(3 - Q - 1 I /14- c261 AN ORDINANCE AMENDING CHAPTER 4, SECTION 4.309, CODE OF ORDINANCES OF THE CITY OF ROUND ROCK, TEXAS TO CHANGE THE MAXIMUM FEES CHARGED BY WRECKER PERMIT HOLDERS FOR HAULS; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, a Texas home -rule municipality may adopt ordinances that are for the good government, peace, or order of the municipality; and WHEREAS, the City of Round Rock, Texas has previously enacted provisions in its Code of Ordinances relating to wrecker services; Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, I. That Chapter 4, Section 4.309 (5) of the Code of Ordinances, City of Round Rock, Texas, is hereby amended to read as follows: 4.309 PROCEDURES FOR NOTIFYING WRECKER SERVICES (5) The following maximum fees may be charged by permit holders under this section for the use of the class of wrecker designated. No additional charges may be made. These maximum fees shall also apply to hauls when the request is made through the police communications center to have a vehicle towed from the scene of a collision. Collision haul $95.00 Impound haul $95.00 Fee for use of flatbed wrecker $130.00 *Extra -large wreckers $393.00 Dollies $35.00 Winching $35.00/hr. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. (Second Reading) Resource: Paul Conner, Chief of Police Captain Tim Ryle History: Section 4.309 of the City Code of Ordinances provides a schedule of maximum fees that vehicle wrecker services that are permitted to operate within the city limits may charge. These maximum fees also apply when a request is made through the police communications center to have a vehicle towed from the scene of a collision. The Department reviewed the fees for three neighboring municipalities and Williamson and Travis counties prior to making this proposal.
