G-03-06-22-10E2 - 6/22/2003ORDINANCE NO. l7 -03 `05 o(a -OE OJ AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.503, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, DESIGNATING A PORTION OF HARVEY PENICK DRIVE AS A SCHOOL SPEED ZONE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the State of Texas; and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation; and WHEREAS, an engineering and traffic investigation was conducted on Harvey Penick Drive from Forest Creek Drive to Norman Loop/Lord Byron Circle on the 9th day of April, 2003; and WHEREAS, a copy of said engineering and traffic study is attached hereto as Exhibit "A" and incorporated herein for all purposes; and WHEREAS, the results of said engineering and traffic investigation indicate that a 20 miles per hour school speed zone should be established on Harvey Penick Drive from Forest Creek Drive to Norman Loop/Lord Byron Circle, between the hours 7:00 a.m 0:\wdox\ORDINANC\03CS08C3.WPD/sc and 8:00 a.m. and between the hours of 2:30 p.m. and 4:30 p.m. on school days only; Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.503, of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended as follows: (9) When a sign is posted with the hours of operation, giving notice thereof, the maximum speed limit shall be twenty (20) miles per hour between the hours of 7:00 a.m. and 8:00 a.m.; and between the hours of 2:30 p.m. and 4:30 p.m. on school days only, upon those streets or portions of streets as follows: ON FROM TO Harvey Penick Drive Forest Creek Drive Norman Loop/Lord Byron Circle II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, 2 considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 9, Section 9.503 of the Round Rock Code of Ordinances (1995 Edition) amending the school speed zone on Harvey Penick Drive. (Second Reading) Resource: Tom Word, Chief of P.W. Operations Bill Stablein, Transportation Construction Coordinator History: The existing school speed zone on Harvey Penick Dirve was established along the Forest Creek Elementary street frontage several years ago. At the time, Harvey Penick Drive extended only one block beyond the school, and very few houses existed. Since the adoption of the initial school speed zone, Harvey Penick Drive has been extended several times, and many houses are now completed along this street. The increase in school pedestrian activity, and the increase in traffic along this street warrants the extension at the school speed zone to the intersection with Norman Loop/Lord Byron Circle. Funding: Cost: $210 Source of funds: Operating Signs and Markers Outside Resources: N/A Impact:/Benefit: The extension of the school speed zone will promote a safer environment for pedestrian accessing Forest Creek Elementary.
