G-02-01-24-8C3 - 1/24/2002 (2)ORDINANCE NO. 6' "' Da -o /_a L% - 8c 3 AN ORDINANCE OF THE CITY OF ROUND ROCK, TEXAS, ADOPTING THE 2000 EDITIONS OF THE INTERNATIONAL MECHANICAL CODE, INTERNATIONAL FUEL GAS CODE, INTERNATIONAL PLUMBING CODE, INTERNATIONAL ENERGY AND CONSERVATION CODE, AND INTERNATIONAL FIRE CODE ESTABLISHING MINIMUM STANDARDS AND REGULATIONS IN THE CITY OF ROUND ROCK, TEXAS; PROVIDING FOR THE ISSUANCE OF PERMITS, PENALTIES AND COLLECTION OF FEES; AMENDING SECTIONS 3.500, 3.600, 3.700, AND 5.100 AND REPEALING SECTIONS 3.200, 3.109, 3.506 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH, PROVIDING FOR A SAVINGS CLAUSE, AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. INTERNATIONAL MECHANICAL CODE A. That certain documents, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, being marked and designated as the 2000 edition of the International Mechanical Code excluding Appendix Chapter B, as published by the International Code Council, be and are hereby adopted as the code of the City of Round Rock for regulating and controlling the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Mechanical Code are hereby referred to, ::ODMA\WORLDOX\O:\WDOX\ORDINANC\020110B3. W PD/cr adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes set forth below. B. Section 3.701 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: 3.701. INTERNATIONAL MECHANICAL CODE (2000 EDITION) ADOPTED. The 2000 edition of the International Mechanical Code excluding Appendix Chapter B, as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the code of the City of Round Rock. Penalties, conditions and terms of said Mechanical Code are hereby adopted, and made a part hereof, as if fully set out in this ordinance, except as amended hereafter. C. Section 3.700 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended by adding Section 3.703, which shall read as follows: Section 3.703. AMENDMENTS TO THE INTERNATIONAL MECHANICAL CODE, (2000 EDITION). The International Mechanical Code is amended as follows: (a) Section 101.1. Insert: City of Round Rock, Texas (b) Section 106.5.3: Deleted. (c) Section 108.4: Amend to read: "Violations of any provision of this code shall be punished by a fine of up to $2000.00. Each day that a violation continues after due notice has been given shall be deemed a separate offense." (d) Section 108.5: Insert: "$2,000.00. " II. International Fuel Gas Code A. That certain documents, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, being marked and designated as the 2000 edition of the International Fuel Gas Code, including Appendix Chapters, as published by the International Code Council, be and are hereby 2 adopted as the code of the City of Round Rock, Texas, for the establishment of minimum regulations governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Fuel Gas Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, set forth below. B. Section 3.601 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: Section 3.601. INTERNATIONAL FUEL GAS CODE ADOPTED. The 2000 edition of the International Fuel Gas Code, as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the code of the City of Round Rock, Texas. Penalties, conditions and terms of said Fuel Gas Code are hereby adopted, and made a part hereof, as if fully set out in this ordinance, except as amended hereafter. C. Section 3.602 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: Section 3.602. AMENDMENTS TO THE INTERNATIONAL FUEL GAS CODE (2000 EDITION) The International Fuel Gas Code is amended as follows: (a) Section 101.1. Insert: City of Round Rock, Texas (b) Section 106.5.2. Insert: "All fees for permits are governed by Section 3.106 of the Code of Ordinances, (1995 Edition) City of Round Rock ." (c) Section 106.5.3: Deleted. (d) Section 108.4: Amend Code section to read: "Violations of any provision of this code shall be punished by a fine of up to $2000.00. Each day that a violation continues after due notice has been given shall be deemed a separate offense." (e) Section 108.5: Insert: 12,000.00." 3 International Plumbing Code A. That certain documents, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, being marked and designated as the 2000 edition of the International Plumbing Code including Appendix Chapters, as published by the International Code Council, be and are hereby adopted as the code of the City of Round Rock, Texas, for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Plumbing Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, as set forth below: B. Section 3.501 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: Section 3.501. INTERNATIONAL PLUMBING CODE (2000 EDITION) ADOPTED. The 2000 edition of the International Plumbing Code, as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the code of the City of Round Rock, Texas. Penalties, conditions and terms of said International Plumbing Code are hereby adopted, and made a part hereof, as if fully set out in this ordinance, except as amended hereafter. C. Section 3.502 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: Section 3.502. AMENDMENTS TO THE INTERNATIONAL PLUMBING CODE (2000 EDITION) 4 The International Plumbing Code is amended as follows: (a) Section 101.1. Insert: City of Round Rock, Texas. (b) Section 106.6.2. Insert: All fees for permits are governed by Section 3.106 of the Code of Ordinances, (1995 Edition) (c) Section 106.6.3: Deleted. (d) Section 108.4: Amend to read: "Violations of any provision of this code shall be punished by a fine of up to $2000.00. Each day that a violation continues after due notice has been given shall be deemed a separate offense." (e) Section 108.5: Insert: "$2,000.00." (f) Section 305.6.1. Insert: "six (6) inches." (g) Section 904.1. Insert: "six (6) inches." D. Section 3.506 of the Code of Ordinances, (1995 Edition) City of Round Rock is hereby repealed. IV. International Energy and Conservation Code A. Section 3.200 of the Code of Ordinances, (1995 Edition) City of Round Rock, entitled, "When Issuance of Building Permits is Restricted Due to Water Shortage," is repealed in its entirety. B. That certain documents, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, being marked and designated as the 2000 edition of the International Energy and Conservation Code including Appendix Chapters, as published by the International Code Council, be and are hereby adopted as the code of the City of Round Rock, Texas, for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of the building envelope, mechanical, lighting and power systems in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said 5 International Energy and Conservation Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, as set forth below. C. Section 3.200 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: Section 3.200. ENERGY AND CONSERVATION CODE. Section 3.201. INTERNATIONAL ENERGY AND CONSERVATION CODE (2000 EDITION) ADOPTED The 2000 edition of the International Energy and Conservation Code, as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the code of the City of Round Rock, Texas. Penalties, conditions and terms of said International Energy and Conservation Code are hereby adopted, and made a part hereof, as if fully set out in this ordinance, except as amended hereafter. Section 3.202. AMENDMENTS TO THE INTERNATIONAL ENERGY AND CONSERVATION CODE (2000 EDITION). The International Energy and Conservation Code is amended as follows: (a) Section 101.1. Insert: City of Round Rock, Texas V. International Fire Code A. That certain documents, one (1) copy of which is on file in the office of the City Secretary for the City of Round Rock, Texas, being marked and designated as the 2000 edition of the International Fire Code including Appendix Chapters, as published by the International Code Council, be and are hereby adopted as the code of the City of Round Rock, Texas, for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to 6 life or property in the occupancy of buildings and premises in the City of Round Rock, Texas, as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Fire Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, set forth below. B. Section 5.101 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: Section 5.101.INTERNATIONAL FIRE CODE (2000 EDITION) ADOPTED. The 2000 edition of the International Fire Code, as published by the International Code Council, one copy of which shall be placed on file in the office of the City Secretary of the City of Round Rock, Texas, is hereby adopted as the code of the City of Round Rock, Texas. Penalties, conditions and terms of said International Fire Code are hereby adopted, and made a part hereof, as if fully set out in this ordinance, except as amended hereafter. " C. Section 5.102 of the Code of Ordinances, (1995 Edition) City of Round Rock is amended to read as follows: Section 5.102. AMENDMENTS TO INTERNATIONAL FIRE CODE (2000 EDITION) (a) Section 101.1. Insert: City of Round Rock, Texas (b) Section 109.3: Amend to read: "Violations of any provision of this code shall be punished by a fine of up to $2000.00. Each day that a violation continues after due notice has been given shall be deemed a separate offense. " (c) Section 111.4: Insert: "$2,000.00." (d) Section 3204.3.1.1: Insert: Storage of flammable cryogenic fluids in stationary containers outside of buildings is prohibited within the City of Round Rock city limits, with the exception of areas zoned for industrial use. Storage of flammable cryogenic fluids may be permitted at the discretion of the Fire Chief following his or her review of the proposed location and the fire protection for the storage area. Storage shall not be allowed within one hundred feet (100') of the property line of any Group E, I or R occupancies. (e) Section 3404.2.9.5.2: Insert: The storage of flammable or combustible liquids in outside above ground tanks is prohibited within each and every zoning district within the City of Round Rock with the exception of those districts which are zoned for industrial use. Installation of above ground tanks in industrial districts shall be permitted at the discretion of the Fire Chief following his or her review of the proposed installation location and the fire protection for the storage area. When used in conjunction with Chapter 22 above ground storage will be allowed 7 at the discretion of the Fire Chief. Tanks shall not be located within one hundred feet (100') of the property line of any Group E, I or R occupancies. (f) Section 3406.2.4.4: Insert: Storage of Class I and II liquids in above -ground tanks is prohibited within the City of Round Rock city limits, with the exception of areas that are zoned for industrial use. Storage of Class I and II liquids may be permitted at the discretion of the Fire Chief following his or her review of the proposed location and the fire protection for the storage area. Storage shall not be allowed within one hundred feet (100') of the property line of any Group E, I or R occupancies. (g) Section 3804.2: Insert: Tanks shall not be located within one hundred feet (100') of the property line of any Group E, I or R occupancies." VI. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. VII. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Round Rock, Texas hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. VIII. The city secretary is hereby ordered and directed to cause this ordinance to be published for the requisite number of times in the appropriate newspaper of general circulation, and to cause this ordinance to be posted according to applicable requirements. IX. This ordinance and the rules, regulations, provisions, 8 requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect from and after the date of its final passage and adoption. X. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance adopting the 2000 Editions of the International Family of Codes: Fire, Plumbing, Energy and Conservation, Mechanical, and Fuel and Gas. (Second Reading) The Standard Family of Codes that are currently enforced are no longer revised to reflect changes in the current industry standards. The Standard, Uniform and BOCA Building Codes have been consolidated into single family of codes, The International Codes. Resource: Jim Nuse, Public Works Director Mark Remmert, Chief Building Official History: Last year the City Council adopted the International Residential Code for one and two family dwellings. The Ordinance before the Council tonight adopt the family of International Codes. This ordinance repeals the 1994 Edition of the Standard Building Code and adopts the 2000 Editions of the International Building Codes: Fire, Plumbing, Energy and Conservation, Mechanical, and Fuel and Gas. The Sections pertaining to Permit Fees remains unchanged. Obsolete provisions of the Code are repealed.
