AN ORDINANCE AMENDING CHAPTER 9, CODE OF ORDINANCES
OF THE CITY OF ROUND ROCK, TEXAS BY ADDING A NEW
SECTION TO MAKE IT UNLAWFUL FOR PERSONS TO PARK A
VEHICLE ON THE EAST SIDE OF LAMAR DRIVE BETWEEN OLD
SETTLERS BOULEVARD AND COMMERCE BOULEVARD;
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING
CONFLICTING ORDINANCES OR RESOLUTIONS.
WHEREAS, a Texas home -rule municipality may adopt ordinances
that are for the good government, peace, or order of the
municipality; and
WHEREAS, the City of Round Rock, Texas has previously enacted
provisions in its Code of Ordinances relating to the parking of
motor vehicles within the territorial limits of the City of Round
Rock; and
WHEREAS, the section of Lamar Drive between Old Settlers
Boulevard and Commerce Boulevard has been designated as an arterial
route by the Round Rock Fire Department to responding to calls in
the Northeast section of the City; and
WHEREAS, persons frequently park vehicles on both the east
side and the west side of Lamar Drive thereby narrowing the roadway
and blocking the travel of emergency vehicles; and
WHEREAS, this ordinance is intended to make it unlawful for
any person to park along the east side of Lamar Drive between Old

Settlers Boulevard and Commerce Boulevard and designate said area
as a tow away zone. Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
I.
That Chapter 9 , Section 9.1816 of the Code of Ordinances,
City of Round Rock, Texas is hereby amended by adding Section
9.1816(24) to read as follows:
9.1816 PARKING PROHIBITED IN CERTAIN DESIGNATED LOCATIONS
(24) Lamar Drive between Old Settlers Boulevard and Commerce Boulevard
It shall hereafter be unlawful for any person to park a motor vehicle, vehicle, trailer, or
automobile, as those terms are defined by Section 502.001 of the Texas Transportation
Code, V.T.C.A, on the east side of Lamar Drive between Old Settlers Boulevard and
Commerce Boulevard.
Any such vehicle or trailer parked in such prohibited area shall be a nuisance per se and
shall deemed to be a traffic and public safety hazard. Any vehicle or trailer parked in
violation of this Section may be removed by a police officer or at his or her direction and
retained until such time as any towing and storage fees are paid; provided however that
the prohibited parking area shall be posted with an official sign giving notice of the
prohibition and of the fact that such area is a tow away zone.
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.

C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.

ITEM: *14.B.1. Consider an ordinance establishing a No -Parking, tow -away zone
on a portion of Lamar Drive (Second Reading) This ordinance will
ensure safe egress to the roadway for Fire Department vehicles
responding to emergency calls. The first reading of the ordinance
was approved on September 13, 2001.

History: Lamar Drive is a primary point of egress for the Round Rock Fire Department as
it and EMS responds from the Central Station to emergency service calls in the
northeast part of the City. The safety of this route has been hampered seriously
by vehicles that frequently are parked on both sides of Lamar Drive, effectively
narrowing the roadway enough to block the travel of emergency vehicles.
The proposed ordinance would make it unlawful to park and designate a vehicle
tow away zone on the east side of Lamar Drive between Old Settlers and
Commerce Boulevards. Prohibiting parking on one side of the roadway is
sufficient to ensure that Fire Department vehicles can safely use Lamar Drive
while responding to emergency calls.

will be safe as they enter Lamar Drive to respond to calls for emergency
