G-06-03-09-8C1 - 3/9/2006ORDINANCE NO. 0-010-03-09_gcl AN ORDINANCE ESTABLISHING THE METHODOLOGY OF DETERMINING THE AMOUNT OF WASTEWATER SERVICE USED FOR BILLING PURPOSES FROM MARCH 15, 2006 UNTIL THE AMOUNT OF WASTEWATER SERVICE USED IS RE -DETERMINED IN ACCORDANCE WITH CHAPTER 10, SECTION 10.202(1)(C), CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: WHEREAS, Chapter 10, Section 10.202 (1) (c) , Code of Ordinances (1995 Edition), City of Round Rock, Texas, provides that wastewater rates for retail customers are based on the average monthly water consumption for the months of December, January and February of each fiscal year, and WHEREAS, because of unusually warm and dry weather during the months of December 2005 and January 2006, citizens were forced to apply above normal amount of water to their landscaping, and WHEREAS, the City Council has determined that the aforesaid month with the highest water consumption will not be included in the calculation of the wastewater consumption, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. Monthly sewer consumption shall be based upon the actual monthly water consumption, or the average monthly consumption of the two months out of December, January, and February with the lowest monthly water @PFDesktop\::ODMA/WORLDOX/O:/WDOX/ORDINANC/060309C1.WPD/sls consumption. The foregoing methodology shall be in effect only until the next time that wastewater service usage is calculated in accordance with Chapter 10, Section 10.202(1)(c), Code of Ordinances (1995 Edition), City of Round Rock. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Due to unusually warm and dry weather during the months of December 2005, January and February 2006, citizens may have applied above normal amounts of water to the landscaping. This ordinance attempts to fairly establish the methodology for billing wastewater under these abnormal conditions.
