AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.401(2)(a),
CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK,
TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
OFFICIAL ZONING MAP, TO WIT: TO REZONE 0.3505 ACRES OF
LAND, OUT OF THE ANDERSON ADDITION, KNOWN AS 504 N.
MAYS, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM
DISTRICT C-1 (GENERAL COMMERCIAL WITH HISTORIC
OVERLAY) TO DISTRICT C-1 (GENERAL COMMERCIAL).
WHEREAS, an application has been made to the City Council of
the City of Round Rock, Texas to amend the Official Zoning Map to
rezone 0.3505 acres of land, out of the Anderson Addition, known as
504 N. Mays, in Round Rock, Williamson County, Texas, being more
fully described in Exhibit "A" attached hereto, from District C-1
(General Commercial with Historic Overlay) to District C-1 (General
Commercial), and
WHEREAS, the City Council has submitted the requested change
in the Official Zoning Map to the Planning and Zoning Commission
for its recommendation and report, and
WHEREAS, the Planning and Zoning Commission held a public
hearing concerning the requested change on the 14th day of December
2005, following lawful publication of the notice of said public
hearing, and
WHEREAS, after considering the public testimony received at
such hearing, the Planning and Zoning Commission has recommended
that the Official Zoning Map be amended so that the property

WHEREAS, on the 12 th day of January, 2006, after proper
notification, the City Council held a public hearing on the
requested amendment, and
WHEREAS, the City Council determines that the zoning provided
for herein promotes the health, safety, morals and protects and
preserves the general welfare of the community, and
WHEREAS, each and every requirement set forth in Chapter 211,
Sub -Chapter A., Texas Local Government Code, and Section 11.300 and
Section 11.400, Code of Ordinances (1995 Edition), City of Round
Rock, Texas concerning public notices, hearings, and other
procedural matters has been fully complied with, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
I.
That the Official Zoning Map adopted in Section 11.401(2)(a),
.Code of Ordinances (1995 Edition), City of Round Rock, Texas, is
hereby amended so that the zoningclassification of the property
described in Exhibit "A" is hereafter designated as District C-1
(General Commercial).
II.
A. Allordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
2.
C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.

vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

Exhibit "A"
The subject property consists of .3505 acres of land, more or less, being part of
that certain tract of land described as part of the Anderson Addition, an
unrecorded subdivision to the Town of Round Rock and being part of the East
150 feet of Block 15 of said unrecorded subdivision, also known as 504 North
Mays Street, in Williamson County, Texas.

Justification:
The filling station building has already been demolished at 504 N. Mays Street, and the rest of
the buildings will be demolished in the near future. Because the historic integrity of this site is
no longer intact and the buildings will no longer be on the site, the historic overlay zoning is no
longer appropriate for this property. The Historic Preservation Commission recommended
removal of the Historic Overlay in June 2005.

Background Information:
The historic overlay was added to this C-1 (General Commercial) tract at 504 N. Mays, also
known as Adams Garage, in 1993. At the time, the tract in question consisted of a filling
station with canopy, which was vacant, a building that houses the business "Texandwiches",
and a motor court which was used as housing.
The canopy on the front of the filling station was removed from the property in 2003, and the
filling station building was demolished in 2004. In April 2005, the applicant applied to
demolish the remaining buildings on the site. The applicant requested to remove the historic
overlay from the entire site at the same time, and, in June 2005, the Historic Preservation
Commission approved this request.
Public Comment:
Public notice and a public hearing were held in accordance with the City of Round Rock's
Zoning Ordinance. No members of the public spoke against this application at the Planning
and Zoning Commission public hearing held on December 14, 2005.
