G-02-08-22-12A1 - 8/22/2002ORDINANCE NO. e - AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.503, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS DESIGNATING A PORTION OF GULF WAY DRIVE AS A SCHOOL SPEED ZONE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the State of Texas; and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation; and WHEREAS, an engineering and traffic investigation was conducted on Gulf Way Drive from Settlement Drive to 1,275 feet East of Sandy Brook Drive on the 22nd day of July 2002; and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes; and WHEREAS, the results of said engineering and traffic investigation indicate that a 20 miles per hour school speed zone should be established on Gulf Way Drive from Settlement Drive to 1,275 feet East of Sandy Brook Drive, between the hours of 7:00 a.m. and 8:45 a.m. and between the hours of 2:30 p.m. and 4:30 p.m. on school days only; Now Therefore ::ODMA\WORLDOX\O:\WDOX\ORDINANC\020808D1.WPD/sC BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.503, of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding a new section (12) which shall read as follows: (12) When a sign is posted with the hours of operation, giving notice thereof, the maximum speed limit shall be twenty (20) miles per hour between the hours of 7:00 a.m. and 8:45 a.m. and between the hours of 2:30 p.m. and 4:30 p.m. on school days only, upon those streets or portions of streets as follows: ON FROM TO Gulf Way Drive Settlement Drive 1,275 feet East of Sandy Brook Drive II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, 2. considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 9, Section 9.503, Code of Ordinances (1995 Edition) by designating a portion of Gulf Way Drive as a school speed zone. (Second Reading) Resource: Jim Nuse, Chief of Operations/Asst. City Manager Tom Word, Director of Transportation Services History: Union Hill Elementary School and the newly located Hopewell Middle School will be opening on Gulf Way Drive for the school year 2002. School zones will need to be implemented and in place prior to their opening day.
