G-01-08-09-12A2 - 8/9/2001ORDINANCE NO. a- 01-08-09- /QAZ AN ORDINANCE DETERMINING THAT THE RECITALS CONTAINED HEREIN ARE TRUE AND CORRECT; DECLARING AND DETERMINING THAT CERTAIN PROPERTY DESCRIBED HEREIN ARE NOT CITY STREETS; DETERMINING THAT SAID PROPERTY HAS NEVER BEEN USED AS A CITY STREET; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, a portion of the real property located east of North Mays Street, north of Anderson Avenue and south of Brushy Creek, has, at various times, been mistakenly described as being a part of Milam Street (unopened), Herrick Street (unopened) and Blair Street (unopened), (herein referred to as the "Street Property"), being as shown on Exhibit "A", attached herein; and WHEREAS, none of said Street Property was ever dedicated to, or accepted by, the City in any fashion; Now Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, I. 1. That none of the Street Property as shown in Exhibit "A" has ever been a city street and that no legally effective dedication of said Street Property has taken place. 2. That the Street Property has never been used as a street at any time nor has the City at any time accepted said Street Property for public purposes. ::ODMA\WORLDOX\0:\WDOX\ORDINANc\00008599.WPD/cdc II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. Consider an ordinance declaring that no City streets are located within the real property located east of North Mays Street, north of Anderson Avenue and south of Brushy Creek. (First Reading) Resource: Joe Vining, Planning Director History: The property owners of the subject property are unable to convey clean title because a City map from the early 1840's shows an unopened portion of three streets running through the property. The streets were never dedicated to the City, nor has the City ever accepted said streets within said property. The City has no present or future need for the streets. Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A Impact: None Benefit: Allows for the sale of property and retaining property on tax rolls.
