AN ORDINANCE AMENDING CHAPTER 8, SECTIONS 8.106, 8.404, AND 8.415, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, TO AMEND THE DEFINITION OF "LOT;" TO ESTABLISH ACCESS REQUIREMENTS; TO AMEND STREET FRONTAGE REQUIREMENTS; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. Chapter 8, Section 8.106(32), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: 8.106 DEFINITIONS (32) Lot shall mean a parcel of land shown on a Final Plat of record and having frontage upon (i) a public street and shown on a Final Plat of record, or (ii) an alternate public access to a public street through an approved planned unit development zoning district, as provided for in Chapter 11. II. Chapter 8, Section 8.404, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to add subsection (10) to read as follows: 8.404 STREETS (10) Access (a) Except as provided below, a lot shall be provided with public access to an existing or proposed public street. @PFDesktop\::ODMA/WORLDOX/O:/wdox/ORDINANC/060622C2.WPD/vr 1 (b) A lot without public access to a public street shall have an alternate public access to a public street through an approved planned unit development zoning district only for non-residential uses, which shall include provisions for such alternate public access, as provided for in Chapter 11. III. Chapter 8, Section 8.415(5), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: 8.415 LOTS (5) Lot Width Lot widths shall be determined according to the requirements of Chapter 11 of this Code. IV. Chapter 8, Section 8.415, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to add subsection (7) to read as follows: 8.415 LOTS (7) Lot Street Frontage (a) The lot street frontage for a single-family residential lot abutting a right-of-way shall be no less than twenty-five feet (25'). (b) The lot street frontage for a non-residential or residential lot other than a single- family lot abutting a right-of-way shall be no less than fifty feet (50'). V. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 2 C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 8, Subdivisions, of the Round Rock Code of Ordinances to establish street access requirements and amend street frontage requirements. (First Reading) Department: Planning and Community Development Department Staff Person: Jim Stendebach, Director Justification: The development of large retail shopping centers often includes shared access. This shared access often is the only physical access to individual lots. The current Subdivision Ordinance requires lot frontage on a public street, which results in the need for awkward flag lots that provide legal access only. The proposed amendments to the Subdivision Ordinance contain provisions allowing non- residential lots to be platted along alternate public access that is privately owned and maintained instead of along a public street, thus eliminating the need for flag lots. This provides greater flexibility in situations where a public street may not be appropriate or practical to provide access. Alternate public access may be permitted through an approved planned unit development zoning district for non-residential uses as provided for in Chapter 11, Zoning. This set of amendments also includes new provisions to confirm street frontage requirements for single family Tots and to establish street frontage requirements for non-residential lots and residential lots other than single family. Staff proposes the following requirements: • The lot street frontage for a single-family residential lot shall be no less than twenty-five feet (25'). • The lot street frontage for a non-residential lot or a residential lot other than single family shall be no less than fifty feet (50').
