G-02-07-25-13A1 - 7/25/2002ORDINANCE NO. 1 - Od.- 07 c25— 13191 AN ORDINANCE AMENDING CHAPTER 10, SECTION 10.204, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, BY AMENDING THE WATER AND WASTEWATER IMPACT FEES, AND ADOPTING NEW LAND USE ASSUMPTIONS AND CAPITAL IMPROVEMENT PLAN; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Sec. 395.052, Tex. Local Gov't Code, requires a municipality imposing impact fees to review and evaluate its current land use assumptions and capital improvements plan at least every three (3) years (dating from the day the initial capital improvements plan is adopted); and WHEREAS, the last time such land use assumptions and capital improvements plan were review, evaluated and updated was three (3) years ago; and WHEREAS, the City Council has reviewed, evaluated, and now wishes to adopt updated land use assumptions and a capital improvements plan in order to comply with said Texas Local Government Code requirements for same; Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. That Chapter 10, Section 10.204(3), Code of Ordinances (1995 Edition), City of Round Rock is hereby amended to read as follows: ::ODMA\WORLDOX\O:\WDOX\ORDINANC\020711B2.WPD/s1s (3) Amount and Assessment of Water Impact Fee Beginning on August 1, 2002, the city shall assess and collect on all new development and/or new connections to be served by the city's water system a Water Impact Fee of $2,910.00 for each LUE. (4) Amount and Assessment of Wastewater Impact Fee Beginning on August 1, 2002, the city shall assess and collect on all new development and/or new connections to be served by the city's wastewater collection and treatment system a Wastewater Impact Fee of $1,059.00 for each LUE. II. That Chapter 10, Section 10.204(9), Code of Ordinances (1995 Edition), City of Round Rock is hereby amended to read as follows: (9) Updated Capital Improvement Plan and Land Use Assumptions Pursuant to Section 395.052, Texas Local Government Code, the City must adopt new Land Use Assumptions and Capital Improvement Plans at least every three (3) years from the day the initial Impact Fee Capital Improvement Plan was adopted. The Land Use Assumptions and Capital Improvement Plan dated May 31, 2002, on record in the office of the City Secretary is hereby adopted and incorporated by reference. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which 2 this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. MARTINEZ, City Secretar 3 LAND USE ASSUMPTIONS, CAPITAL IMPROVEMENTS PLAN REVISED IMPACT FEES THE CITY IS REQUIRED TO REVIEW THE LAND USE ASSUMPTIONS AND CAPITAL IMPROVEMENTS PLAN, WHICH FORM THE BASIS FOR THE ADOPTION OF IMPACT FEES. THIS REVIEW WAS PREPARED TO INCLUDE RECENT MAJOR PROJECTS REQUIRED TO ACCOMMODATE PROJECTED GROWTH. GROWTH SINCE THE LAST REVIEW EQUATES TO 4,750 RESIDENTIAL LUE's and 1,890 COMMERCIAL & INDUSTRIAL LUE's. IN ADDITION 2,171 WATER LUE's HAVE BEEN ADDED TO THE BRUSHY CREEK and FERN BLUF MUD's. THE CITY OF ROUND ROCK GENERAL PLAN 2000 PROJECTS THE FOLLOWING LAND USE DISTRIBUTION: COMMERCIAL/INDUSTRIAL 13.1% 5,507 ACRES RESIDENTIAL 64.8% 27,238 ACRES OPEN SPACE 09.3% 3,889 ACRES MIXED USE PUD 01.0% 407 ACRES BUSINESS PARK 03.5% 1,473 ACRES THE CURRENT CITY & ETJ POPULATION IS 80,515. THE 10 -YEAR PROJECTED INCREASE IN POPULATION UTILIZING CITY WATER IS 41,807. WATER CAPITAL IMPROVEMENTS REQUIRED TO SERVE THE PROJECTED GROWTH INCLUDE 13 PROJECTS WITH A COST OF $4,982.00 PER LUE PLUS $838.00 PER LUE FOR THE RAW WATER LINE PROJECT FROM STILLHOUSE HOLLOW, FOR A TOTAL COST OF $5,820.00 PER LUE. THE 10 -YEAR PROJECTED INCREASE IN POPULATION UTILIZING CITY WASTEWATER IS 55,135. WASTEWATER CAPITAL IMPROVEMENTS REQUIRED TO SERVE THE PROJECTED GROWTH INCLUDE 4 MAJOR INTERCEPTORS WITH A COST OF $403.00 PER LUE and EXPANSION OF THE TREATMENT PLANT WITH A COST OF $1,715.00 PER LUE, FOR A TOTAL OF $2,118.00 PER LUE. RECENT AMENDMENTS TO LEGISLATION LIMIT IMPACT FEES TO 50% OF THE AMOUNT DOCUMENTED IN THE STUDY. Consider an ordinance amending Chapter 10, Section 10.204 of the Round Rock Code of Ordinances to adopt the Land Use Assumptions, Capital Improvements Plan, and water and wastewater impact fees. (Second Reading) Resource: Joe Vining, Planning Director Jim Nuse, Chief of Operations/Assistant City Manager History: On June 5, 2002, the Capital Improvement Advisory Committee reviewed and recommended approval of the updated land use assumptions, capital improvements plan and proposed impact fees as presented by S.D. Kallman, L.P. Capital improvements to the water system to serve the projected growth have a projected cost of $ 5,820.00 per LUE. Capital improvements to the wastewater system to serve the projected growth have a projected cost of $ 2,118.00 per LUE. Section 395 of the Texas Local Government Code only permits recovery of fifty percent of this cost through impact fees. The report supports the following impact fees. Water $ 2,910.00 per LUE Wastewater $ 1,059.00 per LUE Total $ 3,969.00 per LUE Section 395.053 of the Texas Local Government Code requires that the Council receive this report as the first step of updating impact fees. Funding Cost: N/A Source of Funds: N/A Outside Resources: S. D. Kallman, L.P. Impact: The updated water and wastewater impact fees will permit recovery of fifty percent of the cost of Capital improvements to the water and wastewater systems necessary to accommodate projected growth. Benefit: New fees will reflect updated costs. Public Comment: Public Notice and a Public Hearing were held in accordance with the Section 395.055 of the Texas Local Government Code.
