ORDINANCE NO. a-06-1,2Al AN ORDINANCE APPROVING AND ADOPTING A BUDGET FOR THE MUNICIPAL COURT FUND FOR THE 2001-2002 FISCAL YEAR. WHEREAS, the Municipal Court has submitted a proposed budget for the Municipal Court Fund for fiscal year 2001-2002, and WHEREAS, the City Council wishes to approve said proposal, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the budget for the Municipal Court Fund submitted by the Municipal Court for fiscal year 2001-2002, attached hereto as Exhibit "A", is hereby approved. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Article 102.014(c), Code of Criminal Procedure, is amended to read as follows: (c) A person convicted of an offense under Subtitle C, Title 7, Transportation Code, when the offense occurs within a school crossing zone as defined by Section 541.302 of that code, shall pay as court costs S25 in addition to other taxable court costs. A person convicted of an offense under Section 545.066, Transportation Code, shall pay as court costs S25 in addition to other taxable court costs. The additional court costs under this subsection shall be collected in the same manner that other fines and taxable court costs in the case are collected and shall be assessed only in a municipality [ tee]. SECTION 2. The change in law made by this Act applies only to the assessment of court costs for a conviction, as determined under Article 102.014(e), Code of Criminal Procedure, that takes place on or after the effective date of this Act, without regard to whether the behavior that is the basis for the conviction takes place before, on, or after that date. SECTION 3. ORGANIZATIONAL RELATIONSHIPS 1. Reports to: Court Administrator EXAMPLES OF DUTIES: QUALIFICATIONS Knowledge of: Security procedures, court procedures, and laws related to the duties of a Bailiff. Procedures of municipal court as it relates to the service and execution of warrants and arrests. Ability to: Make arrests, maintain order in a professional manner. Communicate clearly and concisely, both orally and in writing. Establish and maintain effective working relationships with those contacted in the course of work. Experience and Training Previous experience with court process and procedures. Previous experience with security and Law Enforcement Any combination of experience and training that would likely provide the required knowledge and abilities is qualifying. Certificates and Licenses Required Certified / Commissioned Peace Officer Annual TMCEC Bailiff Training 12 hour course Required TCLOSE hours DUTIES OF ROUND ROCK MUNICIPAL COURT BAILIFF The primary function of the Municipal Court Bailiff is to maintain security and order in the Courtroom in a professional manner. In most instances the only court with which a citizen may have contact is the Municipal Court. It is the Court's desire that citizens leave the Municipal Court with the impression that Court's business is conducted in a friendly and professional manner. Most persons who come to Municipal Court are good citizens. Occasionally there may be individuals present in the courtroom who are disruptive, discourteous, or disrespectful. Such individuals must be handled in a quiet and non -threatening manner so that the regular flow of the Court docket is not disrupted. Each distraction should be handled on a case-by-case basis so as to cultivate the appropriate court room behavior. Each person's experience with the Court should be as orderly and as stress -free as possible. The Round Rock Municipal Court has adopted a list of specific duties and responsibilities for the Municipal Court Bailiff. Persons serving in the capacity of Municipal Court Bailiff shall perform the duties and responsibilities set forth below: The Bailiff must be available on hour prior to the docket to secure the court room and open the court room doors. The Bailiff shall remain in the court room at all times unless under the direction of the Judge. 1. The Bailiff shall insure that persons remove their hats as required by the court. 2. The Bailiff shall have all persons appearing before the judge sign is on the Municipal Court Sign In sheet, which will be provided and retrieved by the Deputy Clerk assisting the judge during the session. 3. When a defendant asks the Bailiff questions about his or her case or Court procedures, the Bailiff shall refer that defendant to Municipal Court personnel. The Bailiff must not discuss a defendant's individual case or Court procedures with a defendant. (The proper persons to answer questions are the Judge and/or the Municipal Court Clerk or one of her Deputies. It is not proper for the Bailiff to give a defendant his or her opinion about a particular case or to give advice to a defendant about Municipal Court procedures.) 4. The Bailiff shall maintain a quiet "library" atmosphere in the courtroom. The Bailiff must keep distractions to a minimum so that each defendant has a full opportunity to hear instructions given by the Judge or court support personnel. 5. The Bailiff shall move about the courtroom watching for disruptive, disorderly, or threatening behavior. The Bailiff shall address problems or disruptive behavior in a professional non -confrontational manner without creating a distraction or involving other persons present in the courtroom. Each distraction shall be handled on a case-by-case basis so as to cultivate the appropriate courtroom behavior. 6. The Bailiff shall begin a new sign in sheet for tardy defendants and shall supply the list as soon as practicable or immediately at the request of the Judge. The Judge will call the cases of late -comers after the cases of persons who appear on time have been handled. 7. When a child becomes unruly or noisy, the Bailiff shall ask the defendant who has charge of the child to step into the hallway outside the courtroom until his or her case is called. Bailiff may inform the person of other employees and customers who may be affected by excessive noise. 8. If court is in session at 11:00 a.m., the Bailiff shall lock the main entrance to the courtroom. If a person attempts to appear after 11:00 AM, they will need to be referred to the Municipal Court Clerk's Office. REVISED on this day of October, 2001. Dan R. The fees collected by the municipal court hereunder shall be deposited into the city treasury for the use and benefit of the city. A person who is authorized by the municipal court judge to attend a teen court program and fails to complete the program is not entitled to a refund of the fee. (Ordinance No. G -96-04-11-12E of April 11, 1996) 1.2204 MUNICIPAL COURT BUILDING SECURITY FEE The municipal court is authorized to collect a municipal court building security fee of $3.00 per conviction. The fees collected pursuant to this subsection shall be paid into the city treasury for deposit in a fund to be known as the municipal court building security fund. Funds collected pursuant to this subsection shall be expended as authorized by Article 102.017 of the Texas Code of Criminal Procedure, as amended. (Ordinance No. G -00-04-27-11B1 of April 27, 2000) 1.2205 MUNICIPAL COURT TECHNOLOGY FEE The municipal court is authorized to collect a municipal court technology fee of $4.00 per conviction. The fees collected pursuant to this subsection shall be paid into the city treasury for deposit in a fund to be known as the municipal court technology fund. Funds collected pursuant to this subsection shall be expended as authorized by Article 102.0172 of the Texas Code of Criminal Procedure, as amended. In accordance with Article 102.0172 of the Texas Code of Criminal Procedure, this subsection and the assessment of the collection of the municipal court technology fee expires September 1, 2005. The purpose of the use of any funds remaining in the fund shall continue to be used and administered as required by Article 102.0172 of the Texas Code of Criminal Procedure and for that purpose this subsection remains in effect.
