R-2016-3612 WHEREAS, the City of Round Rock wishes to release certain real property from its extraterritorial jurisdiction ("ETJ"), and relinquish all ETJ rights in said property to the City of Pflugerville, and WHEREAS, the City of Round Rock wishes to enter into an Agreement Releasing and Accepting Extraterritorial Jurisdiction Property Between the City of Round Rock, Texas and the City of Pflugerville, Texas, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an Agreement Releasing and Accepting Extraterritorial Jurisdiction Property, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHITE, City Clerk 0112.1604;00359978 EXHIBIT "A„ AGREEMENT RELEASING AND ACCEPTING EXTRATERRITORIAL JURISDICTION PROPERTY THE STATE OF TEXAS § COUNTY OF WILLIAMSON § KNOW ALL BY THESE PRESENTS That this Agreement Releasing and Accepting Extraterritorial Jurisdiction Property ("Agreement") is by and between the City of Round Rock, Texas, a home -rule municipality located in Williamson and Travis Counties, Texas, and the City of Pflugerville, Texas, a home - rule municipality located in Travis and Williamson Counties, Texas. The City of Round Rock and the City of Pflugerville may be referred to singularly as "Party" and both collectively to as the "Parties." I. That the governing body of the City of Round Rock will dis-annex by Ordinance certain real property from its general-purpose boundaries, said property previously located within its corporate city limits and fully described on Exhibit "A" attached hereto and made a part hereof for all intents and purpose. H. That the City of Round Rock hereby agrees to release the real property described on Exhibit "A" from its extraterritorial jurisdiction. Further, the City of Round Rock hereby agrees to relinquish all extraterritorial jurisdictional rights to the City of Pflugerville which it has or may hereinafter acquire in said property. That upon disannexation by the City of Round Rock, the City of Pflugerville hereby agrees to accept such above-described real property into its extraterritorial jurisdiction. Further, the City of Pflugerville hereby agrees to accept all extraterritorial jurisdictional rights from the City of Round Rock on said property. IV. That the City of Round Rock hereby agrees that the effect of this agreement is to reduce the extraterritorial jurisdiction of the City of Round Rock. Further, the governing body of the City of Round Rock has given its required written consent by Resolution No. in accordance with Section 42.023 of the Texas Local Government Code. V. That the Parties agree to take appropriate action to effectuate the terms of this Agreement 358577bk approved hereby through the adoption of an official map showing their respective city limits and ETJ as required by Section 41.001 of the Texas Local Government Code. Further, That the Parties hereby agree that this agreement is privy only between the Parties herein and in no way affects, gains, or gives up any right or interest which may now or hereafter exist between the parties herein and any municipality not a party to this agreement. VI. That this agreement shall become binding immediately upon the proper execution thereof by the City of Round Rock and the City of Pflugerville. DATED on this the day of the month of , 2016.
