G-02-09-26-10C1 - 9/26/2002ORDINANCE NO. 6- AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS CHANGING THE SPEED ZONE ON A PORTION OF THE SH -45 FRONTAGE ROAD; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation, and WHEREAS, an engineering and traffic investigation was conducted on the SH -45 Frontage Road from Station No. 40644+22.88 to Donnell Drive on the 22nd day of July, 2002, and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein, and WHEREAS, the results of said engineering and traffic investigation indicate that the speed limit on the SH -45 Frontage Road from Station No. 40644+22.88 to Donnell Drive should be 55 miles per hour, Now Therefore ::ODMA\WORLDOX\O:\WDOX\ORDINANC\020912C1.WPD/sc BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.502(9), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding the following: (9) The maximum prima facie speed limit shall be fifty-five (55) miles per hour along the following streets: ON FROM TO SH -Frontage Road Station No. 40644+22.88 Donnell Drive II. That Chapter 9, Section 9.502 (7) , of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by deleting the following: (7) The maximum prima facie speed limit shall be fifty-five (55) miles per hour along the following streets: ON Louis Henna Boulevard east and westbound FROM IH 35 East Frontage Road TO a point 1610' east of Doublee Creek Drive III. That Chapter 9, Section 9.502(9), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by deleting the following: 2. (9) The maximum prima facie speed limit shall be fifty-five (55) miles per hour along the following streets: ON Louis Henna Boulevard north and southbound Louis Henna Boulevard north and southbound FROM 200' east of Greenlawn Boulevard City Limits (east of Meister Lane) IV. TO City Limits (west of Meister Lane) City Limits (at MKT Railroad right of way) A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 9, Section 9.502, Round Rock Code of Ordinances (1995 Edition) establishing a 55 -mph speed zone on a portion of the SH 45 frontage road. (Second Reading) Resource: Jim Nuse, Chief of Operations/Assistant City Manager Tom Word, Director of Transportation Services History: The Texas Department of Transportation conducted speed studies on SH 45/Louis Henna Boulevard during June of 2002. Based on the information gathered, TxDOT recommended the establishment of 45 -mph speed limits to 1,272.88 feet East of CR 170. The City has conducted a traffic engineering study on the remainder of Louis Henna Boulevard to the East and has identified that the existing 55 -mph speed limit is still appropriate. We are recommending approval of this ordinance to eliminate overlapping limits of the speed zone created by the construction of SH 45. Staff recommends approval.
