LJ - q05 1 - qp(2., AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS CHANGING THE SPEED ZONES ON PARKER DRIVE FROM F.M. 1325 TO I11-35 WEST FRONTAGE ROAD; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation, and WHEREAS, an engineering and traffic investigation was conducted on Parker Drive from F.M. 1325 to IH -35 West Frontage Road on the 5th day of February 1998, and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes as Exhibit "A", and WHEREAS, the results of said engineering and traffic investigation indicate that the speed limit on Parker Drive from F.M. 1325 to IH -35 West Frontage Road should be 40 miles per hour, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: K:\WPDOCS\ORDINANC\080423A2. That Chapter 9, Section 9.502(6), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, (The maximum prima facie speed limit shall be forty (40) miles per hour along the following streets:) is hereby amended by adding the following: ON Parker Drive (both directions) FROM TO F.M. 1325 IH -35 West Frontage Road II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. Consider an ordinance designating a 40 MPH speed zone on Parker Drive from FM 1325 to IH 35 West Frontage Road. (Second Reading) (The first reading of the ordinance was approved on April 23, 1998) Parker Drive does not currently have a speed zone ordinance in effect. At the request of several people working in the area, staff conducted a traffic and engineering study to determine the appropriate speed zone for this street. As a result of the study, staff is recommending that an ordinance be passed to establish a speed zone of 40 mph on Parker Drive from FM 1325 to the IH 35 West Frontage Road.
