"q I- Ole - 3 3 A AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF ROUND ROCK, TEXAS, TO SUBMIT A PROPOSITION ON THE QUESTION OF THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX UNDER THE PROVISIONS OF SECTION 4B OF THE DEVELOPMENT CORPORATION ACT OF 1979; MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION. WHEREAS, the City Council of the City of Round Rock, Texas hereby finds that an election should be held for the purpose of submitting a proposition on the levy and collection of an additional sales and use tax within the City under the provisions of Section 4B of Article 5190.6 V.T.C.S. ("the Act"); and WHEREAS, the City Council further determines that the City is an eligible City under the provisions of the Act, in that the City would be eligible to adopt a Section 4A sales and use tax pursuant to the Act, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT I. An election shall be held on the 9th day of August, 1997, in the City of Round Rock, Texas, which date is not less than forty- five (45) days from the date of the adoption hereof, and is a uniform election date pursuant to V.T.C.A. Election Code, Section 41.001, for the purpose of submitting the following measure: "THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX WITHIN THE CITY AT THE RATE OF ONE-HALF (;4) OF ONE PERCENT AS AUTHORIZED BY SECTION 4B, ARTICLE 5190.6, V.T.C.S., AS AMENDED, WITH THE PROCEEDS THEREOF TO BE USED AND APPLIED FOR STREETS, ROADS, DRAINAGE AND OTHER RELATED TRANSPORTATION SYSTEM IMPROVEMENTS, INCLUDING THE PAYMENT C:\WPDOCS\ORDINANC\OR70617A.2WP/sls OF MAINTENANCE AND OPERATING EXPENSES ASSOCIATED WITH SUCH AUTHORIZED PROJECTS." II. The election shall be held at the polling places for the precincts designated on the attached Exhibit "A," which is made a part hereof for all intent and purposes. The polls at the designated polling places shall on said election day be open from 7:00 a.m. to 7:00 p.m. III. A. The presiding judge and alternate presiding judge for each of said polling places are also designated on the attached Exhibit "A", and each of said presiding judges and alternate presiding judges are hereby appointed the respective presiding judge and alternate presiding judge for each of said polling places for this election. Each of said respective presiding judges is hereby authorized to appoint the necessary election clerks (not less than 2 and not more than 6) to assist in conducting said election. B. For purposes of processing ballots cast in early voting, the precinct election officers should also serve as the Early Voting Board. IV. A. Early voting by personal appearance will be conducted at the following location on the dates and times indicated: 1. Round Rock Community/Senior Center 7/21 - 8/1 Weekdays 8 - 5 pm 221 East Main Street, Round Rock 8/4 - 8/5 Weekdays 8 - 7 pm 7/26 & 8/2 Saturdays 10 am - 7 pm 2 B. Applications for ballot by mail shall be mailed to: John Willingham Williamson County Elections Administrator P.O. Box 209 Georgetown, Texas 78627-0209 C. Applications for ballot by mail must be received no later than the close of business on August 1, 1997. V. Ballots and ballot labels shall be prepared in accordance with the applicable provisions of the Election Code so that the voters may cast their ballots either "FOR" or "AGAINST" the aforesaid measure which shall appear on the ballot substantially as follows: THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX WITHIN THE CITY AT THE RATE OF ONE-HALF (4z) OF ONE PERCENT AS AUTHORIZED BY SECTION 4B, ARTICLE 5190.6, V. T.C.S., AS AMENDED, WITH THE PROCEEDS THEREOF TO BE USED AND APPLIED FOR STREETS, ROADS, DRAINAGE AND OTHER RELATED TRANSPORTATION SYSTEM IMPROVEMENTS, INCLUDING THE PAYMENT OF MAINTENANCE AND OPERATING EXPENSES ASSOCIATED WITH SUCH AUTHORIZED PROJECTS." VI. This election shall be held and conducted in accordance with the provisions of V.T.C.A., Election Code and V.T.C.A., Tax Code, Subchapter E of Chapter 321, and the Act and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. VII. A substantial copy of this ordinance shall serve as proper notice of said election. Said notice, including a Spanish translation thereof, shall be posted not later than the 21st day before the election on the bulletin board used for posting notices of meetings of the City Council and shall also be published at least once not earlier than the 30th day nor later than the 10th 3 day before the election in a newspaper published and of general circulation in the City. VIII. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B.
