AN ORDINANCE AMENDING CHAPTER 5, SECTION 5.100, CODE OF
ORDINANCES (1990 EDITION), CITY OF ROUND ROCK, TEXAS, BY
AMENDING AND ADDING CERTAIN PROVISIONS OF THE STANDARD
FIRE PREVENTION CODE AS ADOPTED IN SECTION 5.101; PROVIDING
A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES
AND RESOLUTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
I.
That the Standard Fire Prevention Code which as been adopted
by the City. of Round Rock in Chapter 5, Section 5.101, Code of
Ordinances, 1990 Edition, City of Round Rock, Texas is hereby
amended as follows:
A. Chapter 6, Section 602.6.1 - Access to Buildings by Fire
Apparatus, is hereby amended as follows:
SECTION 602.6.1
Every building hereafter constructed shall be accessible
to fire department apparatus by way of access roadways
with all-weather driving surfaces of not less than 20 ft
(6.1 m) of unobstructed width, with adequate roadway
turning radius capable of supporting the imposed loads of
fire apparatus and having a minimum vertical clearance of
13 ft 6 inch (4.1 m) and terminating within 150 ft. from
all parts of the building. During construction, when
combustibles are brought on to the site in such
quantities as deemed hazardous by the Fire Official,
access roads and a suitable temporary supply of water
acceptable to the fire department shall be provided and
maintained.
B. Chapter 6, is hereby amended by adding a new Section
602.6.7 - Specifications:
SECTION 602.6.7
(a) Any fire lane more than one hundred feet (100') in
length shall either connect at each end to a
dedicated street or be provided with a turnaround
having a minimum radius of fifty five feet (55')

when measured from curb to curb. All fire lanes
shall be maintained and kept in a state of good
repair at all times by the owner, manager, or
person in charge of the premises, and the City of
Round Rock shall never be responsible for the
maintenance thereof.
(b) The Fire Official or his authorized representative
is hereby authorized to designate adequate fire
lanes and/or turnarounds to any building when
deemed necessary for fire department access in the
event of fire in such building.
C. Chapter 6, is hereby amended by adding a new Section
602.6.8 - Fire Lane Markings:
SECTION 602.6.8
(a) The owner, manager, or person in charge of any
building or property to which fire lanes have been
approved or required by the Fire Official or his
authorized representative shall mark and maintain
said fire lanes in the following manner:
All curbs and curb ends shall be painted red with
four inch (4") white lettering stating "NO PARKING
- FIRE LANE". Wording may not be spaced more than
thirty feet (30') apart.
In areas where fire lanes are required but no
continuous curb is available, one of the following
methods shall be used, in conjunction with the curb
markings, to indicate that the fire lane is
continuous:
Option #1: Signs twelve inches (12") wide and
eighteen inches (18") in height with red
lettering on a white background stating "NO
PARKING - FIRE LANE" shall be mounted
conspicuously along the edge of the fire lane.
Signs may be spaced no more than thirty feet
(30') apart and the lettering shall be at
least 3/8" stroke.
Option #2: From the point the fire lane
begins to the point the fire lane ends,
including behind all parking spaces which
adjoin a fire lane, shall be marked with one
continuous eight inch (8") red stripe painted
on the drive surface behind the parking
spaces. All curbing adjoining a fire lane
must be painted red. Red stripes and curbs
will contain the wording "NO PARKING -FIRE
LANE", painted in four inch (4") white
letters.

(b) For two years immediately following the passage of
this Section, fire lanes marked in yellow with
black lettering or any other configuration will
have the same effect as fire lanes marked in red
with white lettering. Immediately after this two
year period, only fire lanes marked in red with
white lettering will be effective.
D. Chapter 6, is hereby amended by adding a new Section
602.6.9 - Destruction of Fire Lane Signs:
SECTION 602.6.9
It is hereby unlawful for any person, without lawful
authority to attempt or in fact alter, destroy, deface,
injure, knock down, or remove any sign designating a fire
lane erected under the terms of this Code, or to deface
a curb marking in any way.
E. Chapter 6, is hereby amended by adding a new Section
602.6.10 - Abandonment or Closing:
SECTION 602.6.10
No owner, manager, or person in charge of any premises
served by a required fire lane shall abandon or close
such fire lane without written permission of the Fire
Official of the City of Round Rock.
F. Chapter 6, is hereby amended by adding a new Section
602.6.11 - Parking in Fire Lanes Prohibited:
SECTION 602.6.11
No person shall park, place, allow, permit, or cause to
be parked, placed, or remain unattended, any non-
emergency motor vehicle, trailer, boat or similar
obstruction within or upon an area designated as a fire
lane and marked by an appropriate sign or curb marking.
Any non -emergency motor vehicle, trailer, boat, or
similar obstruction found parked or unoccupied within an
area designated as a fire lane as required by this
section is hereby declared a nuisance per se and any such
motor vehicle, trailer, boat, or similar obstruction
parked or unoccupied in such a manner as to obstruct in
whole or in part any such fire lane shall be prima facie
evidence that the registered owner unlawfully parked,
placed, or permitted to be parked or placed such
obstruction within a fire lane.
The records of the State Highway Department or the County
Highway License Department showing the name of the person
to whom the Texas highway license or boat or trailer
license is issued shall constitute prima facie evidence
of ownership by the named persons.

G. Chapter 6, is hereby amended by adding a new Section
602.6.12 - Modifications:
SECTION 602.6.12
The Fire Official of the Fire Department shall have power
to modify any of the provisions of the Code hereby
adopted upon application in writing by the owner or
lessee, or his duly authorized agent, when there are
practical difficulties in the way of carrying out the
strict letter of the code; provided that the spirit of
the code shall be observed, public safety secured, and
substantial justice done. The particulars of such
modifications when granted or allowed and the decision of
the Fire Official of the Fire Department thereon shall be
entered upon the records of the department and a signed
copy shall be furnished the applicant.
H. Chapter 6, is hereby amended by adding a new Section
602.6.13 - Enforcement; Issuance of Citations;
Impoundment of Obstructions:
SECTION 602.6.13
The Fire Official or any member of the Fire Department
designated by the Fire Official, the Chief of Police, or
any member of the Police Department designated by the
Chief of Police are hereby authorized to issue parking
citations for any motor vehicle, trailer, boat, or
similar obstruction found parked or unattended in or upon
a designated fire lane and may have such obstruction
removed by towing it away. Such vehicle or obstruction
may be redeemed by payment of the towage and storage
charges at the owner's expense.
No parking citations shall be voided nor shall the
violator be relieved of any penalty assessed by a judge
of the Municipal Court for any provision by the
redemption of the obstruction from the storage facility.
I. Chapter 6, is hereby amended by adding a new Section
602.6.14 - Penalties:
SECTION 602.6.14
Any person who shall violate any of the provisions of the
Code hereby adopted or fail to comply herewith, or who
shall violate or fail to comply with any order made
thereunder, or who shall build in violation of any
detailed statement of specifications or plans submitted
and approved thereunder, or any certificate or permit
issued thereunder, and from which no appeal has been
taken, or who shall fail to comply with such an order as
affirmed or modified by the City of Round Rock, shall
severally for each and every violation and noncompliance
respectively be guilty of a misdemeanor. Any violation

of this ordinance is punishable by a fine not to exceed
Two Thousand Dollars ($2,000) as provided for by Article
4.14 of the Texas Code of Criminal Procedure, as amended.
In the event that a fine not to exceed Two Thousand
Dollars ($2,000) is greater than the intended
jurisdictional limit, then the fine imposed shall not
exceed Five Hundred Dollars ($500.00). The imposition of
one (1) penalty for any violation shall not excuse the
violation or permit it to correct or remedy such
violations or defects within a reasonable time; and when
not otherwise specified, each ten (10) days that
prohibited conditions are maintained shall constitute a
separate offense.
III.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

Section 9.1814, Code of Ordinances (1990 Edition)
concerning fire lanes. (Second Reading)
STAFF RESOURCE PERSON: Keith Tanner
STAFF RECOMMENDATION:
This ordinance would amend the current fire code relating to the
location and marking of required fire lanes for commercial and multi-
family structures. This ordinance would also restrict parking in
properly marked fire lanes and provide authority to issue tickets for
parking in fire lanes.
There have been no changes since the first reading of the ordinance.
