G-01-03-22-11E3 - 3/22/2001ORDINANCE NO. g v I ' 03 -AQ -//3 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING; AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND TO SEND NOTICE BY CERTIFIED MAIL TO CERTAIN PERSONS; AUTHORIZING THE DIRECTOR OF PLANNING AND COMMUNITY DEVELOPMENT TO PREPARE LAND USE ASSUMPTIONS AND THE CAPITAL IMPROVEMENTS PLAN USED IN CALCULATING ROADWAY IMPACT FEES IN ACCORDANCE WITH CHAPTER 395 OF THE LOCAL GOVERNMENT CODE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. On the 24th day of May, 2001, at 7:00 o'clock P.M. in the City Council Chambers, City of Round Rock, Texas, the City Council will hold a public hearing to consider the land use assumptions and capital improvements plan within the designated service area that will be used to develop a capital improvements plan pursuant to which a roadway impact fee may be imposed. Any member of the public has the right to appear at the hearing and present evidence for or against the land use assumptions and capital improvements plan. II. The City Secretary is hereby authorized and directed to publish notice of the hearing once a week for three consecutive weeks, the first notice to appear before the 30th day but on or after the 60th day before the date set for the hearing, in one or K:\WPDOCS\ORDINANC\010322E3.WPD/sc more newspapers of general circulation in Williamson and Travis Counties in the format required by Chapter 395, Local Government Code. III. The City Secretary is hereby authorized to send a notice of the hearing by certified mail to any person who has given written notice by certified or registered mail to the City Secretary requesting notice of such hearing within two years preceding the date of adoption of this ordinance. IV. The Director of Planning and Community Development is hereby authorized and directed to prepare the land use assumptions and capital improvements plan relating to the possible adoption of a roadway impact fee in accordance with the provisions of Chapter 395 of the Local Government Code. V. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which 2 this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. Consider an ordinance setting a date, time and place for a public hearing for the new land use assumptions in the northeast portion of the City of Round Rock as part of the proposed roadway impact fee ordinance. (First Reading) Resource: Joe Vining, Planning Director History: The City of Round Rock is considering an Impact Fee ordinance for the construction of roadways in the northeast portion of the city. Dan Sefko and Associates will do a roadway impact fee study. The Planning and Zoning Commission will provide general direction in the form of recommendations on land use and act as Road Impact Fee Advisory Committee. Funding: N/A Cost: Source of Funds: Outside resources: Dan Sefko and Associates, Inc. Impact: New land use assumptions for some tracts in the northeast portion of the city will be made through a general plan amendment. Benefit: Cost participation by the development community for the construction of new roadways. Public Comment: Public notification is required prior to the City Council hearing on Land Use Assumptions as per Section 395.044 of Local Government Code.
