DECLARATION OF PUBLIC UTILITY E, ASEMENT

§ KNOW ALL PERSONS BY THESE PRESENTS:

That the CITY Of ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of Public Utility Easement for
the purpose of establishing the following exclusive easement in and under the following
described property in Williamson County, Texas, to -wit:
Being 0.034 of an acre, or 1,493 square feet more tract of land, being out of Lot 2, Block E, of
the University Village South Sections I and 2 Subdivision recorded in Document No.
2012047937 of the Official Public Records of Williamson County, Texas, situated in the Abel
L, Eaves Survey, Abstract No. 215, in the City of Round Rock, Williamson County, Texas. Said
0.034 of an acre being more particularly described in Exhibit "A" attached ]rereto and
incorporated herein for all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used for the
purposes of location, placement, relocation, construction, operation, enlargement, maintenance, alteration,
repair, rebuilding, removal and patrol of public utilities, to -wit: underground electric transmission and
distribution lines, telecommunication and cable television lines, water lines, natural gas lines, wastewater
lines, sanitary sewer lines, connecting lines, access facilities and related equipment, stonnwater lines,
drainage systems and structures, all necessary conduits, valves, vaults, manholes, ventilators and
appurtenances, storm sewers and collection facilities, drainage pipes and all other subsurface drainage
structures, and any necessary accessories, or operations.
Declarant retains, reserves, and shall continue to enjoy the surface of such easement for any and
all purposes which do not interfere with and prevent the use of the easement, including but not limited to,
the right to use the surface for park purposes and improvements. Declarant will not be responsible or
liable for any damage to utilities placed within the easement caused by Declarant's use of the surface
pursuant to this paragraph. By placing facilities within this easement, all entities agree to the terms of this
Declaration of Easement_
The benefits and obligations of the Easemenc created herein shall constitute benefits and
servitudes running with the land,
This Declaration may be modified, amended, or terminated by Declarant.

RECORDS OF WILLIAMSON COUNTY, TEXAS, SITUATED IN THE ABEL L. EAVES
SURVEY; ABSTRACT NO. 215, IN THE CITY OF ROUND ROCK, WILLIAMSON
COUNTY, TEXAS. SAID 0.034 OF AN ACRE TRACT BEING MORE FULLY DESCRIBED
AS FOLLOWS, WITH BEARINGS BASED ON THE NORTH AMERICAN DATUM OF 1983
(NA2011) EPOCH 2010.00, FROM THE TEXAS COORDINATE SYSTEM ESTABLISHED

COMMENCING at an iron rod with a illegible cap found, a point of curvature in the east right-

89°08'00", a chord bearing and distance of S 65°58'15" E, 28.07 feet, an are length of 31.11
feet to a point of non -tangency in the east zight-o£-way line of said Sandy Brook Drive, same
being a southwest corner of said Lot 3, Block E, also being a southermonst northwest comer of
said Lot 21 Block E and the northwest corner of a Water, Wastewater Line, Storm Sewer and
Drainage Easement recorded in Document No. 2011045296 of the Official Public Records of
Williamson County, Texas;
THENCE N 68°46'47" E, departing the east right-of-way line of said Sandy Brook Drive, with
the south line of said Lot 3, Block E, same being a north line of said Lot 2, Block E and, in part,
the north line of said Water, Wastewater Line, Storm Sewer & Drainage Easement and in part
the north line of a Storm Water and Drainage Easement recorded in Document No, 2000053391
of the Official Public Records of Williamson County, Texas, a distance of 123.15 feet for the
northernmost northwest comer and POINT OF BEGINNING hereof;
THENCE N 68°46'47" E, continuing with the south line of said Lot 3, Block E, same being a

distance of 10.33 feet to a calculated point for the northeast comer and point of non -tangent

THENCE with the are of said curve to the right, departing the south line of said Lot 3, Block E,
through the interior of said Lot 2, Block E and the interior of said Storm Water & Drainage
Easement, said carve having a radius of 65.00 feet, a central angle of 76°39'27", a chord bearing
and distance of S 30°27'04" W, 80.62 feet, an are length of 86.97 feet for a calculated point of
tangency in the south line of said Storm Water & Drainage Easement;
THENCE S 68°46'47" W, with, in part, the south line of said Storm Water & Drainage

westernmost northwest comer hereof;
THENCE departing the east right-of-way line of said Sandy Brook Drive, through the interior of

Sewer & Drainage Easement and, in part, through the interior of said Storm Water & Drainage
Easement, the following two (2) courses and distances:

2. with the arc of a tangent curve to the left having a radius of 55.00 feet, a central angle of
74°10'24", a chord bearing and distance of N 31°41'35" E, 66.33 feet, an arc length of
71.20 feet to the POINT OF BEGINNING and containing 0.034 of an acre of an acre in
the City of Round Rock, Williamson County, Texas. Said tract being described in
