AN ORDINANCE WAIVING FISCAL REQUIREMENTS UNDER
CHAPTER 8, SECTION 8.601(2), CODE OF ORDINANCES (1995
EDITION), CITY OF ROUND ROCK, TEXAS, FOR A FUTURE
MIDDLE SCHOOL ON RUSK ROAD; AND PROVIDING A SAVINGS
CLAUSE AND REPEALING CONFLICTING ORDINANCES AND
RESOLUTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
I.
That the fiscal requirements for plat recordation under
Section 8.601(2), Code of Ordinances (1995 Edition), City of Round
Rock, are hereby waived for a future Round Rock Independent School
District middle school to be located on Rusk Road.
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

Consider an ordinance waiving fiscal requirements for plat recordation
for a future Round Rock Independent School District Middle School on
Rusk Road
STAFF RESOURCE PERSON: Jim Nuse
STAFF RECOMMENDATION:
Section 8.601 of the Round Rock Code of Ordinances requires subdividers to post fiscal
for public improvements or complete the improvements prior to filing the plat for
recordation. This is done as a protection to the City and future purchasers that the
improvements will be completed. RRISD Is requesting that this requirement be waived for
the Middle School site on Rusk Road. Staff has no objections to this request since the
RRISD is a public agency with bond funds in place. Staff recommends approval of the
waiver.
