AN ORDINANCE OF THE CITY OF ROUND ROCK, TEXAS,
CALLING AN ELECTION ON MAY 15, 2004 FOR THE PURPOSE
OF ELECTING CERTAIN CITY OFFICIALS AND FOR
SUBMITTING TO THE VOTERS CERTAIN PROPOSED
AMENDMENTS TO THE HOME RULE CHARTER OF THE CITY;
DESIGNATING ELECTION PRECINCTS AND POLLING PLACES;
PROVIDING FOR EARLY VOTING; PROVIDING FOR
PERFORMANCE OF REQUIRED ADMINISTRATIVE DUTIES; AND
PROVIDING FOR OTHER MATTERS RELATING TO SUCH CITY
ELECTION.
WHEREAS, the City Council of the City of Round Rock,
Texas, wishes to order a city election on
purpose of electing Councilmember Place
Place 6; and
WHEREAS, the City Council additionally wishes to submit to
the voters at the same election certain proposed amendments to
the home rule charter of the City of Round Rock; and
WHEREAS, Section 13.11 of the charter for the City of
Round Rock provides that proposed amendments to such charter may
be "framed and submitted to the voters of the City in the manner
provided by Tex. Loc. Gov't Code Ann., Chapter 9, as amended;"

WHEREAS, Vernon's Texas Codes Annotated, Local Government
Code §9.004(a) provides that the "governing body of a
municipality on its own motion may submit a proposed charter
amendment to the municipality's qualified voters for their
approval at an election;" and

WHEREAS, certain charter amendments are proposed for
submission to the voters of the City of Round Rock, and a copy
of same is attached hereto as Exhibit "A" and incorporated
herein by reference for all purposes; and
WHEREAS, Vernon's Texas Codes Annotated, Local Government
Code §9.004(b) requires the charter amendment election to be
held on the first authorized uniform election date prescribed by
the Election Code that allows sufficient time to comply with
other requirements of law and that occurs on or after the
thirtieth (30th) day after the date the ordinance is adopted; and
WHEREAS, the City Council has determined that May 15, 2004
is the appropriate date for holding the election to elect
Councilmember Place 2 and Councilmember Place 6, and for holding
the charter amendment election; and
WHEREAS, the City Council wishes to encourage all
registered voters in the city to vote in this election; and
WHEREAS, it has been determined that Caldwell Heights
Elementary School, Stony Point High School, Forest Creek
Elementary School, Gattis Elementary School, First Baptist
Church, Round Rock High School, Bluebonnet Elementary School,
Old Town Elementary School, and Wells Branch Elementary School
would be easily accessible to voters in the City of Round Rock
on election day; and

WHEREAS, it has been further determined that early voting
places will be at Robert G. & Helen Griffith Public Library,
Noel Grisham Middle School, Round Rock Independent School
District Administration Building, United Heritage Conference
Center, Forest North Elementary School, and Clay Madsen
Recreation Center; Now, Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND
ROCK, TEXAS, THAT:
I.
1. A charter amendment election shall be held in
conjunction with the general election on Saturday, May 15, 2004
in accordance with the attached Order of Election. The City of
Round Rock hereby designates the election precincts and polling
places designated by John Willingham, Williamson County
Elections Administrator, and approved by the Williamson County
Commissioners Court, for such election. Further, the City of
Round Rock hereby designates the early voting polling places and
the temporary polling places designated by John Willingham,
Williamson County Elections Administrator, and approved by the
Williamson County Commissioners Court, for such election.
2. Caldwell Heights Elementary School, Stony Point High
School, Forest Creek Elementary School, Gattis Elementary
School, First Baptist Church, Round Rock High School,
Bluebonnet Elementary School, Old Town Elementary School, and
Wells Branch Elementary School are hereby designated as the

official election day polling places; and Robert G. & Helen
Griffith Public Library, Noel Grisham Middle School, Round Rock
Independent School District Administration Building, United
Heritage Conference Center, Forest North Elementary School, and
Clay Madsen Recreation Center are hereby designated as the
official early voting polling places for the May 15, 2004
election; and that the polling places and voting hours are
detailed in the attached Order of Election.
3. For such election, the City of Round Rock hereby
appoints the election judge(s) and alternate election judge(s)
appointed by Williamson County, Texas and designated by John
Willingham, Williamson County Elections Administrator.
4. Early voting shall be conducted by personal appearance
and by mail at the following places: Round Rock Independent
School District Administration Building, 1311 Round Rock Avenue,
Round Rock, Texas; and/or at such other places as shall be
designated in writing by John Willingham, Williamson County
Elections Administrator, and approved by the Williamson County
Commissioners Court. During the period in which early voting is
required or permitted by law, that being April 28, 2004 through
May 11, 2004, the hours designated for early voting by personal
appearance shall be as follows, and/or as otherwise designated
in writing by John Willingham, Williamson County Elections
Administrator, and approved by the Williamson County
Commissioners Court:

The Early Voting Clerk and manager of the central counting
station shall be John Willingham, Williamson County Elections
Administrator, and he
shall appoint additional clerks as
necessary to assist in early voting.
5. An Early Voting Ballot Board is hereby created to
process early voting results, and the City of Round Rock hereby
appoints the presiding judge of said Board appointed by John
Willingham, Williamson County Elections Administrator. The
presiding judge shall appoint at least two (2) other members of
the Board.
6. Pursuant to the Election Code and the applicable
Election Services Contract, John Willingham shall be appointed
as Custodian of Election Records.
7. All resident, qualified electors of the City of Round
Rock, Texas shall be entitled to vote at the election.
8. Notice of this election shall be given in accordance
with Vernon's Texas Codes Annotated, Local Government Code
§9.004(c) by twice publishing a substantial copy of the proposed
amendments to the city charter in a newspaper of general
circulation published in the city. The dates of such

publication shall be the same day in each of two (2) successive
weeks, with the first publication occurring before the
fourteenth (14th)day before the date of the election.
Notice of this election shall also be given by posting a
copy of the Notice on the bulletin board used for posting
notices of City Council meetings, and it shall be posted no
later than the twenty-first (215t)day before the date of the
election and shall remain posted through election day.
The City Secretary is hereby authorized and directed to
publish and post the required notices in the manner and for the
time periods required by law.
9. At the election, the proposed amendments to amend the
charter shall be set forth substantially in the form contained
herein, and said proposed charter amendments shall be submitted
to the qualified voters in accordance with applicable law.
10. The official ballots for this charter amendment
election shall be prepared so as to permit the qualified
electors to vote on a proposed charter amendment by ballot
title. The ballot title of a proposed charter amendment may
differ from its legal title and shall be a clear, concise
statement describing the substance of the proposed charter
amendment without argument or prejudice. The official ballots
for this charter amendment election shall be prepared so as to
permit the qualified electors to vote "Yes" or "No" on the
proposed charter amendments. Said proposed charter amendments

shall be combined with other allowable matters on the same
ballots, said ballots to contain such provisions, markings and
language as required by law. The proposed charter amendments
shall be expressed substantially as follows:

11. In all pertinent respects, the election shall be
conducted in accordance with applicable provisions of the Texas
Election Code.
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
C. The City Council hereby finds and declares that
written notice of the date, hour, place and subject of the
meeting at which this Ordinance was adopted was posted and that

such meeting was open to the public as required by law at all
times during which this Ordinance and the subject matter hereof
were discussed, considered and formally acted upon, all as
required by the Open Meetings Act, Chapter 551, Texas Government
Code, as amended.

PROPOSITION NO. 1
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Sections 4.01(d) and 4.01(e), providing for assistant and acting city
managers.
SECTION 4.01 CITY MANAGER
(d) Powers and Duties:
The City Manager shall be the Chief Administrative Officer of the City, and
shall be responsible to the City Council for the proper administration of all
the affairs of the City and to that end shall have the power and shall be
required to:
(1) see that all state laws and City ordinances are effectively enforced;
(2) appoint, suspend or remove all or any one of the directors of
departments, except as otherwise provided in this Charter;
( appoint, suspend or remove such Assistant City Managers as may
be deemed necessary by the City Council to assist the City
Manager in carrying out the day to day management
responsibilities;
(4)
attend all meetings of the City Council except when excused by the
City Council, and shall have the right to take part in the
discussions;
(45) prepare the budget annually and submit it to the City Council and
be responsible for its administration after its adoption;
(56) prepare and submit to the City Council at the end of the fiscal year
a complete report on the finances and administrative activities of
the City for the preceding year;
(67) keep the City Council advised of the financial condition and future
needs of the City and make such recommendations as may seem
advisable;

(-78) make other such reports as the City Council may require
concerning the operations of City departments, offices and
agencies subject to his or her discretion and supervision; and
(89) perform such other duties as may be prescribed by this Charter or
required by the City Council, as consistent with this Charter.
(e) Assistant Acting City Manager:
The City Manager, within sixty (60) days after taking office, shall
designate by letter filed with the City Secretary, a qualified administrative
officer of the City to . - - . -- - - .. - - - . - .: - be the Acting
City Manager in his or her absence or disability. Such designation shall be
subject to the prior approval of the City Council. The Assistant Acting City
Manager is authorized to perform the same powers and duties as the City
Manager while acting in the City Manager's stead. No member of the City
Council shall serve as A cistant Acting City Manager. From time to time
the City Manager may remove and appoint another Assistant Acting City
Manager, also with the prior approval of the City Council. The Acting City
Manager shall perform the duties of the City Manager until the City
Manager returns or his or her disability shall cease or until the City
Council designates another person to perform such duties.
PROPOSITION NO. 2
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Sections 3.05, 4.01(a), 4.01(f) and 4.01(g), amending the powers and duties
of the City Manager.
SECTION 3.05 MAYOR AND MAYOR PRO -TEM
The Mayor shall be the official head of the City government. The Mayor shall be
the chairman of, and shall preside at all meetings of the City Council. The Mayor shall
vote on every proposition before the City Council, but shall have no power to veto. The
Mayor shall see that all ordinances, bylaws, and resolutions of the City Council are
J faithfully obeyed and enforced. Except as provided in Section 4.01, tThe Mayor shall,
when authorized by the City Council, sign all official documents such as ordinances,
resolutions, conveyances, grant agreements, official plats, contracts, and bonds. The
Mayor shall appoint special committees he or she deems advisable and as instructed by
the City Council. The Mayor shall perform such other duties consistent with this Charter
or as may be imposed upon him or her by the City Council.
The Mayor Pro -tem shall be a Council member elected by the City Council at the
first regular City Council meeting following each regular City election. The Mayor Pro -
tem shall act as Mayor during the disability or absence of the Mayor, and in this
capacity shall have the rights conferred upon the Mayor.

SECTION 4.01 CITY MANAGER
(a) Appointment and Qualifications:
The City Council by majority vote of the entire City Council shall appoint a
City Manager. The method of selection shall be left to the discretion of the
City Council so long as the method insures orderly, nonpartisan action
toward securing a competent and qualified person to fill the position. The
City Manager shall be chosen solely upon the basis of such person's
executive and administrative training, experience and ability and need not
when appointed be a resident of the City; however, during the tenure of
his or her office the City Manager shall reside within the City. The City
Manager shall be bonded at City expense in an amount to be determined
by the City Council

al Contracts and Purchases:
The City Council may by ordinance set a maximum amount for which the
City Manager shall be authorized to execute contracts and/or to expend
funds for budgeted items; provided however, that all contracts and
expenditures must comply with state laws requiring competitive bids. The
City Council may by ordinance establish an amount above which all
contracts or purchases must be approved in advance by the City Council.
All contracts and purchases shall be handled in a manner to obtain the
best value for the City.
(g) Execution of Documents:
The City Manager shall have the authority to execute on behalf of the
City, standard form documents, including but not limited to deeds,
releases of liens, rental agreements, easements, right-of-way
agreements, joint use agreements, and other similar documents, under
the following conditions:
(i1. The execution of the document is necessary to carry out a public works
project; utilize, maintain or improve a City facility, street, right-of-way,
easement, park or other City property, or to implement other City
policies; provided that such project, program or policy has been approved
by the City Council;
012 That all blanks are filled in on any document correctly and that such
document is consistent with the objectives approved by the City Council;
and
(iii) That the form of such document shall be approved by the City
Attorney.

PROPOSITION NO. 3
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Section 5.01(a), providing that the City Council may establish the general
election date in accordance with the Texas Election Code.
SECTION 5.01 CITY ELECTIONS
(a) Schedule.
The regular City Election will be held annually in accordance with the
provisions of Tex. Elec. Code Ann., Chapter 41. The City Council shall, by
ordinance, establish the general election date. on thc first Saturday in

candidates who are unopposed may be canceled -in accordance with the
provisions of Tex. Elec. Code Ann., Chapter 2, Subchapter C. The City
Council shall be responsible to specify places for holding such election.
PROPOSITION NO. 4
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Sections 7.02 and 7.04, establishing procedures regarding petitioners'
committee affidavits and notice for initiative and referendum petitions.
SECTION 7.02 COMMENCEMENT OF PROCEEDINGS;
PETITIONERS' COMMITTEE; AFFIDAVIT
Any five (5) or more qualified voters of the City may commence initiative or
referendum proceedings by filing with the City Secretary an affidavit stating that they
will constitute the petitioners' committee and be responsible for circulating the petition
and filing it in proper form, stating their names and addresses and spccifying the
address(cs) to which all noticcs to thc committcc arc to be scnt, and setting out in full
the proposed initiative ordinance or citing the ordinance sought to be reconsidered.
No later than ten (10) days after the date that the aforesaid affidavit is filed and
received by the City Secretary, supplemental affidavits may be filed adding names to
the petitioners' committee membership.
The affidavit shall also designate one member as the Committee Chairperson and
state the name, address and telecopier number (if any) of the Committee Chairperson
to which all notices provided herein shall be served. The name of the Committee
Chairperson may be changed by an amendment to the affidavit signed by at least a
majority of the committee members.
All notices provided for herein may be served on the Committee Chairperson by
personal delivery, by telephonic document transfer to the current telecopier number, if

any, or by mail, which shall be complete upon deposit of the paper, enclosed in a
postpaid, properly addressed wrapper, in a post office or official depository under the
care and custody of the United States Postal Service.
Immcdiatcly Within ten (10) business days after the affidavit of the petitioners'
committee is filed, the person performing the duties of City Secretary shall issue the
appropriate petition blanks to the petitioners' committee.
SECTION 7.04 DETERMINATION OF SUFFICIENCY
(a) Certificate of City Secretary.
Within ten (10) days after the petition is filed, the person performing the
duties of City Secretary shall complete a certificate as to its sufficiency,
specifying, if it is insufficient, the particulars wherein it is defective and
shall immediately upon completion of certification send serve a copy of
the certificate to
mail the Committee Chairperson, as set forth in Section 7.02.
PROPOSITION NO. 5
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Section 7.03(a), changing the number of voters who must sign a petition for
initiative and referendum from 5% of the total qualified voters of the City to
10% of the total qualified voters of the City.
SECTION 7.03 PETITIONS
(a) Number of Signatures.
Initiative and referendum petitions must be signed by qualified voters of
the City equal in number to at (east five ten percent (-5 10%) of the
number of total qualified voters of the City as currently certified to by the
County Election Administrator, or 250, whichever is greater.
PROPOSITION NO. 6
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Sections 7.03(d), 7.04(c), 7.04(d), and 7.04(e), increasing the time for filing
initiative and referendum petitions.
SECTION 7.03 PETITIONS
(d) Time for Filing Referendum Petitions.

Referendum -Petitions must be filed within thirty (30) forty-five (45) days
after the initial issuance of the appropriate blanks for reconsideration of
to the
petitioners' committee. Additional time as specified in Section 7.04 shall
SECTION 7.04 DETERMINATION OF SUFFICIENCY
(c) Insufficient Petition, Final Determination.
If a petition is certified insufficient, and the petitioners' committee does
not elect to amend or request City Council review under subsections (d)
and (c) of this section within the time required, the City Secretary shall
present a certificate to the City Council by the next regular City Council
meeting which shall be a final determination of the insufficiency of the
petition.
(d) Insufficient Petition, Appeal.
If a petition has been certified insufficient crs' committee

committee may, within two (2) working days after receiving the copy of
such certificate, file a request that it be reviewed by the City Council. The
City Council shall review the certificate at its next regular meeting
following the filing of such request and approve or disapprove it, and the
City Council's determination shall then be a final determination.
(c) Insufficient Petition, Amending.

(fe) Court Review: New Petition.
A final determination as to the sufficiency of a petition shall be subject to
review in a court of competent jurisdiction and higher. A final
determination of insufficiency, even if sustained upon court review, shall
not prejudice the filing of a new petition for the same purpose.
PROPOSITION NO. 7
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Section 8.08, regarding signatories on depository accounts.
SECTION 8.08 DEPOSITORY
All monies received by any person, department or agency of the City for or in
connection with affairs of the City shall be deposited promptly in the City depository or
depositories, which shall be designated by the City Council in accordance with such
regulations and subject to such requirements as to security for deposits and interest
thereon as may be established by ordinance. All checks, vouchers, or warrants for the
withdrawal of money from the City depositories shall be signed by the Mayor a
nd
- " - - or City Manager and countersigned by an authorized
designee, as approved by City Council ordinance. Provided, that the City Council, under
such regulations and limitations as it may prescribe, may by ordinance authorized the
use of machine -imprinted facsimile signatures of said Mayor and City Manager and
authorized designee on such checks, vouchers and warrants.

PROPOSITION NO. 8
Amendment to the Home Rule Charter of the City of Round Rock, Texas,
Section 8.10, regarding the manner in which the City's annual audit report is
made available to the public.
SECTION 8.10 INDEPENDENT AUDIT
At the close of each fiscal year, and at such other times as it may be deemed

the City by a certified public accountant. The certified public accountant so selected
shall have no personal interest, directly or indirectly, in the financial affairs of the City
or any of its officers. Upon completion of the audit, the summary thcrcof shall be

placed on file in the City Secretary's office as public record. A notice shall be published
in the official newspaper when the aforesaid copies of the audited annual financial

SECTION 10.01 DEPARTMENT OF TAXATION
There shall be established a Department of Taxation to assess and collect taxes,
the head of which shall be the the Director of Finance. The Director of Finance shall give
a surety bond for faithful performance of his or her duties, including compliance with all
controlling provisions of the state law bearing upon the functions of such office, in a
sum which shall be fixed by the City Council at not Tess than five thousand dollars
($5,000.00.) Notwithstanding the foregoing, the City Council may contract with an
outside agency or other governmental entity to assess and collect City taxes and to
perform the duties of the City's Tax Assessor/Collector.

Amendment to the Home Rule Charter of the City of Round Rock, Texas, adding
provisions dealing with Police Department disciplinary procedures.
POLICE DEPARTMENT DISCIPLINARY PROCEDURES
SECTION 13.01 PURPOSE
The purpose of this Article is to establish procedures for the appeal of certain
disciplinary actions for Officers (as defined below) of the Round Rock Police
Department. This Article is not applicable to the Chief of Police or to employees of the
Police Department who are not sworn police officers or to police officers who are in a
probationary period.
SECTION 13.02 DEFINITIONS
(a) Chief. "Chief" means the Chief of Police of the Round Rock Police
Department.
022 Day. "Day" means a calendar day.
(c1 Demotion. "Demotion" means a change in duty assignment of an Officer
from a position in one pay grade to a position in a lower pay grade.
(d) Department. "Department" means the City of Round Rock Police
Department.
CO Disciplinary Matrix. "Disciplinary Matrix" means the disciplinary matrix
adopted, maintained and amended from time to time by the Chief.
O2 HR Director. "HR Director" means the City's Director of Human Resources.
(g) Officer. "Officer" means a sworn police officer employed by the
Department who has served for one year following the successful
completion of the Department's field training program.
012 Probationary Officer. "Probationary Officer" means a sworn police officer
employed by the Department who has not completed the Department's
field training program or who has served for less than one year following
the successful completion of the Department's field training program.

£L2 Suspension. "Suspension" means a disciplinary action whereby an Officer
is involuntarily relieved of duty for more than twenty-four hours without
pay. Suspension, as used herein, does not mean being relieved of duty for
twenty four hours or less or being relieved of duty without loss of pay.
£L1 Termination. "Termination"means a disciplinary action whereby an Officer
is permanently relieved of duty.
SECTION 13.03 APPEALS TO A HEARING EXAMINER
LaZ Notice of Appeal. If the Chief determines to impose a disciplinary action
that includes Suspension, Demotion, or Termination, and the Officer is not
satisfied with such decision, the Officer may elect to appeal the decision
to a Hearing Examiner. In order to exercise the right of appeal, the Officer
shall file with the Chief a written notice of appeal on forms provided by
the City within three (3) calendar days of being notified of the Chief's
decision to impose Suspension, Demotion, or Termination. The written
notice of appeal shall not be effective unless the Officer agrees to waive
and release any and all rights the Officer might have to appeal the Chief's
decision to a court of law.
01 Selection of Hearing Examiner. Upon receipt of the written notice of
appeal, the Chief shall notify the HR Director. The HR Director and the
Officer shall attempt to agree on the selection of a Hearing Examiner on
or before 10 days after the date the notice of appeal is filed. If no
agreement is reached within the specified time, The HR Director shall
request a list of seven qualified neutral arbitrators from the American
Arbitration Association or the Federal Mediation and Conciliation Service
or their successors in function. The Officer and the HR Director may agree
on one of the seven arbitrators on the list. If they do not agree within 25
days after the date the notice of appeal was filed, the Officer and the HR
Director shall on the 25th day after the appeal was filed alternate striking
a name from the list and the name remaining is the Hearing Examiner. In
the event that the 25th day falls on a Saturday, Sunday, or a legal
holiday, then the parties shall strike the list on the next work day. The
parties shall agree on a date for the hearing that is within the time period
prescribed in paragraph (d) below.
(cl Hearing Examiner's Jurisdiction and Authority. The Hearing Examiner has
jurisdiction to hear appeals from a decision of the Chief to Suspend,
Demote or Terminate an Officer. Upon consideration of the testimony,
evidence, arguments, and briefs, the Hearing Examiner may affirm,
modify, or reverse the decision of the Chief. If the Hearing Examiner
determines to modify the decision, the Hearing Examiner's authority to so
modify is limited to the level of discipline outlined in the Disciplinary
Matrix.
Appeal Hearing. The appeal hearing shall begin as soon as possible, but in
any event within 60 days after the date the appeal is filed. If the hearing

is not begun within 60 days after the date the appeal is filed, the
Suspension, Demotion or Termination is upheld and the appeal is
withdrawn if the Officer is not ready to proceed and the appeal is
sustained if the Chief is not ready to proceed. In computing the 60 -day
period, a period of delay not to exceed 30 calendar days because of a
continuance granted at the request of the Chief or the Officer on good
cause being shown, or because of the unavoidable unavailability of the
Hearing Examiner on the date of the hearing. In no event may a Hearing
Examiner grant a continuance of more than 30 days in a hearing involving
Termination. A Hearing Examiner may grant a continuance beyond the
30 -day period upon good cause being shown in a hearing involving
Suspension or Demotion unless the Officer has another disciplinary action
pending.
Lei Subpoenas. The Hearing Examiner shall have the power to issue
subpoenas.
Expedited Procedure. The parties may agree to an expedited hearing
procedure. Unless otherwise agreed by the parties, in an expedited
procedure the Hearing Examiner shall render a decision on the appeal
within 10 days after the date the hearing closed.
in Non -expedited Procedure. In an appeal that does not involve an expedited
hearing procedure, the Hearing Examiner shall make a reasonable effort
to render a decision on the appeal within 30 days after the date the
hearing ends or the briefs are filed. The Hearing Examiner's inability to
meet the time requirements imposed by this paragraph does not affect
the Hearing Examiner's jurisdiction, the validity of the disciplinary action,
or the Hearing Examiner's final decision.
Final Decision. The Hearing Examiner's decision is final and binding on all
parties. No party shall have the right to appeal a Hearing Examiner's
decision except as provided in paragraph (i) below.
022 Fees and Expenses. The Hearing Examiner's fees and expenses are shared
equally by the Officer and the City. The costs ofa witness are paid by the
party who calls the witness.
CO District Court Appeal. A district court may hear an appeal of a Hearing
Examiner's award only on the grounds that the Hearing Examiner was
without jurisdiction or exceeded its jurisdiction or that the order was
procured by fraud, collusion, or other unlawful means. If the basis for the
appeal of the Hearing Examiner's award is based on the grounds that the
Hearing Examiner was without jurisdiction or exceeded itsjurisdiction, the
petition must be filed in district court within 10 days of the Hearing
Examiner's decision. An appeal must be brought in a district court in
Williamson County, Texas.

segun lo estime necesario el Concejo Municipal para ayudar al Gerente
de la Ciudad a llevar a cabo las responsabilidades administrativas
cotidianas;
(34) asista a todas las reuniones del Concejo Municipal, excepto cuando sea
dispensado por el Concejo Municipal, donde tendra derecho a participar
en los debates;
(45)
prepare el presupuesto en forma anual, lo envie al Concejo Municipal y
sea responsable de su administracion luego de su adopcion;
(56) prepara y envie al Concejo Municipal, al termino del ano fiscal, un
informe completo sobre las finanzas y actividades administrativas para el
alio precedente;

(67) mantenga al Concejo Municipal al tanto de Ia situacion Financiera y de las
necesidades futuras de la Ciudad y haga las recomendaciones que
parezcan aconsejables;
(78) haga otros informes que pudiera exigir el Consejo Municipal respecto de
las operaciones de los departamentos, oficinas y agencias de Ia Ciudad
que esten sujetos a su criterio y supervision; y
(89) realice otras actividades similares segun lo estipulen estos Estatutos o lo
exija el Concejo Municipal, guardando coherencia con estos Estatutos.
(e) Asistcntc dcl Gerente de la Ciudad Interino.
El Gerente de la Ciudad, en un plazo de (60) dias despues de asumir su cargo,
designara, mediante carta al Secretario de la Ciudad, a un funcionario
administrativo calificado de la ciudad para s funcioncs dcl
Ger-entc d Ia Ciudad que sea el Gerente de la Ciudad Interino en su ausencia o
en caso de discapacidad suya. Dicha designacion estara sujeta a la aprobacion
del Concejo Municipal. EI Asistcntc dcl Gerente Municipal Interino este
autorizado a desempenar la misma autoridad y funciones que el Gerente de la
Ciudad mientras actua en reemplazo del Gerente de Ia Ciudad. Ningun miembro
del Concejo Municipal puede servir como Asistcntc dcl Gerente de la Ciudad
Interino. En ocasiones, el Gerente de Ia Ciudad puede remover o designar a
otro Asistcntc dcl Gerente de Ia Ciudad Interino, sujeto tambien a la
aprobacion del Concejo Municipal. El Gerente de /a Ciudad Interino
desempenara las funciones del Gerente de la Ciudad hasta que reqrese el
Gerente de la Ciudad o termine su discapacidad o hasta que el Concejo
Municipal designe a otra persona para que desempef►e dichas funciones.
Propuesta No. 2
Enmienda a los Estatutos de Autonomia de Ia Ciudad de Round Rock, Texas,
Secciones .05, 4.01(a), 4.01(f) y 4.01(g), en que se modifican la autoridad y las
funciones del Gerente de la Ciudad.
SECCION 3.05 ALCALDE Y ALCALDE SUBROGANTE
El Alcalde sera el funcionario principal del gobierno de la Ciudad. El Alcalde sera el
presidente de todas las reuniones del Concejo Municipal. El Alcalde emitira su voto sobre
cada propuesta ante el Concejo Municipal, pero no tendra derecho a veto. El Alcalde velars
que todas las ordenanzas, los reglamentos y las resoluciones del Concejo Municipal se
obedezcan y hagan cumplir de manera estricta. Except() en to establecido en la Seccion 4.01,
eEI Alcalde debera, cuando este autorizado por el Concejo Municipal, firmar todos los
documentos oficiales, como ordenanzas, resoluciones, escrituras de traspaso, acuerdos de
concesiones, pianos oficiales, contratos y bonos. El Alcalde designara a comites especiales
que estime convenientes y segun se lo indique el Concejo Municipal. El Alcalde desempenara
otras funciones coherentes con estos Estatutos o segun se las imponga el Concejo Municipal.

El Alcalde Subrogante debera ser un miembro del Concejo elegido por el Concejo
Municipal en la primera reunion habitual del Concejo Municipal posterior a cada votacion
habitual de Ia Ciudad. El Alcalde Subrogante se desempenara como Alcalde durante el
periodo de ausencia o discapacidad del Alcalde y, en este cargo, tendra los derechos
asignados al Alcalde.
SECCION 4.01 GERENTE DE LA CIUDAD
(a) Designacion y calificaciones:
El Concejo Municipal, mediante voto mayoritario de todo el Concejo Municipal,
designara al Gerente de la Ciudad. El metodo de seleccion quedara a criterio del
Concejo Municipal siempre que este metodo garantice una accion ordenada y
no partidista que asegure Ia eleccion de una persona competente y calificada
para ocupar el cargo. El Gerente de Ia Ciudad sera elegido exclusivamente en
base a la capacitacion ejecutiva y administrativa, experiencia y capacidad de Ia
persona y, al momento de su designacion, no es necesario que sea residente de
la Ciudad; no obstante, durante el ejercicio de su cargo, el Gerente de Ia
Ciudad debera residir dentro de los 'finites de la Ciudad. El Gerente de la
Ciudad recibira bonos financiados por la Ciudad en un monto que debe ser
determinado por el Concejo Municipal 10,000) do-Iares.
LQ Contratos y adquisiciones:
El Concejo Municipal puede, mediante ordenanza, filar un monto maximo por el
que al Gerente se le autorice a ejecutar contratos y/o gastar fondos para
itemes incluidos en el presupuesto, con /a condicion, no obstante, de que todos
los contratos y los gastos deben cumplir con las Jeyes estatales que exigen
licitaciones competitivas. El Concejo Municipal puede, mediante ordenanza,
establecer un monto sobre el cual todos los contratos o las adquisiciones deben
contar anticipadamente con la aprobacion del Concejo Municipal. Todos los
contratos y las adquisiciones deberan ser abordados de una manera que
garantice el mejor valor para la Ciudad.
(g) Ejecucion de documentos:
El Gerente de la Ciudad tendra la autoridad de ejecutar, en representacion de
la Ciudad, documentos de formato convencional, to que incluye, entre otros,
escrituras, liberaciones de derechos prendarios, acuerdos de alquileres,
servidumbres, acuerdos de derechos de Paso, acuerdos de use compartido y
otros documentos similares, en las siguientes condiciones:
al La ejecucion del documento es necesaria para Ilevar a cabo algae proyecto de
obras pablicas, mantener o mejorar instalaciones de la Ciudad, una calle,
derecho de paso, servidumbre, parque u otra propiedad de la Ciudad, o para
imp/ementar otras politicas de la Ciudad, con la condicion de que dicho
proyecto, programa o politica cuente con /a aprobacion del Concejo Municipal;

all Que se Ilenen correctamente todos los espacios en blanco de los documentos
necesarios y cue estos documentos sean congruentes con los objetivos
aprobados Dor el Concejo Municipal; y
iii Que el formato de dicho documento sea aprobado por el Abogado de la Ciudad.

Enmienda a los Estatutos de Autonomia de la Ciudad de Round Rock, Texas, Seccion
5.01(a), en que se establece que el Concejo Municipal puede establecer Ia fecha de
Ia eleccion general de acuerdo con el Codigo de Elecciones de Texas.
SECCION 5.01 ELECCIONES DE LA CIUDAD
(a) Calendario.
La Eleccion de Ia Ciudad habitual se Ilevara a cabo anualmente de acuerdo con
las disposiciones del Anexo del Cod. de Elec. de Tex., Capitulo 41. El Concejo
Municipal,mediante ordenanza, establecera Ia fecha de la eleccion general. el
Pueden canceiarse las elecciones de candidatos que no tengan contendores de
acuerdo con las disposiciones del Anexo del Cod. de Elec. de Tex., Capitulo 2,
Subcapitulo C. El Concejo Municipal sera responsable de especificar los lugares
para realizar dicha eleccion.
Propuesta No. 4
Enmienda a los Estatutos de Autonomia de la Ciudad de Round Rock, Texas,
Secciones 7.02 y 7.04, en que se establecen los procedimientos sobre declaraciones
juradas de comites de peticionarios y avisos de iniciativas y peticiones de
referendos.
SECCION 7.02
INICIO DE PROCEDIMIENTOS;
COMITE DE PETICIONARIOS, DECLARACION JURADA
Cinco (5) o mas electores calificados de la Ciudad, sin importar quienes sean, pueden
comenzar los procedimientos de una iniciativa o de un referendo presentando ante el
Secretario Municipal una declaracion jurada en que senalen que constituiran el comite de
peticionarios y que seran responsables de hacer circular la peticion y de presentarla en Ia

comite de peticionarios.
En la declaracion jurada tambien se designara a otro miembro como Presidente del
Comite y se indicara el nombre, la direccion y el numero de telecopiador (si to hubiera) del
Presidente del Comite al que deben notificarse todos los avisos que se establecen en el
presente documento. El nombre del Presidente del Comite puede ser modificado mediante
una enmienda a la declaracion jurada firmada al menos por una mayoria de los miembros

un certificado relativo a Ia suficiencia de esta, en que se especifique, si es
insuficiente, los detalles en que lo sea, y debera, inmediatamente despues de
concluida la certificacion, cnviar entregar una copia del certificado a cada
al Presidente
del Comite, como se establece en la Seccion 7.02.

Enmienda a los Estatutos de Autonomia de la Ciudad de Round Rock, Texas, Seccion
7.03(a), en que se cambia el porcentaje de electores que deben firmar una peticion
de iniciativa y referendo de 5% del total de electores calificados de la Ciudad a un
10% del total de electores calificados de la Ciudad.
SECCION 7.03 PETICIONES
(a) Cantidad de firmas.
Las peticiones de iniciativas y referendos deben ser firmadas por electores
calificados de la Ciudad equivalentes a al menos un cinco diez por ciento (S
10%) del numero total de electores calificados de la Ciudad, segun lo

certificado actualmente por el Administrador de Elecciones del Condado, o 250,
Ia cantidad que sea mayor.

SECCION 7.03 PETICIONES

SECCION 7.04

(c) Petition insuficiente, determinacion final.
Si se determina mediante certificado que una peticion es insuficiente y el
comite de peticionarios no opta por cnmcndar ni solicitar que el Concejo
Municipal haga una revision seg in las subsecciones (d) y -(e)- de esta seccion
dentro del plazo exigido, el Secretario Municipal presentara un certificado al
Concejo Municipal en Ia siguiente reunion habitual del Consejo Municipal que
constituira una determinacion final respecto de la insuficiencia de Ia peticion.
(d) Peticion insuficiente, apelacion.
Si se determina mediante certificado que una peticion es insuficiente
en Ia Scccion 7.01(c), el comite puede, dentro de un plazo de dos (2) dias
laborales despues de recibir la copia de dicho certificado, presentar una solicitar
una solicitud de revision por parte del Concejo Municipal. El Concejo Municipal
revisara el certificado en su siguiente reunion habitual, Iuego de Ia presentacion
de dicha solicitud, para aprobarlo o rechazarlo, y la determinacion del Concejo
Municipal sera entonces una determinacion final.

SECCION 8.08 DEPOSITARIO

en el depositario o los depositarios de Ia Ciudad, que seran designados por el Concejo
Municipal de acuerdo con los reglamentos correspondientes y estaran sujetos a requisitos de
seguridad de los depositos e intereses de estos segun se establezca mediante ordenanza.

SECCION 8.10 AUDITORIA INDEPENDIENTE
Al finalizar cada alio fiscal, y en otras ocasiones que se estime conveniente, el Concejo
ordenara la realization de una auditoria independiente de todas las cuentas de Ia Ciudad por
parte de un contador publico certificado. El contador publico certificado seleccionado no
debera tener intereses personales, directos o indirectos, en los asuntos financieros de Ia

SECCION 10.01 DEPARTAMENTO DE TRIBUTACION
Se establecera un Departamento de Tributacion para evaluar y cobrar impuestos, al
mando del cual estara el Director de Finanzas. El Director de Finanzas entregara un bono de
garantia por el desempeno correcto de sus obligaciones, lo que incluye el acatamiento de
todas las disposiciones de control de las leyes estatales relativas a las funciones de dicha
oficina, por un monto que sera fijado por el Concejo Municipal a no menos de cinco mil
dolares ($5,000.00). Sin perjuicio de lo anterior, el Concejo Municipal puede contratar a una
agencia externa o a otra entidad gubernamenta/ para que evalue y cobre los impuestos de la
Ciudad y para que realice las funciones del Tasador/Recaudador de Impuestos de Ia Ciudad.

PROCEDIMIENTOS DISCIPLINARIOS DEL DEPARTAMENTO DE POLICIA
SECCION 13.01 OBJETIVO

El objetivo de este Articulo es establecer procedimientos de apelacion a ciertas
acciones disciplinarias para los oficiales (segim se define a continuacion) del Departamento
de Policia de Round Rock. Este Articulo no rige para el Jefe de la Policia ni para los
empleados del Departamento de Policia que no sean oficiales de policia juramentados ni para
oficiales de policia que esten en periodo de prueba.
SECCION 13.02 DEFINICIONES
(a) Jefe. "Jefe" se refiere al Jefe de Policia del Departamento de Policia de Round
Rock.
[b) Dia. "Dia" se refiere a un dia calendario.
Degradacion. "Degradacion"se refiere a un cambio de la asignacion de deber
de un official desde un puesto con un grado de remuneracion a otro con un
_grado inferior de remuneracion.
fd) Departamento. "Departmento" se refiere al Departamento de Policia de la
Ciudad de Round Rock.
Matriz disciplinaria. "Matriz disciplinaria" se refiere a la matriz disciplinaria
adoptada, mantenida y enmendada de vez en cuando por el Jefe.
ft2 Director de RH. "Director de RH"se refiere al Director de Recursos Humanos de
la Ciudad.
to) Oficial. "Oficial" se refiere a un oficial de policia juramentado empleado por el
Departamento y que ha servido por un ano /uego de concluir satisfactoriamente
el programa de capacitacion en campo del Departamento.
(h2 Oficial a prueba. "Oficial a prueba"se refiere a un oficial de policia juramentado
empleado por el Departamento y que no ha completado el programa de
capacitacion en campo del Departamento o que ha servido por menos de un
ano /uego de concluir satisfactoriamente el programa de capacitacion en cameo
del Departamento.
Suspension. "Suspension" se refiere a una accion disciplinaria en /a que un
oficial es involuntariamente relevado de sus funciones por mas de veinticuatro
horas sin derecho a recibir remuneracion. Suspension, como se emplea en el
presente documento, no se refiere al relevo de funciones por veinticuatro horas
o menos o al relevo de funciones sin perdida de la remuneracion.
Terminacion. "Terminacion" se refiere a una accion disciplinaria mediante la
cual un oficial resulta permanentemente relevado de sus funciones..

SECCION 13.03 APELACIONES AL EXAMINADOR DE AUDIENCIAS
(a2 Aviso de apelacion. Si el Jefe determina imponer una accion disciplinaria que
incluya suspension, degradacion o terminacion, y el Oficial en cuestion no este
satisfecho con esta decision, el Oficial puede optar por apelar a la decision ante
un Examinador de Audiencias. A fin de eiercer el derecho a apelacion, el Oficial
debera presentar ante el Jefe un aviso por escrito de apelacion en los
formularios proporcionados por la Ciudad dentro de un plazo de tres (3) dias
calendarios luego de ser notificado de la decision del Jefe de imponer
suspension, degradacion o terminacion. El aviso por escrito de apelacion no
sera valido a menos que el Oficial acceda a renunciar a todos los derechos que
el Oficial pudiera tener de apelar a la decision del Jefe ante un tribunal de
justicia.
Seleccion del Examinador de Audiencias. Lueqo de recibir el aviso por escrito de
apelacion, el Jefe debera notificar al Director de RH. El Director de RH y el
Oficial intentaran ponerse de acuerdo en la seleccion de un Examinador de
Audiencias en un plazo maximo de 10 dias despues de la fecha en que se
presente el aviso de apelacion. Si no se alcanza un acuerdo dentro del plazo
especificado, el Director de RH solicitara un listado de siete arbitros neutrales
calificados a la Asociacion Estadounidense de Arbitraje o al Servicio Federal de
Mediacion y Conciliacion o a sus sucesores en funciones. El Oficial y el Director
de RH pueden ponerse de acuerdo respecto de uno de los siete arbitros del
listado. Si no estuvieran de acuerdo dentro de un plazo de 25 dias despues de
la fecha de presentacion del aviso de apelacion, el Oficial y el Director de RH
deberan, el dia 25 despues de presentada la apelacion, tachar del listado en
forma alternada el nombre de un arbitro y la persona cuyo nombre no se tache
sera el Examinador de Audiencias. En caso de que el dia 25 sea sabado,
domingo o feriado legal, las partes tacharan los nombres del listado el siguiente
dia laboral. Las partes acordaran una fecha para la audiencia que este dentro
del plazo indicado a continuacion en el parrafo (d).
Jurisdiccion y autoridad del Examinador de Audiencias. El Examinador de
Audiencias tiene jurisdiccion para revisar apelaciones a una decision del Jefe de
suspender, degradar o terminar a un Oficial. Luego de considerar los
testimonios, las pruebas, los argumentos y los escritos, el Examinador de
Audiencias puede confirmar, modificar o revertir la decision del Jefe. Si el
Examinador de Audiencias determina modificar la decision, la autoridad del
Examinador de Audiencias para hacer modificaciones se limita al nivel de
disciplina indicado en la Matriz Disciplinaria.
Audiencia de apelacion. La audiencia de apelacion comenzara to antes posible,
pero en todo caso dentro de un plazo de 60 dias despues de la fecha de
presentacion de la apelacion. Si la audiencia no ha comenzado dentro de un
plazo de 60 dias despues de la fecha de presentacion de /a apelacion, se
confirma /a suspension, degradacion o terminacion y /a apelacion es retirada si
el Oficial no este listo para proceder y se da lugar a la apelacion si el Jefe no
este listo para proceder. Al calcular el periodo de 60 dias, debera considerarse

un periodo de retraso no superior a 30 dias calendarios debido a un
aplazamiento otorgado a solicitud del Jefe o del Oficial por motivos justificab/es
presentados o debido a la indisposicion inevitable del Examinador de Audiencias
en la fecha de la audiencia. En ninguna circunstancia puede el Examinador de
Audiencias otorgar un aplazamiento de mas de 30 dias en una audiencia que
entrane terminacion. Un Examinador de Audiencias puede otorgar un
aplazamiento superior al periodo de 30 dias si se presentan motivos
justificables en una audiencia que entrane suspension o degradacion a menos
que el Oficial tenga otra accion disciplinaria pendiente.
Col Citaciones. El Examinador de Audiencias tendra la autoridad para emitir
citaciones.
Procedimiento agilizado. Las partes pueden acordar realizar un procedimiento
de audiencia agilizado. A menos que las partes acuerden algo distinto, en un
procedimiento agilizado el Examinador de Audiencias tomara una decision
sobre la apelacion dentro de un plazo de 10 dias despues de la fecha de
finalizacion de la audiencia.
Procedimiento no agilizado. En una apelacion que no entrane un procedimiento
de audiencia agilizado, el Examinador de Audiencias hara lo razonablemente
posible por entreqar una decision sobre la apelacion dentro de un plazo de 30
dias despues de la fecha en que culmine la audiencia o se presenten los
escritos. La incapacidad del Examinador de Audiencias de cumplir con los
requisitos de plazos impuestos por este parrafo no incide en la jurisdiccion del
Examinador de Audiencia, en /a validez de /a accion disciplinaria ni en la
decision final del Examinador de Audiencias.
(q) Decision final. La decision final del Examinador de Audiencias es definitiva y
vinculante para todas las partes. Ninquna de las partes tendra derecho a apelar
una decision del Examinador de Audiencias, excepto en /o establecido en el
parrafo U a continuacion.
022 Honorarios y gastos. Los honorarios y gastos del Examinador de Audiencias
seran compartidos en partes iguales por el Oficial y la Ciudad. Los costos de los
testigos son pagados por la parte que los llama.
al Ape/acion ante una corte de distrito. Una corte de distrito puede revisar una
apelacion de una decision del Examinador de Audiencias solo con el argumento
de que el Examinador de Audiencias no tenia jurisdiccion en el asunto o se
excedio en su jurisdiccion o que la orden se procuro mediante fraude,
confabulacion u otros medios ilegales. Si el argumento de la apelacion de la
decision del Examinador de Audiencias se basa en que el Examinador de
Audiencias no tenia jurisdiccion sobre el asunto o que se excedio en su
jurisdiccion, la peticion debe presentarse en /a corte de distrito dentro de un
p/azo de 10 dias a partir de /a decision del Examinador de Audiencias. Las
ape/aciones deben presentarse en una corte de distrito del Condado de
Williamson, Texas.

Councilmember, Place 2 and Councilmember, Place 6 and submitting to the voters
certain proposed amendments to the Home Rule Charter of the City.

This ordinance calls the joint City of Round Rock and Round Rock
Independent School District Election. This election is to elect Council Place 2
and Council place 6 and to submit to the voters 13 propositions that will
amend the City Charter. A joint election allows the voter to register only
once at the polling place instead of twice, thus simplifying the voting
process and reducing the cost of the election.

Background Information: At the request of the School District, two Election Day precinct
locations have been added. Those are Caldwell Heights
Elementary and Forest Creek Elementary. This change created

outlined in the attachment.
