Resource Officers, at the schools of the District situated within the jurisdiction of the Department in an amount equal to at least the number of officers that the Department and the District agree upon. The Department agrees to provide other officers as manpower allows during the regularly scheduled school hours and sessions to work directly with the Campus Principal. The Officers shall perform duties including but not limited to the following: 1. Coordinate all security efforts at the School to which the Officers are assigned. 2. Give classroom presentations to students on topics dealing with but not limited to personal safety, peer pressure, handling crisis, chemical abuse, sexual assault prevention, Texas Penal Code, City Ordinances, Texas Family Code, Texas Education Code, conflict mediation, gang involvement alternatives, or other topics related to student safety or law enforcement. 3. Coordinate communication between the School and the Department. 4. Coordinate a safety audit of the campus and develop and maintain a long-range plan for campus safety incorporating input from parents, students, and teachers. Make safety recommendations to the administration. EXHIBIT 5. Assist with campus vehicular and pedestrian traffic control through long-term problem -solving. 6. Address incidents which require law enforcement intervention on campus. 7. Instruct the faculty and staff in areas dealing with safety awareness, after -hour facility use, crisis prevention and personal safety. Keep high school personnel abreast of current research and safety programs as they evolve. 8. Coordinate all documentation regarding persons who trespass at the School. 9. Be available on a regular basis to any students at the School who have an interest in a career in law enforcement. 10. Maintain high visibility on campus. 11. Maintain documentation of crime data, including information on the number of gang members in a particular school, the number of suspensions and expulsions related to gang activities, school surveys, and complaints from the community. 12. While the Department will confer with the District regarding the assignment of personnel, the Department retains the expressed right to assign or reassign personnel at its discretion. 13. The officers providing services under this Agreement shall remain City employees at all times. School Resource Officers shall wear their Police Department uniforms or be clearly identifiable as police officers, shall provide their own equipment, and shall utilize marked Police Department patrol cars while providing services under this Agreement. All officers providing services under this Agreement shall be acting within the course and scope of their employment by the City at all times while engaged in the performance of the duties contemplated hereunder. The foregoing shall in no way relieve the City of its obligation to provide routine patrol services to property within the District on the same basis as such services are provided to other property within the City. The foregoing services shall be in addition to, and not in lieu of, such routine services. Section 3. Compensation. The District, in paying for the governmental services being provided by the City through the Department pursuant to this Agreement, shall make such payments out of current revenues available to the District, as required by applicable law. The District shall pay to the City an amount equivalent to 50 percent of the salary and benefits per officer for each month a School Resource Officer was assigned to a District site during the school year in accordance with this agreement, as well as 50 percent of the salary and benefits for the School Resource Officers' supervisor . The District shall pay no more than 50 percent of the ten (10) -month salary and benefits for any specific School Resource Officer's services and the supervisor's services during a single school year. This amount shall be reduced by the amount of grant funding for School Resource Officers received by the Department. The District shall also pay a portion of the cost to equip new School Resource Officers assigned to the District. Before new officers are assigned, the Department and the District shall agree in writing on the amount of the cost the District is required to pay. Not withstanding Section 5(b) of this agreement, such written agreement regarding the equipment costs shall become a part of this agreement and is enforceable as such. The District shall also pay all costs of any special training required for officers to provide services pursuant to this Agreement. Such costs shall be submitted to the District in the invoice referenced below. The Department may request additional funding for officers assigned to the District. Such requests must be submitted to the District, and any positions assigned as a result of the additional funding will be permanently assigned as long as funding is available. The City shall provide an invoice to the District within 15 days after the ending date for each semester of the regular school year. The invoice following the end of the first semester shall be for an amount equal to 50% of the previous school year's costs to the District, and the District shall pay the invoiced amount within 30 days of receipt. The invoice following the end of the second semester shall be for an amount equal to the remaining balance due for the current year based on the costs to the District as outlined above and the District shall pay the invoiced amount by June 30 of that year. Section 4. Notice. The District and the City agree to cooperate with each other in good faith, at all times during the term hereof in order to effectuate the purposes and intent of this Agreement. Each party hereto acknowledges and represents that this Agreement has been duly authorized by their respective governing body. b. Entire Agreement: Amendments. This Agreement contains the entire agreement between the parties respecting the subject matter hereof, and supersedes all prior understandings and agreements between the parties reading such matters. This Agreement may not be modified or amended except by written agreement duly executed by the parties hereto. c. Interpretation. The parties acknowledge and confirm that this Agreement has been entered into pursuant to the authority granted pursuant to the Cooperation Act. All terms and provisions hereof are to be construed and interpreted consistently with such Act. d. Invalid Provisions. Any clause, sentence, paragraph or article of this Agreement which is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect shall not be deemed to impair, invalidate, or nullify the remainder of this Agreement. e. Applicable Laws. This Agreement shall be construed in accordance with the laws and constitutions of the United States and the State of Texas. All obligations hereunder are performable in Williamson County, Texas, and venue for any action arisinghereunder shall be in Williamson County, Texas. f. Termination of Agreement. This Agreement maybe terminated by either party upon thirty (30) days written notice. Provided, however, that the District shall be responsible for payment due to the City for officers provided to the District at any time during the immediately preceding year and shall be made according to Section 3.
