G-02-08-08-10A1 - 8/8/2002ORDINANCE NO. j " p'? - OQ - 01- /OR I AN ORDINANCE AMENDING CHAPTER 1, SECTION 1.2700, CODE OF ORDINANCES OF THE CITY OF ROUND ROCK, TEXAS TO MAKE THE DAYTIME CURFEW PERIOD FOR THE TIME PERIOD MINORS SHOULD BE IN SCHOOL PERMANENT; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, a Texas home -rule municipality may adopt ordinances that are for the good government, peace, or order of the municipality; and WHEREAS, the City of Round Rock, Texas has previously enacted provisions in its Code of Ordinances relating to juvenile curfew hours; and WHEREAS, after conducting the required review of the juvenile curfew ordinance in 2001, the City of Round Rock adopted a daytime curfew to include the time period minors are required to be in school. The daytime curfew was given an expiration time and date of 12:01 a.m. on August 1, 2002; and WHEREAS, after conducting a review of the daytime curfew provisions to determine its effects on the community and on the problems the ordinance was intended to remedy, the daytime curfew hours should be continued beyond August 1, 2002; Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ::ODMA\WORLDOX\O:\WDOX\ORDINANC\020725B1.WPD/scl I. That Chapter 1, Section 1.2701(1) of the Code of Ordinances, City of Round Rock, Texas, is hereby amended to read as follows: SECTION 1.2700 YOUTH CURFEW 1.2701 DEFINITIONS (1) Curfew Hours mean; (a) 12:01 a.m. until 6:00 a.m. on any Monday, Tuesday, Wednesday, Thursday or Friday; (b) 1:00 a.m. until 6:00 a.m. on any Saturday or Sunday; and (c) 9:00 a.m. until 2:30 p.m. on Monday, Tuesday, Wednesday, Thursday or Friday. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. 2 READ and APPROVED on first reading this the 0' day of , 2002. Consider an ordinance amending Chapter 1, Section 1.2700 of the Round Rock Code of Ordinances making the daytime curfew period permanent. (Second Reading) Resource: Paul Conner, Chief of Police Tim Ryle, Captain History: In July 2001, the Department brought to the City Council a proposed ordinance change to establish a daytime curfew to address the problem of children not being in school during school hours. This ordinance was approved as a one-year trial, after which the Department was to present to Council the results of the one-year trial. That presentation was made at the July 11, 2002, City Council meeting. The proposed ordinance makes permanent the daytime curfew for school -aged youths. The first reading of the ordinance was approved at the July 25, 2002 City Council meeting. Funding: Cost: N/A Source: N/A Outside Resources: None Impact/Benefit: Adopting this change in ordinance will allow the Police Department to continue using daytime curfews as a tool to address the problems of youths not being in school during school hours.
