ORDINANCE NO. 6-00- O - 9"1 - /CC I
AN ORDINANCE OF THE CITY OF ROUND ROCK, TEXAS,
CALLING AN ELECTION ON MAY 6, 2000 FOR THE PURPOSE OF
ELECTING CERTAIN CITY OFFICIALS AND FOR SUBMITTING TO
THE VOTERS CERTAIN PROPOSED AMENDMENTS TO THE HOME
RULE CHARTER OF THE CITY; DESIGNATING ELECTION
PRECINCTS AND POLLING PLACES; PROVIDING FOR EARLY
VOTING; PROVIDING FOR PERFORMANCE OF REQUIRED
ADMINISTRATIVE DUTIES; AND PROVIDING FOR OTHER
MATTERS RELATING TO SUCH CITY ELECTION.
WHEREAS, the City Council of the City of Round Rock, Texas,
wishes to order a city election on May 6, 2000, for the purpose of
electing Councilmember Place 3 and Councilmember Place 5; and
WHEREAS, the City Council additionally wishes to submit to
the voters at the same election certain proposed amendments to the
home rule charter of the city; and
WHEREAS, Section 13.11 of the Charter for the City of Round
Rock provides that proposed amendments to such charter may be
"framed and submitted to the voters of the City in the manner
provided by Tex. Loc. Gov't Code Ann., Chapter 9, as amended;" and
WHEREAS, Vernon's Texas Codes Annotated, Local Government
Code §9.004(a) provides that the "governing body of a municipality
on its own motion may submit a proposed charter amendment to the
municipality's qualified voters for their approval at an election;"

WHEREAS, certain charter amendments are proposed for
submission to the voters of Round Rock, and a copy of same is
attached hereto as Exhibit "A" and incorporated herein by reference
for all purposes; and
WHEREAS, Vernon's Texas Codes Annotated, Local Government
Code §9.004(b) requires the charter amendment election to be held
on the first authorized uniform election date prescribed by the
Election Code that allows sufficient time to comply with other
requirements of law and that occurs on or after the thirtieth
(30th) day after the date the ordinance is adopted; and
WHEREAS, the City Council has determined that May 6, 2000 is
the appropriate date for holding the election to elect
Councilmember Place 3 and Councilmember Place 5, and for holding
the charter amendment election; and
WHEREAS, the City Council wishes to encourage all registered
voters in the City to vote in this election; and
WHEREAS, it has been determined that Robertson Elementary
School, Gattis Elementary School, First Baptist Church, Round Rock
High School, Bluebonnet Elementary School, and Wells Branch
Elementary School would be easily accessible to voters in the City
of Round Rock on election day; and
WHEREAS, it has been further determined that early voting

places will be at Round Rock City Hall, Round Rock Independent
School District Administration Building, Westwood High School, and
McNeil High School; Now Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND
ROCK, TEXAS, THAT:
I.
1. An election shall be held in conjunction with the general
election on Saturday, May 6, 2000 in accordance with the attached
Order of Election. The City of Round Rock hereby designates the
election precincts and polling places designated by John
Willingham, Williamson County Elections Administrator, and approved
by the Williamson County Commissioners Court, for such election.
Further, the City of Round Rock hereby designates the early voting
polling places and the temporary polling places designated by John
Willingham, Williamson County Elections Administrator, and approved
by the Williamson County Commissioners Court, for such election.
2. Robertson Elementary School, Gattis Elementary School,
First Baptist Church, Round Rock High School, Bluebonnet Elementary
School, and Wells Branch Elementary School are hereby designated as
the official election day polling places; and Round Rock City Hall,
Round Rock Independent School District Administration Building,
Westwood High School, and McNeil High School are hereby designated
as the official early voting polling places for the May 6, 2000

election; and that the polling places and voting hours are detailed
in the attached Order of Election.
3. For such election, the City of Round Rock hereby appoints
the election judge(s) and alternate election judge(s) appointed by
Williamson County, Texas and designated by John Willingham,
Williamson County Elections Administrator.
4. Early voting shall be conducted by personal appearance
and by mail at the following places: Round Rock City Hall, 221 E.
Main Street, 3rd Floor, Round Rock, Texas; Round Rock Independent
School District Administration Building, 1311 Round Rock Avenue,
Round Rock, Texas; Westwood High School, 12400 Mellow Meadow Drive,
Austin, Texas; and McNeil High School 5720 McNeil Road, Austin,
Texas; and/or at such other places as shall be designated in
writing by John Willingham, Williamson County Elections
Administrator, and approved by the Williamson County Commissioners
Court. During the period in which early voting is required or
permitted by law, that being April 19 through April 28, 2000 and
May 1 through May 2, 2000, the hours designated for early voting by
personal appearance shall be as follows, and/or as otherwise
designated in writing by John Willingham, Williamson County
Elections Administrator, and approved by the Williamson County
Commissioners Court:

April 19 - April 28, 2000 (Weekdays) 8:00 a.m. - 5:00 p.m.
May 1 - May 2, 2000 (Weekdays) 8:00 a.m. - 7:00 p.m.

Early voting clerks shall keep the early voting places open
during all such hours for early voting by personal appearance. The
Early Voting Clerk and manager of the central counting station
shall be John Willingham, Williamson County Elections
Administrator, and he shall appoint additional clerks as necessary
to assist in early voting.
5. An early ballot board is hereby created to process early
voting results, and is hereby appointed as
the presiding judge of said board. The presiding
judge shall appoint at least two (2) other members of the board.
6. Pursuant to the Election Code and the applicable Election
Services Contract, John Willingham shall be appointed as Custodian
of Election Records.
7. All resident, qualified electors of the City of Round
Rock, Texas shall be entitled to vote at the election.
8. Notice of this election shall be given in accordance with
Vernon's Texas Codes Annotated, Local Government Code §9.004(c) by
twice publishing a substantial copy of the proposed amendment in a
newspaper of general circulation published in the city. The dates

of such publication shall be the same day in each of two successive
weeks, with the first publication occurring before the 14th day
before the date of the election.
Notice of this election shall also be given by posting a copy
of this ordinance on the bulletin board used for posting notices of
city council meetings, and it shall be posted not later than the
21st day before the date of the election and shall remain posted
through election day.
The City Secretary is hereby authorized and directed to
publish and post the required notices in the manner and for the
time periods required by law.
9. At the election, the proposed amendments to amend the
charter shall be set forth substantially in the form contained
herein, and said proposed charter amendments shall be submitted to
the qualified voters in accordance with applicable law.
10. The official ballots for this charter amendment election
shall be prepared so as to permit the qualified electors to vote on
a proposed charter amendment by ballot title. The ballot title of
a proposed charter amendment may differ from its legal title and
shall be a clear, concise statement describing the substance of the
proposed charter amendment without argument or prejudice. The
official ballots for this charter amendment election shall be
prepared so as to permit the qualified electors to vote "Yes" or

"No" on the proposed charter amendments. Said proposed charter
amendments shall be combined with other allowable matters on the
same ballots, said ballots to contain such provisions, markings and
language as required by law. The proposed charter amendments shall
be expressed substantially as follows:

AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK,
TEXAS, SEC. 5.01 TO CORRECT A TYPOGRAPHICAL ERROR AND TO CLARIFY
LANGUAGE REGARDING THE CALLING OF ELECTIONS BY THE COUNCIL.

A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.

C. The City Council hereby finds and declares that
written notice of the date, hour, place and subject of the
meeting at which this Ordinance was adopted was posted and
that such meeting was open to the public as required by law at
all times during which this Ordinance and the subject matter
hereof were discussed, considered and formally acted upon, all
as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

SECTION 6.02 PETITION FOR RECALL
Before the question of recall of such officer shall be submitted to the qualified voters of the City,
a petition demanding such question to be so submitted shall first be filed with the person performing the
duties of the City Secretary; which said petition shall be signed by qualified voters of the City equal in
number to at least ten percent (10%) of the number of rcgistcrcd qualifiedvoters as

SECTION 6.03 RECALL PROCEDURE
Any rcgistcrcd qualified voters of the City may make and file with the person performing the duties
of City Secretary an affidavit containing the name or names of the officer(s) whose removal is sought and
a statement of the grounds for removal. The City Secretary shall immediately notify in writing the officer(s)
sought to be removed that the affidavit has been filed and shall inform the officer(s) of its statement of
grounds. The City Secretary shall within a period of two (2) working days from the time the affidavit was
filed thereupon make available to the registered qualified voters making such affidavit copies of petition
blanks demanding such removal. The City Secretary shall keep a sufficient number of such printed petition
blanks on hand for distribution. Such blanks when issued by the City Secretary shall bear the signature of
the City Secretary and be of such form as prescribed in Section 6.04 of this Article, and shall be numbered,
dated, and indicate the name of the person to whom issued. The City Secretary shall enter in a record to
be kept in his or her office the name of the registered qualified voters to whom the petition blanks were
issued and the number to said person.
SECTION 6.04 FORM OF RECALL PETITION
The recall petition mentioned above must be addressed to the City Council of the City of Round
Rock, must distinctly and specifically state the ground(s) upon which such petition for removal is
predicated, and, if there be more than one ground, such as for incompetency, noncompliance with this
Charter, misconduct or malfeasance in office, shall specifically state each ground with such certainty as
to give the officer sought to be removed, notice of such matters and things with which he or she is charged.

SECTION 7.02 COMMENCEMENT OF PROCEEDINGS;
PETITIONERS' COMMITTEE; AFFIDAVIT
Any five (5) or more qualified voters of the City may commence initiative or referendum
proceedings by filing with the City Secretary an affidavit stating that they will constitute the petitioners'
committee and be responsible for circulating the petition and filing it in proper form, stating their names
and addresses and specifying the address(es) to which all notices to the committee are to be sent, and
setting out in full the proposed initiative ordinance or citing the ordinance sought to be reconsidered.
Immediately after the affidavit of the petitioners' committee is filed, the person performing the
duties of City Secretary shall issue the appropriate petition blanks to the petitioners' committee.
SECTION 7.03 PETITIONS
(a) Number of Signatures.

SECTION 7.06 ACTION ON PETITIONS
(d) Withdrawal of Petition.

An initiative or referendum petition may be withdrawn at any time prior to the time the
petition has been determined to be sufficient by filing with the City Secretary a request for
withdrawal signed by at least four (4) eighty,percent 80%) of the members of the

or effect and all proceedings thereon shall be terminated.

SECTION 7.08 RESULTS OF ELECTION
(a) Initiative.
If a majority of the qualified voters voting on a proposed initiative
ordinance vote in its favor, it shall be considered adopted upon certification of the election
results and shall be treated in all respects in the same manner as ordinances of the same
kind adopted by the City Council. If conflicting ordinances are approved at the same
election, the one receiving the greatest number of affirmative votes shall prevail.
(c) Referendum.
If a majority of the registered electors qualified voters voting on a referred ordinance vote
against the ordinance, it shall be considered repealed upon certification of the election
results. If a majority of the etors qualified voters voting on a referred
ordinance vote for the ordinance, it shall be considered in effect and petition shall become
void.
SECTION 8.04 ADMINISTRATION OF BUDGET
(b) Financial Reports.
The City Manager shall submit to the City Council at
least quarterly the financial condition of the City by budget item, budget estimate versus
accruals for the fiscal year to date. The financial records of
the City will be maintained on an accrual basis to support this type of financial
management.
SECTION 12.03 MEMBERS FILING FOR OFFICE
No member of a Board or Commission shall continue in such position after filing for an elective
office of the City .

ORDER OF ELECTION
CITY OF ROUND ROCK, TEXAS
An Election is hereby ordered to be held on May 6, 2000 for the purpose of electing Council, Place 3
and Council, Place 5.
The City Officer Election shall be held at the polling places for the precincts designated on the attached
Exhibit "A", which is made a part hereof for all intents and purposes. The polls at the designated
polling places shall on said Election Day, be open from 7:00 a.m. to 7:00 p.m.
The Early Voting Ballot Board and the presiding judge and alternate presiding judge for each of said
polling places shall be designated by supplemental election order. Each of said respective presiding
judges is hereby authorized to appoint the necessary election clerks (not less than 2 and not more than
6) to assist in conducting said election. In the event a presiding judge or an alternate presiding judge is
not designated by the Round Rock City Council, the City Secretary of the City of Round Rock or her
designee is hereby authorized to designate a presiding judge or an alternate presiding judge. The City
Secretary or her designee shall also be authorized to designate replacement presiding judges or
alternate presiding judges should any such officers resign their position prior to the election and
thereby fill vacancies in such positions.
