WHEREAS, the City of Round Rock has previously entered into a
Contract for Engineering Services ("Contract") with Baker-Aicklen &
Associates, Inc. for the Red Bud Lane Sidewalk Improvements Project,
Phase I, and
WHEREAS, Baker-Aicklen & Associates, Inc. has submitted
Supplemental Contract No. 1 to the Contract for Engineering Services
for a change in the scope of services, and
WHEREAS, the City Council desires to enter into said Supplemental
Contract No. 1 with Baker-Aicklen & Associates, Inc., Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Contract No. 1 to the Contract for
Engineering Services with Baker-Aicklen & Associates, Inc., a copy of
same being attached hereto as Exhibit "A" and incorporated herein for
all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

This Supplemental Contract No. 1 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Baker-Aicklen & Associates,
Inc., hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 12th day of May, 2005 for the Red Bud Lane — Sidewalk
Improvements Phase 1, for the sum of $69,567.12; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $74,621.41 to a total of $144,188.53; and
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
I.
Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.
II.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$74,621.41 the lump sum amount payable under the Contract for a total of $144,188.53, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Contract in duplicate.

ADDENDUM TO EXHIBIT B
Engineering Services
The changes to the scope of this project are as follows:
1. Attend project coordination and bi-weekly meetings with City staff as required (weeks 1, 3, & 5).
2. Prepare "Engineer's Opinion of Probable Construction Cost" for the meetings in weeks 3 & 5.
3. Establish base cross-section and plan and profile sheets with ultimate roadway profile utilizing
plans developed for the County Road 122 Phase I and Phase II Construction Improvements Project,
and the Ultimate Red Bud Lane Plan/Profile Roll Plan.
4. Locate in the field any utility relocated since Phase I survey efforts.
5. Review cross-sections.
6. Develop design, plans, and details for retaining walls with handle where deemed appropriate by the
City.
7. Revise sidewalk elevations that will be deemed "throw away."
8. Develop 50' cross-sections for the plans.
9. Prepare plans and construction schedules to complete project on or before dead line.
10. Prepare cover sheets, details, etc. as necessary.
11. Quality Assurance/Quality Control.
12. Respond to City comments.
13. Prepare bid specifications, quantities, and all related bid documents.
14. Submission to TDLR and Response to TDLR.
15. Assist City in the bidding process, and attend the Pre -Bid Conference and Bid Opening.
16. Evaluate bids and make Engineer's written recommendation as to award.
17. Assist City the preparation of Contract Document.
18. Assist with pre -construction conference.
19. Provide Construction Phase Services (based no more than a 90 day construction contract).
20. Provide a Plan of Record.

Justification:
Supplemental Agreement # 1 modifies the existing Preliminary Engineering Services Contract to
include Engineering Service through the completion of the project. Schedule for this Supplemental
has the completion of the sidewalk construction on or before August 31, 2006.
Funding:
Cost: $74,621.41
Source of funds: 2002 GO Bonds
Outside Resources: Baker-Aicklen & Associates, Inc.
Background Information:
This Supplemental is an increase in the cost of Engineering Services from $69,567.12 to
144,188.53. The Preliminary Engineering Services Contract was to make sound judgment on the
final design scope of this sidewalk and related infrastructure, for the effective usage of funds.
The majority of effort in the preliminary phase was development of grades (profile) on the
ultimate roadway section. This profile is being used as tool in the establishment of the final
design. Safety of foot traffic on Red Bud Lane (CR 122) on this high vehicle volume arterial was
the concern of the Bond Overview Committee in their reasoning to recommend Sidewalk
Installation Phase 1 project for the November 2001 bond program.
Public Comment:
This project was presented to the Bond Overview Committee by the HOAs, and a number of
residences in the Forest Creek Subdivision, Lake Creek Subdivision, and other neighborhoods with
roadways connecting to Red Bud Lane.
