DECLARATION OF WASTEWATER EASEMENT

§KNOW ALL PERSONS BY THESE PRESENTS:
COUNTY OF WILLIAMSON §
That the CITY OF ROUND ROCK, a Texas home-rule municipal corporation (hereinafter
called the "Declarant") has executed this Declaration of Wastewater Easement for the purpose of
establishing the following exclusive easement vested in, inuring to, and in favor of, Declarant, in and
under the following described property in Williamson County,Texas,to-wit:
Being a 0.045 of an acre, or 1,957 square feet more or less, tract of land, being out of
Section 2, Lot 2, Block E, a Parkland and Open Space Drainage Easement, in the
University Village South Sections 1 and 2 Subdivision recorded in Document No.
2012047987 of the Official Public Records of Williamson County, Texas, same being a
25.82 acre tract, described in conveyance to the City of Round Rock in Special Warranty
Deed recorded in Document No. 2011049607 of the Official Public Records of
Williamson County, situated in the Abel L. Eaves, Survey, Abstract No. 215, in the City
of Round Rock, Williamson County, Texas. Said 0.045 of an acre tract being more
particularly described in Exhibit "A" attached hereto and incorporated herein for all
purposes.
The Easement, rights, and privileges hereby created shall be used solely for the purpose of
constructing, installing, operating, maintaining, inspecting, reconstructing, enlarging, relocating,
rebuilding, repairing, and removing a wastewater system and lines, together with all necessary lines,
pipes, conduits, valves, vaults, manholes, ventilators, and other equipment, improvements, accessories
and appurtenances or operations related thereto. Except as otherwise stated, the Easement and other
rights and privileges hereby created shall be perpetual.
The benefits and obligations of the Easement created herein shall constitute benefits and
servitudes running with the land.
This Declaration may be modified,amended, or terminated by Declarant.

A 0.045 of an acre, or 1,957 square feet more or less, tract of land, being out of Section 2, Lot 2,
Block E, a Parkland and Open Space Drainage Easement, in the University Village South
Sections 1 and 2 Subdivision recorded in Document No. 2012047987 of the Official Public
Records of Williamson County, Texas, same being a 25.82 acre tract, described in conveyance to
the City of Round Rock in Special Warranty Deed recorded in Document No. 2011049607 of the
Official Public Records of Williamson County, Texas, situated in the Abel L. Eaves, Survey,
Abstract No. 215, in the City of Round Rock, Williamson County, Texas. Said 0.045 of an acre
tract being more frilly described as follows, with bearings based on the Texas Coordinate System
established for the Central Zone from the North American Datum of 1983 NAD 83 (NA2011)
EPOCH 2010.00.
COMMENCING: At a found iron rod with a cap marked "Baker-Aicklen", on the northeast
right-of-way line of Sandy Brook Drive, a 60-foot right-of-way, dedicated in the Stoney Brook
Section 6 Subdivision recorded in Cabinet Y, Slides 323-324 of the Plat Records of Williamson
County, Texas, same being a south corner of Section 1, Lot 3, Block E recorded in the said
University Village South Sections 1 and 2 Subdivision, also being a west corner of said Section
2, Lot 2;
THENCE with the southeast line of said Section 1, Lot 3, a northwest line of said Section 2, Lot
2, the following two (2) bearings and distances:
1. N 68°4647" E, a distance of 107.74 feet to the POINT OF BEGINNING of the herein
described tract;
2. N 68°46'47" E, a distance of 15.00 feet to a point, from which a found iron rod with a
cap marked "Baker-Aicklen" bears N 68°46'47" E, 144.78 feet being the east corner of
said Section 1, Lot 3, same being an interior corner of Section 2, Lot 2;
THENCE departing the southeast line of said Section 1, Lot 3, through the interior of said
Section 2, Lot 2, the following five (5)bearings and distances:
1. S 21°13'51" E, a distance of 42.93 feet to a calculated point,
2. S 69°07'24" W, a distance of 102.54 feet to a calculated point,
3. N 21°30'46" W, a distance of 15.00 feet to a calculated point,
