CM-2016-1141 - 7/19/2016ELECTRONICALLY RECORDED 2016064924 Williamson County Texas DECLARATION OF PUBLIC UTILITY E, ASEMENT THE STATE OF TEXAS § § KNOW ALL PERSONS BY THESE PRESENTS: COUNTY OF Vi+ILLIAMSON § That the CITY Of ROUND ROCK, a Texas home -rule municipal corporation (hereinafter called the "Declarant") has executed this Declaration of Public Utility Easement for the purpose of establishing the following exclusive easement in and under the following described property in Williamson County, Texas, to -wit: Being 0.034 of an acre, or 1,493 square feet more tract of land, being out of Lot 2, Block E, of the University Village South Sections I and 2 Subdivision recorded in Document No. 2012047937 of the Official Public Records of Williamson County, Texas, situated in the Abel L, Eaves Survey, Abstract No. 215, in the City of Round Rock, Williamson County, Texas. Said 0.034 of an acre being more particularly described in Exhibit "A" attached ]rereto and incorporated herein for all purposes. The perpetual easement, right-of-way, rights and privileges herein granted shall be used for the purposes of location, placement, relocation, construction, operation, enlargement, maintenance, alteration, repair, rebuilding, removal and patrol of public utilities, to -wit: underground electric transmission and distribution lines, telecommunication and cable television lines, water lines, natural gas lines, wastewater lines, sanitary sewer lines, connecting lines, access facilities and related equipment, stonnwater lines, drainage systems and structures, all necessary conduits, valves, vaults, manholes, ventilators and appurtenances, storm sewers and collection facilities, drainage pipes and all other subsurface drainage structures, and any necessary accessories, or operations. Declarant retains, reserves, and shall continue to enjoy the surface of such easement for any and all purposes which do not interfere with and prevent the use of the easement, including but not limited to, the right to use the surface for park purposes and improvements. Declarant will not be responsible or liable for any damage to utilities placed within the easement caused by Declarant's use of the surface pursuant to this paragraph. By placing facilities within this easement, all entities agree to the terms of this Declaration of Easement_ The benefits and obligations of the Easemenc created herein shall constitute benefits and servitudes running with the land, This Declaration may be modified, amended, or terminated by Declarant.
