G-98-02-12-12A - 2/12/1998ORDINANCE NO. v ` gpc) - - a AN ORDINANCE APPROVING RETAIL BASE REDUCTIONS FOR TEXAS UTILITIES ELECTRIC COMPANY, PROVIDING AN EFFECTIVE DATE THEREFOR, PROVIDING CONDITIONS UNDER WHICH THE RATE SCHEDULES AND SERVICE REGULATIONS OF TEXAS UTILITIES ELECTRIC COMPANY MAY BE CHANGED, MODIFIED, AMENDED OR WITHDRAWN, FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. On December 22, 1997, Texas Utilities Electric Company filed with the Governing Body of this municipality a Petition and Statement of Intent to implement base rate reductions for its retail electric service customers within this municipality, which base rate reductions are components of a settlement reached among various parties set forth in the Stipulation and Joint Application for Approval Thereof filed with the Public Utility Commission of Texas on December 17, 1997. II. The rate schedules implementing such retail base rate reductions that are approved for Texas Utilities Electric Company and set by the Public Utility Commission of Texas pursuant to the said Stipulation and Joint Application for Approval Thereof filed by said Company with the Public Utility Commission of Texas are hereby approved as the rate schedules implementing such retail base rate reductions within the corporate limits of this municipality K:\WPDOCS\ORDZNANC\OR80122A.WPD/scg until such time as the rate schedules of Texas Utilities Electric Company may be changed, modified, amended or withdrawn with the approval of the Governing Body of this municipality. III. The aforesaid rate schedules herein approved shall be effective from and after the date the Public Utility Commission of Texas orders the retail base rate reductions effective for Texas Utilities Electric Company, provided that, in order to effect uniform systemwide rates, such retail base rate reductions may be earlier placed in effect within this municipality to the same extent that such retail base rate reductions are earlier placed in effect pursuant to an order of the Public Utility Commission of Texas authorizing such retail base rate reductions on an interim basis in the territories over which the Public Utility Commission of Texas exercises original jurisdiction. IV. The filing of the rate schedules implementing such retail base rate reductions -- being Rider RRD - Residential Rate Reduction, Rider GSRD - General Service Secondary Rate Reduction, and Rider RD - Rate Reduction -- shall constitute notice to the consumers of electricity, within this municipality, of the availability and application of such rate schedules. V. Nothing in this Ordinance contained shall be construed now or hereafter as limiting or modifying in any manner, the right and power of the Governing Body of this municipality under the law to regulate the rates, operations, and services of Texas Utilities Electric Company. 2. VI. This ordinance shall take effect immediately upon its final adoption. VII. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. nd- READ and APPROVED on first reading this the �O " day of , 1998. Consider an ordinance approving the Texas Utilities Electric Company Retail Base Rate Reductions as set by the Public Utility Commission. (Second Reading) STAFF RESOURCE PERSON: David Kautz In a proposed settlement with the Public Utility Commission and other entities that will ultimately lead to deregulation of the electric utility industry in Texas, TU Electric is requesting approval of the following rate reduction schedule. Residential - 4% beginning January 1, 1998 (already in effect) Residential - 5.4% beginning January 1, 1999 (cumulative) General Service Secondary (small to medium commercial users) - 2% beginning January 1, 1998 Remaining retail customers (larger commercial, industrial) - 1 % beginning January 1, 1998 Provisions in the final agreement between the parties would apply to all participating cities.
