AN ORDINANCE AMENDING CHAPTER 10, SECTION 10.204, CODE
OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS,
BY AMENDING THE AMOUNT OF THE WATER AND
WASTEWATER IMPACT FEES AND THE TIME IMPACT FEES ARE
ASSESSED AND DUE; PROVIDING FOR A SAVINGS CLAUSE AND
REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS.
WHEREAS, the Legislature of the State of Texas adopted SB
243 which amends Chapter 395 of the Local Government Code regarding
impact fees; and
WHEREAS, sa

id SB 243 is effective as of September 1, 2001;
WHEREAS, said SB 243 provides, among other things, that the
amount of impact fees that may be charged by a municipality is
capped and that impact fees shall be collected at the time a
building permit is issued; and
WHEREAS, the City Council wishes to amend its ordinances to
comply with the provisions of SB 243; Now Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND
ROCK, TEXAS:
I.
For all building permits issued prior to September 1, 2001,
the Water and Wastewater Impact Fees shall be in the amounts in
effect on the date the building permit was issued and shall
continue to be collected at the time a certificate of occupancy is

issued.
For all building permits issued on or after September 1, 2001,
the Water and Wastewater Impact fees shall be charged and collected
as set forth below.
II.
Section 10.204(3) Code of Ordinances, (1995 Edition) City of
Round Rock is hereby amended by adding subsection (e) to read as
follows:
(e) Beginning on September 1, 2001, the city shall assess and collect
on all new development and/or new connections to be served by
the city's water system a Water Impact Fee of $1,741.00 for each
LUE.
III.
Section 10.204(4) Code of Ordinances, (1995 Edition) City of
Round Rock is hereby amended by adding subsection (e) to read as
follows:
(e) Beginning on September 1, 2001, the city shall assess and collect on all new
development and/or new connections to be served by the city's wastewater system
a Wastewater Impact Fee of $1,187.00 for each LUE.
IV.
Section 10.204(5) Code of Ordinances, (1995 Edition) City of
Round Rock is hereby amended to read as follows:
(5) Time Impact Fees are Assessed and Due
The impact fees for all new construction shall be determined, assessed, and due and
payable at the time the building permit is issued. The impact fees for any new service
which is not subject to permitting or inspection by the city shall be due and payable at the
time the connection is made to the water and/or wastewater system.

A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.

ITEM: *14.C.1. Consider an ordinance amending the Impact Fees Ordinance to
comply with the provisions of Senate Bill 243. (Second Reading)
Beginning September 1, 2001 the City shall assess and collect on all
new development and/or new connections to be served by the City's
water system a Water Impact Fee of $1,741 for each LUE and
Wastewater Impact Fee of $1,187. The first reading of the ordinance
was approved on September 13, 2001.

History: The City of Round Rock is complying with the new terms of Senate Bill 243,
which allows the City to charge up to 50% of the maximum fee determined by
the study.
