AN ORDINANCE AMENDING CHAPTER 10, SECTION 10.201 AND
SECTION 10.202, CODE OF ORDINANCES (1995 EDITION), CITY OF
ROUND ROCK, TEXAS, REGARDING WATER AND SEWER RATES
FOR USERS LOCATED OUTSIDE THE CITY LIMITS; PROVIDING
FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
ORDINANCES OR RESOLUTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, THAT:
I.
Section 10.201 (5) (b) , Code of Ordinances, 1995 Edition, City
of Round Rock, Texas, is hereby amended to read as follows:
(b) Outside City Limits
The above water rates and service charges apply to all users located within the corporate
limits of the city. All users located outside of the corporate limits of the city shall pay
double the applicable rates charged users within the corporate limits of the city, unless a
different rate is approved by the Council pursuant to a contractual agreement.
II.
Section 10.202(1) (b), Code of Ordinances, 1995 Edition, City
of Round Rock, Texas, is hereby amended to read as follows:
(b) Outside City Limits
The above sewer rates and service charges apply to all users located within the corporate
limits of the city. All users located outside of the corporate limits of the city shall pay
double the applicable rates charged users within the corporate limits of the city, unless a
different rate is approved by the Council pursuant to a contractual agreement.
III.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.

B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.

SUBJECT: City Council Meeting — March 14, 2002
ITEM: 12.A.1. Consider an ordinance amending Sections 10.201 and 10.202 of the
Round Rock Code of Ordinances regarding water and sewer rates
for users located outside of the city limits. (Second Reading)

History: During the mid -1980's both Steve Sheets and Bob Bennett had left the City to
pursue other avenues. At that time the City made a deal with Palm Valley
Lutheran Church that involved parkland and City water. The Church helped the
City with obtaining Old Settlers Park and the Church claims that the City agreed
to sell water to the Church at the in -city rate. There are notes that suggest
otherwise, but we are relying on what the Church has to say and what former
Mayor Larry Tonn remembers. Currently, the Church wants to expand, remain
outside the City and pay the in -city water rate. The Church is willing to be
annexed in January 2003. In order to accommodate the Church the City must
change the current ordinance thus allowing the Council to charge an in -city rate
for an out -of -city customer.
The first reading of the ordinance was approved on February 28, 2002.
