(oO- OJ -Q7- aD ) AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS CHANGING THE SPEED ZONE ON OLD SETTLERS BOULEVARD FROM 1000' EAST OF LAMAR DRIVE TO 750' EAST OF SUNRISE ROAD; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation, and WHEREAS, an engineering and traffic investigation was conducted on Old Settlers Boulevard from 1000' east of Lamar Drive to 750' east of Sunrise Road on the 12th day of August, 1999, and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes as Exhibit "A", and WHEREAS, the results of said engineering and traffic investigation indicate that the speed limit on Old Settlers Boulevard from 1000' east of Lamar Drive to 750' east of Sunrise Road should be 45 miles per hour, Now Therefore K:\WPDOCS\ORDINANC\000113D1.WPD/SC BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.502(6), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, (The maximum prima facie speed limit shall be forty (40) miles per hour along the following streets:) is hereby amended to read as follows: ON Old Settlers Boulevard FROM TO North Mays Street a point 1000' east of (east and westbound) Lamar Boulevard II. That Chapter 9, Section 9.502(7), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, (The maximum prima facie speed limit shall be forty-five (45) miles per hour along the following streets:) is hereby amended by adding the following: ON Old Settlers Boulevard (east and westbound) FROM TO a point 1000' east of Lamar Boulevard a point 750' east of Sunrise Road M. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 2. C. Consider an ordinance changing the current 40 -mph speed zone to a 45 -mph speed zone on Old Settlers Boulevard from 1000 feet east of Lamar Drive to 750 feet east of Sunrise Road. (Second Reading) This speed zone is based upon findings of the Traffic and Engineering Study. The first reading of the ordinance was approved on January 13, 2000.
