WHEREAS, Chapter 791 of the Texas Government Code, V.T.C.A., authorizes local
governments and agencies of the state to enter into agreements with one another to perform
governmental functions and services, and
WHEREAS, the City of Round Rock wishes to enter into an Interlocal Contract with Region
III Education Service Center for participation in Purchasing Cooperative of America cooperative
purchasing program, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on behalf of the City an Interlocal
Contract with Region III Education Service Center, a copy of same being attached hereto as Exhibit
"A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

Interlocal Contract
Pursuant to Texas Government Code, Chapter 791, Interlocal Cooperation Act, and Texas Local Government
Code, Chapter 271, Subchapter F. Cooperative Purchasing Program, this Interlocal Contract (ILC) is made and
entered into between Region III Education Service Center, 1905 Leary Lane, Victoria, Texas 77901,

Region ill Education Service Center will:

o Provide up to date information concerning contracting opportunities with PCA vendors.
Participating Agency, as a member of Purchasing Cooperative of America, will:
e Designate a contact person and update the contact information as necessary.
o Provide an authorized signature on the ILC.
Work with vendors according to the PCA contract.
issue Purchase Orders stating "Purchasing Cooperative of America" and the Contract Number.
This contract is effective the date of the final signature and will remain in effect until and unless one (1) of the
parties terminates the agreement in writing with thirty (30) days' notice. Send the signed Interlocal Contract

Members@acamerica.org. An email copy of an executed signature shall have the same force and effect as an

a Texas state agency. The "State Agency" connection is vitally important when members
are spending federal funds. Where federal dollars are spent or commingled, the purchasing
cooperative used "...must be administered by a State agency with the [cooperative]
contracts awarded and held by that agency". Region III ESC awards and holds PCA
contracts and administers the PCA cooperative purchasing program.
MEMBERSHIP IS FREE and you will work directly with vendors who have been
awarded PCA contracts by Region III ESC through a rigorous solicitation response and
evaluation process, according to Texas purchasing and cooperative statutes.
