G OD&2-8/?L/ AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.503, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS DESIGNATING A PORTION OF FM 3406 AS A SCHOOL SPEED ZONE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the State of Texas; and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation; and WHEREAS, an engineering and traffic investigation was conducted on FM 3406 from the IH -35 West Frontage Road to CR 175 (Sam Bass Road) on the 3rd day of April 2001; and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes; and WHEREAS, the results of said engineering and traffic investigation indicate that a 35 miles per hour school speed zone should be established on FM 3406 from the IH -35 West Frontage Road to CR 175 (Sam Bass Road), when a sign is posted with a flashing light giving notice thereof; Now Therefore ::ODMA\WORLDOX\O:\WDOX\ORDINANC\020314B4.WPD/SC BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.503(2), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by designating a portion of FM 3406 from the IH -35 West Frontage Road to CR 175 (Sam Bass Road), as a school zone when a sign is posted with a flashing light giving notice thereof, which shall read as follows: (2) When a sign is posted with a flashing light giving notice thereof, the maximum speed limit shall be thirty-five (35) miles per hour when flashing, upon those streets or portions of streets as follows: ON FROM TO FM 3406 I11-35 West Frontage Road CR 175 (Sam Bass Road) II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which 2. this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Stluka Mayor, City of Round Rock 221 East Main Street Round Rock, Texas 78691 Dear Mayor Stluka: Our Transportation Operations office has completed speed studies on FM 3406 within the city of Round Rock and have determined that some adjustment within the existing speed zone is currently warranted and also the addition of a reduced school speed zone with flashing beacons for the Old Town Elementary School. Attached for your review is a print of the proposed speed zone strip map for this section of roadway which shows the results of these studies as well as our recommendations. Also attached is a copy of a proposed Ordinance which will regulate these speeds within the city of Round Rock. When the City Council has passed this Ordinance, please forward one signed copy to this office for our files and so we can proceed with the necessary signing changes. Assistant Director of Transportation Operations An Equal Opportunity Employer AN ORDINANCE OF THE CITY OF ROUND ROCK, TEXAS, ZONING FOR TRAFFIC AND RATE OF SPEED THEREIN, ON FM 3406 IN THE CITY LIMITS OF THE CITY OF ROUND ROCK; DEFINING SPEEDING AND FIXING A PENALTY THEREFORE; DECLARING WHAT MAY BE A SUFFICIENT COMPLAINT IN PROSECUTIONS HEREUNDER; WITH A SAVING CLAUSE REPEALING CONFLICTING LAWS AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY OF ROUND ROCK: Section 1 It is hereby determined upon the basis of an Engineering and Traffic investigation that the prima facie maximum speed limit on those portions of FM 3406 routed in the city of Round Rock, is hereby stated, which prima facie maximum speed limit shall be effective at all times and signs will be erected giving notice of the prima facie maximum speed limit so declared twit. Speed Zone FOR WESTBOUND TRAFFIC Beginning at the west frontage road of IH 35 at milepoint 7.092 to the west city limit of Round Rock at milepoint 5.139, a distance of 1.953 miles, a prima facie maximum speed limit of 50 miles per hour. School Speed Zone Beginning at milepoint 6.614 to milepoint 6.158, a distance of 0.456 miles, a prima facie maximum speed limit of 35 MPH when flashing, 50 MPH at all other times. FOR EASTBOUND TRAFFIC Beginning at the west city limit of Round Rock at milepoint 5.139 to the west frontage road of IH 35 at milepoint 7.092, a distance of 1.953 miles, a prima facie maximum speed limit of 50 miles per hour. School Speed Zone Beginning at milepoint 6.158 to milepoint 6.614, a distance of 0.456 miles, a prima facie maximum speed limit of 35 MPH when flashing, 50 MPH at all other times. SECTION II That all of the streets of this city, and all portions of any such streets, are hereby declared to be public streets and that the driving or operating of any motor vehicle on or along any portion of any street of this city at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixed by this ordinance shall be guilty of a misdemeanor, which is named " The Offense of Speeding " and that the said offense is punishable by a fine in any sum not to exceed Two Hundred dollars ($200.00). That the use of the word " Speeding " shall be sufficient to designate the said offense, and shall mean that a motor vehicle has been driven upon a public street at a greater rate of speed than fixed by City Ordinance for the street and for the zone thereof, that such motor vehicle was so being driven upon, if zoned. That in prosecutions under this ordinance, for the offense of speeding, the complaint, if in other respects sufficient in form, shall as to the portion thereof seeking to acknowledge the offense, be sufficient if it in substance alleges that the defendant did while driving a motor vehicle in said city commit the offense of " Speeding ". SECTION III That should any section or any portion of any section hereof be decreed to be void, the invalidity of such section or such portion thereof shall not affect the validity of the remaining portions of this ordinance; and that each section and each portion thereof not decreed to be invalid shall remain valid and enforceable. That all ordinances and parts of ordinances that are in conflict with this ordinance are hereby repealed. That the fact that prompt action should be taken in the regulation of traffic, on the streets of this city, in the manner provided for in this ordinance creates an emergency requiring that the rules that provide that an ordinance shall be read at three separate meetings of the city council before final passage, be suspended; and that the said rules are hereby suspended, and this ordinance is here and now passed, and that it is ordered that it take effect from and after its passage and publication. Consider an ordinance amending Chapter 9, Section 9.503, Code of Ordinances (1995 Edition) designating a portion of FM 3406 as a school speed zone with flashing beacons for Old Town Elementary School. (Second Reading) Resource: Jim Nuse, Public Works Director Tom Word, Chief Transportation Engineer History: The Texas Department of Transportation conducted speed studies on FM 3406 during 2001. Based on the information gathered, is adding a reduced school speed zone of 35 -mph (when flashing). Since this portion of the road falls within the ETJ of the City of Round Rock, these ordinances will need to be passed before any sign changes can be made by TxDOT. Staff recommends approval.
