AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.401(2)(a),
CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK,
TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
OFFICIAL ZONING MAP, TO WIT: TO ORIGINALLY ZONE 41.505
ACRES OF LAND OUT OF THE P.A. HOLDER SURVEY, ABSTRACT
NO. 297, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, AS
DISTRICT SF -2 (SINGLE FAMILY -STANDARD LOT) AND TO
ORIGINALLY ZONE 3.409 ACRES OF LAND OUT OF THE P.A.
HOLDER SURVEY, ABSTRACT NO. 297, IN ROUND ROCK,
WILLIAMSON COUNTY, TEXAS, AS C-2 (LOCAL COMMERCIAL).
WHEREAS, the City of Round Rock, Texas has recently annexed
41.505 acres of land out of the P.A. Holder Survey, Abstract No.
297 in Round Rock, Williamson County, Texas, being more fully
described in Exhibit "A" and 3.409 acres of land out of the P.A.
Holder Survey, Abstract No. 297 in Round Rock, Williamson County,
Texas, being more fully described in Exhibit "B", attached hereto
and incorporated herein, and
WHEREAS, the Planning and Zoning Commission held a public
hearing concerning the original zoning of the Property on the 7th
day of June, 2006, following lawful publication of the notice of
said public hearing, and
WHEREAS, after considering the public testimony received at
such hearing, the Planning and Zoning Commission has recommended that
the Official Zoning Map be amended so that the Property in Exhibit
"A" be originally zoned as District SF -2 (Single Family -Standard Lot)
and the Property in Exhibit "B" be originally zoned as District C-2
(Local Commercial), and

Original Zoning Ordinance 6/06
WHEREAS, on the 13th day of July, 2006, after proper
notification, the City Council held a public hearing on the
proposed original zoning, and
WHEREAS, the City Council determines that the zoning provided
for herein promotes the health, safety, morals and protects and
preserves the general welfare of the community, and
WHEREAS, each and every requirement set forth in Chapter 211,
Sub -Chapter A., Texas Local Government Code, and Section 11.300 and
Section 11.400, Code of Ordinances (1995 Edition), City of Round
Rock, Texas concerning public notices, hearings, and other
procedural matters has been fully complied with, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
I.
That the Official Zoning Map adopted in Section 11.401(2)(a),
Code of Ordinances (1995 Edition), City of Round Rock, Texas, is
hereby amended so that the zoning classification of the property
described in Exhibit "A" is hereafter designated as District SF -2
(Single Family -Standard Lot) and the property described in Exhibit
"B" is hereafter designated as District C-2 (Local Commercial).
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.

B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions thereof.
C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

METES AND BOUNDS AS FOLLOWS:
BEGINNING at a 1/2 inch iron rebar w/orange cap marked "Landesign" set in the existing
south right-of-way line of Forest Creek Drive (100' R.O.W.) for the northwest corner of said
9.955 acre tract, from which a 1/2 inch iron rebar found for the point of curvature in the
south right of way line of said Forest Creek Drive (100' R.O.W.) bears South 87°49'13"
West a distance of 10.89 feet;
THENCE North 87°49'13" East along the existing south right-of-way line of said Forest
Creek Drive and the north line of said 9.955 acre tract a distance of 376.01 feet to a
calculated point, from which a 1/2 inch iron rebar w/orange cap marked "Landesign" set on
the existing south right-of-way line of Forest Creek Drive (100' R.O.W.) for the northwest
corner of said 9.955 acre tract bears North 87°49'13" East a distance of 283.19 feet;
THENCE crossing said 9.955 acre tract and said 29.158 acre tract the following two (2)
courses:
1. South 01°43'13" East, 375.00 feet east of and parallel with the west line of said 9.955
acre tract a distance of 396.01 feet to a calculated point;
2. South 87°49'13" West, 396.00 feet south of and parallel with the north line of said
Forest Creek Drive a distance of 375.01 feet to a calculated point in the east line of
said 9.955 acre tract and in the east line of a called 147.076 acre tract recorded in
Volume 2814, Page 51 of the Deed Records of Williamson County, Texas;
THENCE North 01°43'13" West along the west line of said 9.955 acre tract and the east
line of said 147.076 acre tract a distance of 396.01 feet to the POINT OF BEGINNING.

ITEM: 13.D.6. Consider an ordinance zoning 41.505 acres to SF -2 (Single Family -
Standard Lot) and 3.409 acres of land to C-2 (Local Commercial)
(Also known as Preserve at Dyer Creek) (First Reading).

Justification:
The zoning request complies with the General Plan and is appropriate for this area.
The one commercial lot (Tract B) is located at the southeast corner of Forest Creek Drive
and the future Arterial A. When Arterial A is constructed, this will be an appropriate location
for commercial development to serve the surrounding neighborhoods.
The Kenney Fort PUD to the west of this tract also shows commercial uses at this
intersection. (See enclosed map.) However, because it will abut single-family homes, the
applicant is only requesting C-2 zoning, which will ensure compatibility between the two
uses.
