A RESOLUTION CONSENTING TO THE ADDITION OF 5.035
ACRES OF LAND TO BRUSHY CREEK MUNICIPAL UTILITY
DISTRICT FOR INCLUSION IN SAID DISTRICT.
WHEREAS, attached to this resolution and made a
petition requesting the consent of the City of Round

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the petition for Request for Consent to the Addition of Land
to Brushy Creek Municipal District, attached hereto as Exhibit "A" and
incorporated herein, is hereby granted, and the City consents to the
annexation of the property described in said petition into the Brushy
Creek Municipal Utility District.
The City Council hereby finds and declares that written notice
of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
The undersigned, Gavumik Builders, LP, a Texas limited partnership, (herein the
"Landowner") holder of title to the land hereinafter described, as indicated by the tax rolls of
Williamson County, Texas, and acting pursuant to the provisions of Chapters 49 and 54, Texas
Water Code respectfully requests the City Council of the City of Round Rock, Texas, for its
written consent to the inclusion of land in Brushy Creek Municipal Utility District under Chapters
49 and 54, Texas Water Code by annexation of land pursuant to the provisions of Chapters 49,
Texas Water Code; and would respectfully show the following:

The boundaries of the Property to be included in Brushy Creek Municipal Utility District
(the "District") are described on Exhibit "A" attached hereto (the "Property"). The Property
consists of 5.035 acres and is located in the extraterritorial jurisdiction of the City of Round Rock,
Texas.

Landowner is the owner of title to all the Property and is the owner of a majority in value
of the Property as indicated by the tax rolls in Williamson County, Texas. The lienholder on the
Property is First State Bank of Central Texas. There are no residents on the Property.
Landowner seeks annexation of the Property into the District so that the Property may
receive municipal water and wastewater service from the District. There is a necessity for the
inclusion of the Property within the District because the District's policy is to not provide service
to lands outside the corporate boundaries of the District unless the lands are annexed into the
District.
IV.
WHEREFORE, the Landowner respectfully prays that this request be heard and that your
Honorable Body duly pass and approve an ordinance or resolution granting the consent to the
inclusion of the Property described herein within the District.

Background Information:
The subject property is located within Round Rock's ETJ and a condition of the Brushy Creek
Regional Wastewater Disposal Contract requires Round Rock's consent for the BCMUD to
provide service. The City does not plan to provide wastewater service to this tract.
