Or- - CC C J ` i C1 D AN ORDINANCE AMENDING CHAPTER 3, SECTIONS 3.1103 AND 3.1106, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, TO REDEFINE THE LANDSCAPE ORDINANCE REQUIREMENTS OF THE SITE PLAN CERTIFICATION PROCESS AND THE INSPECTION PROCESS; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. That Chapter 3, Section 3.1103(1)(i), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: (i) The certification of an architect or landscape architect registered in the State of Texas that the plans satisfy the requirements of this section. II. That Chapter 3, Section 3.1106, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: 3.1106 INSPECTION (1) Prior to the issuance of a certificate of occupancy, an architect or landscape architect registered in the State of Texas shall inspect each site and certify by means of the appropriate city form that the site meets the requirements of this section and conforms to the approved site plan. If the required landscaping is not yet in place, the developer/owner shall make fiscal arrangements (by bond, certificate of deposit, or letter of credit) satisfactory to the city in the amount of two dollars ($2.00) per square foot of required landscaping not in place to ensure that such required landscaping shall be installed. Any developer/owner wishing to make such fiscal arrangements must also grant license to the city to enter upon the land for the purposes of installing the required landscaping in the event that such landscaping is not in place at the time of the inspection required by the pre ceding subsection. Such fiscal arrangements shall be released if the required landscaping K:\WPDOCS\ORDINANC\000525D2.2WP/sc is in place at the time of such inspection. Compliance with this section must be met within nine (9) months of issuance of the certificate of occupancy. III. That this ordinance shall become effective June 1, 2000. W. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. STLUKA, J'., Mayor City of Round Rock, Texas CITY OF ROUND ROCK INTEROFFICE MEMORANDUM TO: Bob Bennett, City Manager FROM: Joe Vining, Director Planning and Community Developme DATE: May 17, 2000 SUBJECT: Landscape Ordinance Revisions The Planning Department is recommending that City Council modify two provisions in the current Landscape Ordinance. The first recommendation pertains to the site plan submittal specifications outlined in Section 3.1103 (1) (i). The current ordinance allows landscape site plans greater than two acres to be certified by either a registered architect or landscape architect. For properties under two acres, plans may be certified by a registered architect, landscape architect, engineer or nurseryman. Staff recommends that all landscape site plans, regardless of the size of the tract, be certified by either a landscape architect or architect registered in Texas. Under the existing requirement, staff often receives non-compliant landscape site plans for properties under two acres. Staff then expends additional time working with the property owner to reconfigure the plan to make it comply with city requirements. As with properties greater than two acres, staff expects that plans developed by either a landscape architect or an architect for properties under two acres will be of a higher quality than those currently submitted. This will reduce the amount of staff time required to review the landscape site plan and improve the quality of citywide landscaping. The second recommendation pertains to the landscape installation inspection process outlined in Section 3.1106 (1). Current regulations require the Building Department to perform an on-site inspection of landscaping prior to the issuance of a certificate of occupancy to ensure that it complies with the approved landscape site plan. Due to increases in commercial and industrial development applications, these requirements are rarely met. Accordingly, staff recommends that either a landscape architect or architect registered in Texas perform the landscape installation inspection and certify that it complies with the approved landscape site plan. This will eliminate the need for the landscape inspection fee, which is collected with the building permit application, and reduce the amount of staff time needed to perform the inspection.
