WHEREAS, the City of Round Rock wishes to purchase three wireless
lighted crosswalk warning systems for Dell Way and Greenlawn Boulevard
("Systems"), and
WHEREAS, Spot Devices, Inc. has submitted a proposal to provide
said Systems, and
WHEREAS, Spot Devices, Inc. is the only provider available to the
City able to provide said Systems, and
WHEREAS, the Local Government Code, Section 252.022(a) (7) exempts
expenditures for sole source providers from the competitive bidding
requirements set forth in Local Government Code, Section 252.021, and
WHEREAS, the City wishes to accept the proposal of Spot Devices,
Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the proposal of Spot Devices, Inc. is hereby accepted and the
City Manager is hereby authorized and directed to issue a purchase
order to Spot Devices, Inc. for the purchase of three wireless lighted
crosswalk warning systems for Dell Way and Greenlawn Boulevard.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

RFP Response
Following is a reference to each numbered item in the City of Round Rock RFP that
elicits a response from vender:
3.1-2 As part of this proposal, Spot Devices will send a trained technician for 3 full
days to instruct and train city personnel how to install Spot Devices' wireless system
from beginning to end. This training will be done in the context of installation of the
first system the City selects. As such, training will include ample `hands-on' time.
Upon completion of this training, City personnel will be able to carry out installation on
their own.
4.1.4 Spot Devices' production and delivery schedule is booked through April 2006.
We could start anytime after that, assuming a timely notification of commencement.
8.1 Spot Devices indemnifies the City of Round Rock per your request in RFP.
9.1.1 Product for this proposal is a next generation product using the latest in wireless,
solar, and LED technology. Consequently, we have just a few recent installations and
are unable to comply with the City's reference request. To offset this issue, Spot
Devices will extend our normal warranty of 1 year to 2 years at no additional charge.
System Description
A Spot Devices Crosswalk Lighting System consists of the following core
components:
• Road Spot inroad, solar -powered, wirelessly activated uni- or bi-directional LED
warning lights
• Road Spot anchors, which are securely installed in the asphalt and allow quick
and easy change -out of Road Spot inroad lights
• Tapco LED enhanced, solar powered, wireless signs
• Spot Controllers, placed atop a push-button pole on each side of the street for
wireless communication with the Road Spot inroad lights and LED enhanced
signs
• Integration of the Spot Controllers with the pushbutton
• Spot Configurator software and modem, which are used to wirelessly reconfigure
each Road Spot and LED enhanced sign and to download usage data from the
controllers

Option 2: We would add two more LED enhanced signs with wireless controllers and
pushbuttons to the Pedestrian Refuge median. This will provide additional visibility and
safety should someone get halfway across and need additional time to cross the
balance of the street.

Common Equipment
This offer includes a licensed copy of Spot Devices' MS Windows-based system
management software and a USB -port wireless transmitter that allows the user to
manage and update the systems and to download data from them to a laptop
computer.
Installation
Spot Devices will provide a three day visit to train installers on installation and to train
the city in the use of the configuration software.
Guarantees
Spot Devices carries a standard 1 year warranty, but we will extend this warranty to 2
years free of charge.

Order to Spot Devices for three (3) Wireless Lighted Crosswalk Warning
Systems for Dell Way and Greenlawn Boulevard.

Justification:
This proposed purchase will be for materials for three (3) complete systems to be installed on
Greenlawn Boulevard and Dell Way. Through discussions with Dell Computers, concerns were
raised for the safety of the pedestrians crossing these roadways. Additionally, median crossings
and pedestrian ramps will be adjusted for ADA compliance.
The City accepted "Request for Proposals" (RFP) on March 7, 2006. During the processes of
evaluating the proposals submitted, it was found that the product of one of the RFP, Spot
Devices, has a battery system for its lights, which was not available from the other RFP. This
particular aspect will save the City approximately $45,000 dollars in maintenance and
replacement costs.
While it was the original intent of the City to review these proposals under a "Best Value" process,
due to the differences between the two products and the financial advantages to the City, award
is recommended to Spot Devices as"Sole Source" procurement.
