G-03-06-12-9C3 - 6/12/2003ORDINANCE NO. 4- C3 QCO'% rC 93 AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS CHANGING THE SPEED ZONE ON A PORTION OF A.W. GRIMES BOULEVARD; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation, and WHEREAS, an engineering and traffic investigation was conducted on A.W. Grimes Boulevard from Gattis School Road to Louis Henna Boulevard on the 13th day of February 2003, and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes as Exhibit "A", and WHEREAS, the results of said engineering and traffic investigation indicate that the speed limit on A.W. Grimes Boulevard from Gattis School Road to Louis Henna Boulevard should be 45 miles per hour, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: @PFDesktop\: : ODMA/WORLDOX/O:/WDOX/ORDINANC/030522E5.WPD/sc I. That Chapter 9, Section 9.502(8), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding the following: (7) The maximum prima facie speed limit shall be forty-five (45) miles per hour along the following streets: ON A.W. Grimes north and southbound FROM TO Gattis School Road Louis Henna Boulevard II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. (Second Reading) Resource: Tom Word, Chief of Public Works Operations Bili Stablein, Transportation Engineering Assoc. History: A speed study was conducted on A.W. Grimes Boulevard in February 2003. Based on the information gathered, the recommendation is to establish a 45 -mph speed limit from Gattis School Road to Louis Henna Boulevard. Funding: Cost: $70 Source of funds: Operating Signs and Markers Outside Resources: N/A Impact/Benefit: Establishment of a 45 -mph speed limit will promote a safer environment for traffic using A.W.
