G-03-08-14-13A1 - 8/14/2003ORDINANCE NO. g - 03-08-14/-6191 AN ORDINANCE AMENDING THE CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, CHAPTER 1, SECTION 1.802 TO ADOPT EXTENDED HOURS FOR THE SALE OF MIXED BEVERAGES AND BEER; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 1, Section 1.802, Code of Ordinances (1995 Edition), City of Round Rock is hereby amended by numbering the existing subsection "(1)" and adding two new subsections, which said section shall read as follows: 1.802 SELLING OF ALCOHOLIC BEVERAGES RESTRICTED TO CERTAIN HOURS (1) Any person, firm, or corporation authorized to offer for sale alcoholic beverages within the city limits of Round Rock will do so only during the hours authorized under the Alcoholic Beverage Code. (2) Pursuant to § 105.03 of the Alcoholic Beverage Code, extended hours for the sale of mixed beverages are adopted, so that the holder of a mixed beverages late hours permit may sell and offer for sale mixed beverages between midnight and 2 a.m. on any day. (3) Pursuant to § 105.05 of the Alcoholic Beverage Code, extended hours for the sale of beer are adopted, so that the holder of a retail dealer's on -premise late hours license may sell, offer for sale, and deliver beer between midnight and 2 a.m. on any day. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. ordinance thereof. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with.
