G-02-03-26-8A3 - 3/26/2002ORDINANCE NO4-0-03-026-8R3 AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS CHANGING THE SPEED ZONE ON A PORTION OF FM 3406; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation, and WHEREAS, an engineering and traffic investigation was conducted on FM 3406 from the IH -35 West Frontage Road to CR 175 (Sam Bass Road) on the 3rd day of April 2001, and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes as Exhibit "A", and WHEREAS, the results of said engineering and traffic investigation indicate that the speed limit on FM 3406 from the IH - 35 West Frontage Road to CR 175 (Sam Bass Road) should be 50 miles per hour, Now Therefore ::ODMA\WORLDOX\O:\WDOX\ORDINANC\020314B3.WPD/5C BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.502(8), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding the following: (8) The maximum prima facie speed limit shall be fifty (50) miles per hour along the following streets: ON FROM TO FM 3406 I11-35 West Frontage Road CR 175 (Sam Bass Road) east and westbound II. Consider an ordinance amending Chapter 9, Section 9.502, Code of Ordinances (1995 Edition) changing the speed zone on a portion of FM 3406 from the west frontage road of IH -35 to CR 175 (Sam Bass Road). (Second Reading) Resource: Jim Nuse, Public Works Director Tom Word, Chief Transportation Engineer History: The Texas Department of Transportation conducted speed studies on FM 3406 during 2001. Based on the information gathered, TxDOT is lowering the existing 55 -mph speed limit to 50 -mph. Since this portion of the road falls within the ETJ of the City of Round Rock, these ordinances will need to be passed before any sign changes can be made by TxDOT. Staff recommends approval. Funding: Cost: $0 Source of funds: N/A Outside Resources: Texas Department of Transportation Impact/Benefit: A reduction of the speed limit to 50 -mph will promote a safer environment for traffic entering FM 3406 from side streets and for traffic entering and exiting Old Town Elementary.
